Source text - Italian Il nocumento si considera grave quando abbia riguardato un numero di risparmiatori superiore allo 0,1 per mille della popolazione risultante dall’ultimo censimento ISTAT ovvero se sia consistito nella distruzione o riduzione del valore dei titoli di entità complessiva superiore allo 0,1 per mille del prodotto interno lordo.
La punibilità per i fatti previsti dal primo e terzo comma è estesa anche al caso in cui le informazioni riguardino beni posseduti o amministrati dalla società per conto di terzi.
La punibilità per i fatti previsti dal primo e terzo comma è esclusa se le falsità o le omissioni non alterano in modo sensibile la rappresentazione della situazione economica, patrimoniale o finanziaria della società o del gruppo al quale essa appartiene. La punibilità è comunque esclusa se le falsità o le omissioni determinano una variazione del risultato economico di esercizio, al lordo delle imposte, non superiore al 5 per cento o una variazione del patrimonio netto non superiore all’1 per cento.
In ogni caso il fatto non è punibile se conseguenza di valutazioni estimative che, singolarmente considerate, differiscono in misura non superiore al 10 per cento da quella corretta.
Nei casi previsti dai commi settimo e ottavo, ai soggetti di cui al primo comma sono irrogate la sanzione amministrativa da dieci a cento quote e l’interdizione dagli uffici direttivi delle persone giuridiche e delle imprese da sei mesi a tre anni, dall’esercizio dell’ufficio di amministratore, sindaco, liquidatore, direttore generale e dirigente preposto alla redazione dei documenti contabili societari, nonché da ogni altro ufficio con potere di rappresentanza della persona giuridica o dell’impresa”.

The acts referred to in the first and third subsection are sanctioned even if the statements are about goods or merchandises owned or managed by the firm for third parties.
The same acts are not sanctioned if false or wrong statements did not clearly change the estimation of the firm’s goods, finances and accounts. Moreover, there is no sanction if false or wrong statements are liable of a variation of the yearly report for a value of less the 5 % or for a variation of the total worth for a value of less the 1 %.
However the act will not be sanctioned if it was caused by choices and assessments, that , taken one at a time, differed from the correct values for less than the 10 %.
In the situations referred in subsection seven and eight, the subjects, as told in the first subsection, get an economic sanction valued between ten and hundred quotas, and a ban from being part of the firm governing council for six months to three years, a ban from the role of CEO, inspector, liquidator, general director and accounting manager with the power to compile the firm’s books, and on top of that is forbidden for them to cover any role on behalf of said firm or group”.
