Spanish to English Law/Patents Law (general)
This phrase occurs in a legal document concerning (the start of) a case in a LATAM country. It looks like it should be something like "procedural filing", but is there a definite legal equivalent in UK English that makes sense to a legal audience?

Esta invocación procesal no constituye acción, ni recurso o instancia procesal, simplemente.....

Not really... I wanted the rest of the sentence because it presumably explains what the document is, but never mind.

Hola FVS and many thanks. Procedural argument fits, as the document seems to be setting out the grounds for taking action, rather than starting the action itself. The case (potential) is a challenge to a court decision in Ecuador, based on the Right to Resistance - the right to challenge/upturn decisions by public administrations which infringe constitutional rights. But it´s a fine dividing line as the document is targetted at the judges who arrived at the original decision. Many thanks, and points to follow! Best wishes. Sian.

"procedural argument" would be fine in an appeal put forward by a party, but as you have stated this is the beginning of proceedings" this is a better fit.
