Source text - English A contract is a legally-binding agreement which recognises and governs the rights and duties of the parties to the agreement.[1] A contract is legally enforceable because it meets the requirements and approval of the law. An agreement typically involves the exchange of goods, services, money, or promises of any of those. In the event of breach of contract, the law awards the injured party access to legal remedies such as damages and cancellation.[2]
In the Anglo-American common law, formation of a contract generally requires an offer, acceptance, consideration, and a mutual intent to be bound. Each party must have capacity to enter the contract.[3] Although most oral contracts are binding, some types of contracts may require formalities such as being in writing or by deed.
Translation - Spanish Un contrato es un acuerdo que obliga a las partes, y que establece y gobierna los derechos y obligaciones de las partes del mismo. Un contrato se puede ejecutar y es obligatorio en la medida que cumpla con los requerimientos de la ley. Este acuerdo en general implica el intercambio de bienes, servicios, dinero, o bien promesas de uno u otro. En el caso de incumplimiento de contrato, la ley concede a la parte perjudicada la posibilidad de acceder a determinadas acciones judiciales, tales como la acción de años o bien la rescisión del contrato.
En el sistema de Common Law anglosajón, la formación del contrato generalmente requiere de Oferta, Aceptación, "Consideration" e Intención mutua de ser obligados por el mismo. Cada parte debe tener "capacidad" para suscribir el contrato.
Si bien en general los contratos verbales pueden ser obligatorios, algunos contratos pueden requerir formalidades especiales, tales como ser formalizados por escrito, o bien formalizados por escritura.
