XXX explained that moving from 5% to 75% permitted investment levels was loosening of the restriction on investing in other companies, so would benefit employees. The change was being made because many US employees were already in breach of the threshold through pension-fund investment.
This had not been brought before the EWC because the original two-year consultation on the code had been overlong; a more flexible procedure would be needed for practical amendments to the code in the future, perhaps through the select committee or local HR and compliance functions.

XXX wyjaśnił, że przejście z dozwolonego 5% do 75% poziomu inwestycji było objawem rozluźnienia restrykcji na inwestycje w innych firmach, więc jest to korzystne dla pracowników. Zmiana ta wynikła z tego, iż wielu amerykańskich pracowników już wcześniej przekroczyło ten próg poprzez inwestycje w fundusz emerytalny. Europejska Rada Pracownicza (EWC) nie została o tym wcześniej poinformowana, ponieważ przedłużony został pierwotny dwu-letni okres na konsultacje. W przyszłości potrzebne będzie stworzenie bardziej elastycznej procedury umożliwiającej praktyczne zmiany w kodeksie, być może za pomocą rady nadzorczej, lokalnych działów do zarządzania zasobami ludzkimi oraz działów do spraw wymogów regulacyjnych.
