Once the evidence has been obtained of a charge on theproperty by a Creditor, the Buyer would need to formally notify the Seller - in the form of a letter sent by recorded delivery post with receipt (raccomandata con ricevuto di ritorno) of their intention to terminate the contract given the existence of one of the factors deemed to indicate the "situation of crisis" and the Buyer may then claim reimbursement directly from the guarantor without the need for any court proceedings to prove breach of contract or claim damages.The Buyer would not however lose his right to claim for damages in the courts, by way of double of the deposit, however if the Seller was insolvent this may no longer be possible.

Vuol dire che all'Acquirente rimane l'azione di richiesta di risarcimento del danno subìto e che il valore del risarcimento corrisponde al valore del deposito cauzionale della fidejussione x 2, moltiplicato due,
"L'Acquirente può citare il Venditore in tribunale per danni il Venditore, nella misura del valore della cauzione moltiplicato per due"
