اما من يقول انها تشهير بالخصم فهذه قضية يرفع عليها في المحاكم
Defamation or slender = التشهير الكتابي واللفظي
ولكن مغالطة تسميم البئر هي تشويه لافكار الخصم بشكل مسبق بحيث لو طرح فكرته اما الجمهور لما تقبلوها لان الخصم الاول عرف كيف يسمم اي يشوه المصادر الفكرية التي ينهل منها امام جمهور الخصم الثاني
