6.1 COMPETENT AUTHORITIES PERFORMANCE
• Responsibilities between the CAs are clearly defined and distributed.
• Horizontal and vertical communication pathways within and between Customs and the NSVFSA are established in accordance with Articles 4(3)(5) and 24 of Regulation (EC) No 882/2004.
• Training is ongoing but was considered not to be in line with Article 6 (a) of Regulation (EC) No 882/2004 due to the inconsistent manner of official controls observed during the mission.
• There are no audits in place as required by Article 4(6) of Regulation (EC) No 882/2004.
• The contingency plans do not cover food and feed as required by Article 13 of Regulation (EC) No 882/2004.
6.2 LEGISLATION
• The dissemination of EC legislation and implementing instructions is adequate.
6.3 IMPORT CONTROLS
• Products subject to Commission Decision 2006/504/EC are released on the Romanian market without completion of Annex III to the Decision. Products which are transited via other MS with the final destination in Romania are not always subject to controls as required by the Decision. They are controlled by the CA at the FBO’s request after customs release.
• The frequency of controls of foodstuffs affected by Commission Decision 2006/504/EC presented by the CA was adequate.
• A specific annual control programme is implemented, which establishes the frequency and place of sampling for products subjected to an increased level of official control but not included in Commission Decision 2006/504/EC.
• No measures are envisaged as regards sampling and analysing products subject to Commission Decisions 2005/402/EC, 2008/352/EC and 2008/433/EC due to lack of analytical capability.
• Physical checks are carried out under suitable conditions and at a place with access to adequate control facilities. Adequate equipment was available as established in Articles 16(3) and 4(2)(d) of Regulation (EC) No 882/2004.
• At the company visited, the inspector did not fully assess HACCP as required by Article 10(2)(d) of Regulation (EC) No 882/2004 or traceability (Article 18 of Regulation (EC) No 178/2002).
6.4 RAPID ALERT SYSTEM FOR FOOD AND FEED
• Romania has clearly designated its NCP and the network connecting the authorities in charge of food and feed to it. EC RASFF information and news notifications are adequately distributed.
• Not all border rejections are effectively notified to EC RASFF, what is not in line with Article 19(3) of Regulation (EC) No 882/2004.
Translation - German Schlussfolgerungen
6.1 AUFGABENWAHRNEHMUNG DURCH DIE ZUSTÄNDIGEN BEHÖRDEN
• Die Verantwortlichkeiten sind eindeutig festgelegt und den zuständigen Behörden zugewiesen.
• Innerhalb der Zollbehörde und der Nationalen Behörde für Veterinärwesen und Lebensmittelsicherheit sowie zwischen diesen beiden Behörden sind horizontale und vertikale Kommunikationswege vorhanden, wie in Artikel 4 Absätze 3 und 5 sowie in Artikel 24 der Verordnung (EG) Nr. 882/2004 vorgeschrieben.
• Schulungen werden fortlaufend organisiert, doch aufgrund der uneinheitlichen Vorgehensweise bei den während des Inspektionsbesuchs beobachteten amtlichen Kontrollen kam das Inspektionsteam zum Schluss, dass sie nicht Artikel 6 Buchstabe a der Verordnung (EG) Nr. 882/2004 gerecht werden.
• Es werden keine Überprüfungen durchgeführt, was gegen Artikel 4 Absatz 6 der Verordnung (EG) Nr. 882/2004 verstößt.
• Die Notfallpläne beziehen sich nicht auf Futtermittel und Lebensmittel, was gegen Artikel 13 der Verordnung (EG) Nr. 882/2004 verstößt.
6.2 RECHTSVORSCHRIFTEN
• Die Verbreitung der gemeinschaftlichen Rechtsvorschriften und Durchführungsanweisungen ist angemessen.
6.3 EINFUHRKONTROLLEN
• Erzeugnisse, die der Entscheidung 2006/504/EG der Kommission unterliegen, werden auf dem rumänischen Markt in Verkehr gebracht, ohne dass das Dokument nach Anhang III dieser Entscheidung ausgefüllt wird. Erzeugnisse mit Endbestimmung in Rumänien, die durch andere Mitgliedstaaten durchgeführt werden, werden nicht immer kontrolliert, entgegen den Anforderungen der Entscheidung. Sie werden auf Anfrage des Lebensmittelunternehmers nach der zollrechtlichen Überlassung von der zuständigen Behörde kontrolliert.
• Die von der zuständigen Behörde angeführte Kontrollhäufigkeit bei Lebensmitteln, die der Entscheidung 2006/504/EG der Kommission unterliegen, war angemessen.
• Für Erzeugnisse, die einer intensiveren amtlichen Kontrolle unterliegen, jedoch nicht von der Entscheidung 2006/504/EG der Kommission abgedeckt werden, wurde ein spezielles jährliches Kontrollprogramm eingerichtet, das die Häufigkeit und den Ort der Probenahmen festlegt.
• Aufgrund unzulänglicher analytischer Kapazität sind keine Maßnahmen in Bezug auf die Beprobung und Untersuchung von Erzeugnissen vorgesehen, die den Entscheidungen 2005/402/EG, 2008/352/EG und 2008/433/EG unterliegen.
• Die Warenuntersuchungen erfolgen unter geeigneten Bedingungen an einem Ort, der Zugang zu entsprechenden Kontrolleinrichtungen hat. Es waren geeignete Ausrüstungen vorhanden, wie in Artikel 16 Absatz 3 sowie Artikel 4 Absatz 2 Buchstabe d der Verordnung (EG) Nr. 882/2004 vorgeschrieben.
• In dem vom Inspektionsteam besuchten Unternehmen wurden das HACCP-System entgegen den Anforderungen von Artikel 10 Absatz 2 Buchstabe d der Verordnung (EG) Nr. 882/2004 und die Rückverfolgbarkeit (Artikel 18 der Verordnung (EG) Nr. 178/2002) nicht ausschöpfend vom Kontrolleur bewertet.
6.4 SCHNELLWARNSYSTEM FÜR LEBENS- UND FUTTERMITTEL (RAPID ALERT SYSTEM FOR FOOD AND FEED, RASFF)
• Rumänien hat eindeutig seine RASFF-Kontaktstelle und das Netz festgelegt, über das die für Futter- und Lebensmittel zuständigen Behörden mit der Kontaktstelle verbunden sind. Die von der Kommission im Rahmen des RASFF herausgegebenen Informationen und Meldungen werden angemessen weitergegeben.
Nicht alle Zurückweisungen an den Grenzkontrollstellen werden wirksam über das RASFF der Kommission gemeldet, was gegen Artikel 19 Absatz 3 der Verordnung (EG) Nr. 882/2004 verstößt.
