What is the section 21 notice
Under the Housing Act 1988, a landlord has a legal right to repossess his/her property at the end of an assured shorthold tenancy. To do it legally, however, the owner must operate within strictly defined procedures. The first step of every procedure is the section 21 notice. It’s a letter of notification that the landlord must serve to the tenant, prior to the eviction. The notice to quit is purely informational and doesn’t carry any legal power.

You must follow strict procedures if you want your tenants to leave your property.
Use ‘standard possession’ if you want your property back because your tenants owe you rent. If your tenant is on Housing Benefit or Universal Credit, you can ask for the rent to be paid directly to you instead. This is known as ‘managed payments’.
Step 1) Section 21 and Section 8 notices

Step 2) Apply to the court for a standard possession order if your tenants don’t leave by the specified date. You can apply for an accelerated possession order if you’re not claiming any unpaid rent.

Step 3: Apply for a warrant for possession if your tenants still won’t leave - this means bailiffs can remove the tenants from your property.

There are 2 main routes private landlords can take to regain possession of their property under the Housing Act 1988:
Section 21 gives a landlord an automatic right of possession without having to give any grounds (reasons) once the fixed term has expired
Section 8 allows a landlord to seek possession using grounds 2, 8, 10 to 15 or 17 listed in Schedule 2 to the Act
These include rent arrears and anti-social behaviour.
In all cases you must give your tenant written notice, usually at least 2 months, of your intention to regain possession.

Section 21 notice of seeking possession
You can use a Section 21 notice if:
your tenants have a written assured shorthold tenancy (AST) or statutory periodic tenancy agreement
you put their deposit in a deposit protection scheme if the tenancy started after April 2007
Fixed-term tenants can’t be evicted until their tenancy ends. If the fixed term has expired the notice must end on the last day of the rental period.
A Section 21 notice must give your tenants at least 2 months’ notice to leave your property.
Section 8 notice of seeking possession
To give your tenants notice using a Section 8, you must fill in a ‘Notice seeking possession of a property let on an assured tenancy or an assured agricultural occupancy’.
You can give between 2 weeks’ and 2 months’ notice depending on which terms of the tenancy they’ve broken.
You can apply to the court for a possession order if your tenants don’t leave by the specified date.
