oblique intent

Explanation:

agree  Adrian MM. (X): The other answers should really be analysing any difference with conditional intent & transferred malice: http://www.proz.com/kudoz/spanish_to_english/law_general/375... - 'una forma di dolo indiretto' suggests more than recklessness.

reckless endangerment

Explanation:
some more context would be useful but essentially someone is guilty of "dolo eventuale" where their actions are not specifically deisgned to cause the end event but said end event was a reasonably possible result of their actions.

context is needed because this could be classified in different ways depending on what the end event was. For instance if your reckless actions result in another person's death, this would be classified as manslaughter in England and Wales.

neutral  Michele Armellini: If you choose this tack, why not just "recklessness"? "Endangerment", AFAIK, implies crimes against persons, while we have no clue that this is the case. Just curiousity, not a critique.
20 mins
-> you are right. Without more context it's very difficult. Is there a contractual relationship between the parties? What is the even that has occured / damage suffered. If damage to property reckless endagerment (of property could still be used).

neutral  Sylvia Gilbertson: I agree that it could well be reckless endangerment in a criminal case, but this is apparently a civil case.
51 mins
-> you are correct...the precise english term would very much depend on the context. I tried to make that clear in my explanation whilst also explaining the concept.

neutral  Michele Armellini: The definition you provide seems to make this fall within the realm of "colpa", which under the Italian law automatically excludes "dolo".
22 hrs
-> No, Michele. Gross negligence is not "colpa" per se, gross negligence is the standard against which you measure intent. In an action for negligence, there are several types each of which depends on the state of mind of the actor.
