English to Romanian Other Law (general)

Provider shall indemnify, defend and hold FIRM harmless from and against any and all losses, costs, liabilities or expenses arising from a claim that any Product infringes any patent [...].
If Provider does not promptly assume the defense of the claim, or if after the assumption of the defense by Provider, Provider has failed to defend the claim diligently, FIRM shall have the right to defend the claim in such manner as it may deem appropriate.

Nu mi-e foarte clara exprimarea asta, meaning that eu inteleg ca este vorba despre "apararea impotriva unei pretentii", insa, am vazut ca aceasta formulare poate fi atat "defense against a claim", cat si "defense of the claim".

Exista vreo diferenta intre cele doua sau sensul lor e acelasi si anume de a se apara impotriva unei pretentii?
