Source text - English After reviewing the documents and hearing the summarized report ensued by the competent Judge/ --------------------------------------------, and after the deliberation.
Whereas, the Appeal has fulfilled all of its formal conditions.
Whereas, the facts – as shown in the Appealed Judgment and the remaining relevant documents – are summed up in that the Appellant Company has lodged Case No. --/2012 (Plenary Commercial) in which it has sought a relief by: First: Adding and attaching the Petition Order File No. --/2012 (Civil) issued on --/--/2012, along with the Travel Ban Order issued against the Second Appellee, seizing his passport and depositing the same into the Court`s Treasury and issuing a Circular Order against him in all the country`s exits; Second: Binding both Appellees to impeach, jointly and severally, an amount of $ US -------- . In witness whereof; the Appellant has declared that it is a Company established in Dubai Airport Free Zone, working in diamond import and export field, and that it has sold a diamond consignment to one of the companies located in Greece, valued at $ US ---------, and that the Second Appellee, who was working as a Manager at the Appellant Company, has addressed a letter to the aforesaid Greek Company on --/--/2010 in which he has requested the Greek Company to transfer the bargain amount to the First Appellee`s bank account despite of the lack of relationship between both of them, and after the Second Appellee`s leave to the work at the Appellant Company and after he has joined his new job at the Greek Company, both; the Second Appellee and the Greek Company have taken over the Appellant Company` funds, for which the Appellant has filed the case. The Court has delegated an Expert, and upon the Court`s receipt to the Expert`s report; the Court has rendered a judgment on --/--/2013 by rejecting the case due to the lack of capacity of the Second Appellee, along with binding the First Appellee to pay to the Appellant the whole claim amount or what is equivalent to the same in UAE Dirhams, in addition to 9% as a legal interest from the date of the judicial claim till the full payment. The Appellant/Plaintiff has lodged an Appeal against the aforementioned judgment by virtue of Appeal No. --/2013 (Commercial Appeal) and the Court has referred the same errand back to the Expert. Upon the Expert`s issuance to his final report, the Court has issued its judgment in respect of the same on --/--/2015 by rejecting the Appeal and affirming the Appealed Judgment, while the Appellant has challenged the said judgment before the Court of Cassation by virtue of a statement of claim which has been submitted to the Court`s Registry on --/--/2015, whilst the Second Appellee has submitted his pleading brief in which he has sought the rejection of the Appellant`s Appeal/Challenge and the Advisory Chamber has set a date to review the same.

وحيث أن، الوقائع – كما تظهر في الحكم المطعون فيه والوثائق الأخرى ذات الصلة – قد تم تلخيصها في أن الشركة المستأنِفة قامت بتقديم الدعوى رقم --/2012 (الجلسة العامة التجارية) والتي التمست فيها الانتصاف عن طريق: أولًا: إضافة وإرفاق ملف طلب العريضة رقم --/2012 (مدني) الصادر في --/--/2012، بالإضافة إلى أمر حظر السفر الصادر ضد المستأنف ضده الثاني، والتحفظ على جواز سفره وإيداعه خزانة المحكمة وإصدار تعميم ضده في جميع مخارج البلاد؛ ثانيًا: إلزام كلًا من المستأنف ضدهم مجتمعين ومنفردين بدفع مبلغ -------- دولار أمريكي. وإشهادًا لذلك، أعلن المستأنف أنها شركة تأسست في منطقة مطار دبي الحرة وتعمل في مجال استيراد وتصدير الماس، وأنها باعت شحنة من الماس إلى إحدى الشركات الموجودة في اليونان، بقيمة -------- دولار أمريكي، وأن المستأنف ضده الثاني والذي كان يعمل مديرًا في الشركة المستأنفة، قد وجه رسالة إلى الشركة اليونانية المذكورة بتاريخ --/--/2010 طلب فيها تحويل مبلغ الصفقة إلى الحساب البنكي للمستأنف ضده الأول رغم عدم وجود علاقة بينهما، وبعد ترك المستأنف ضده الثاني العمل في الشركة المستأنفة وبعد التحاقه بوظيفته الجديدة في الشركة اليونانية، قام كلًا من المستأنف ضده الثاني والشركة اليونانية بالاستيلاء على أموال الشركة المستأنفة، وهو ما قامت الشركة المستأنفة برفع القضية بشأنه. وقد فوضت المحكمة خبيرًا، وعند استلام المحكمة لتقرير الخبير؛ أصدرت المحكمة حكمًا في --/--/2013 برفض الدعوى بسبب عدم أهلية المستأنف ضده الثاني، بالإضافة إلى إلزام المستأنف ضده الأول بدفع مبلغ الدعوى بالكامل أو ما يعادله بالدرهم الإماراتي إلى المستأنف، بالإضافة إلى 9% فائدة قانونية من تاريخ الدعوى القضائية حتى السداد الكامل. قدم المستأنف/المدعي طعنًا في الحكم السالف الذكر بموجب الطعن رقم 2013/2013 (الطعن التجاري) وأحالت المحكمة نفس الخطاب إلى الخبير. وبعد إصدار الخبير لتقريره النهائي، أصدرت المحكمة حكمها فيما يتعلق بذلك في --/ --/ 2015 برفض الطعن وتأكيد الحكم المطعون فيه، في حين طعن المستأنف في الحكم المذكور أمام محكمة التمييز بموجب عريضة الدعوى التي تم تقديمها إلى قلم المحكمة بتاريخ --/--/2015، بينما قدم المستأنف ضده مذكرة مرافعة طلب فيها رفض استئناف/طعن المستأنف وحددت الغرفة الاستشارية تاريخًا لمراجعتها.

Source text - English CAIRO: Prime Minister Ibrahim Mahlab met with UAE Minister of Investment Sultan Ahmed Al-Jaber in Cairo Tuesday to discuss the progress in projects within the Egyptian development program. The UAE will provide Egypt with U.S. $4.9 billion. The money is to be used in several projects to develop service sectors, in addition to improving the living conditions of the Egyptian people. There have been also discussions regarding future cooperation and investment in many fields. Al-Jaber said that there must be quick solutions for the problems that face Emirati investments in Egypt, expressing his appreciation for Egypt’s efforts to develop the laws that protect investors and investments. He stated that such laws would encourage national and international investors to invest in Egypt. He also added that Egypt needs to improve laws regarding investment to reassure investors that their rights are reserved. This is accomplished “through enforcing the law and creating new laws to protect investors to increase investment in Egypt,” he added to Al-Hayah Al-Youm.
