supsidijarnost, mozda bi cak moglo da se prevede i kao ..zakonska prednost Explanation: ukratko ovo je njegov smisao: prednost boljeg rešenja kod usvajnja, vodi se racuna o najboljem interesu deteta -to je osnovni princip u usvajanju najbolje je da dete ostane u biloškoj, prirodnoj prodici. ali ako to nije moguce onda se gleda da bude kod rodjaka, npr. ako to nije moguce onda se gleda da bude u istoj zemlji, ako to nije moguce tj. ako to nije u najboljem interesu deteta onda se ide na medjudrzavno usvojenje. Medjutim, nekad se desava da se o detetovim interesima bolje vode racuna ako se da na usvojenje u drugoj zemlji nego, npr. kod rodjaka, a sto bi trebalo po principu supsidijarnosti. Evo nekoliko primera: he principle of subsidiarity implies that before the authorities of the child's country of origin allow an intercountry adoption, they must determine that the child can not be suitable placed in a family in that country. subsidiarity- supsidijarnost Respect for the principle of subsidiarity – which requires that adoption should only be considered once all measures to maintain the child in his biological family have been exhausted – must be amongst the questions that must be raised before deciding on a child’s adoptability. Given that the competent authorities of the country of origin must first examine all possibilities for the child’s placement in his state of origin, and given that adoption is in itself a subsidiary child protection measure, intercountry adoption thus becomes twice subsidiary. A concrete implementation of the principle of subsidiarity naturally encourages domestic adoption. This approach already exists in many countries of origin, but it naturally implies a political will and budgetary efforts which are not always combined.
