Vielen Dank für eure Hilfe. Es geht hier um die Herausgabe der Vorbehaltssache: Der Satz vor diesem Satz (selber Absatz) lautet: XY ist berechtigt, die Vorbehaltssache sicherzustellen, falls der Kunde seine vertraglichen Verpflichtungen nicht erfüllt, insbesondere die Vorbehaltssache unsachgemäß behandelt oder mit der Kaufpreiszahlung in Verzug gerät.

I would probably term the sentence something like this: "The actual surrender of possession and seizure (or whatever word you decide to use for "Sicherstellung") is deemed to be [...]."

As far as "Vollzug" is concerned, I don't think this has anything to do with enforcement, but rather that such action (here the surrender of possession) has actually been carried out.

Dietl /Lorenz (5th ed.) provides the following suggested translations:

Herausgabe (Übertragung des unmittelbaren Bestizes) surrender (of possession); (Rückgabe) return (of property), giving back, restoration; (Rückgabe unrechtmäßig erworbenen Eigentums) restitution; (Aushändigung) delivery, handing over; (Veröffentlichung) publication; [...].

vollziehen to execute, to accomplish, to carry out; to enforce; [...].

agree Dr. Christopher Brooks : Good, but I would keep "actual" out of it. "Relinquishment" might work for handing over, especially if the law was written pre-1900.

Jetzt ist es klarer.
Ich verstehe den Satz jetzt so:
Wenn der Kunde die Vorbehaltssache nicht freiwillig herausgibt und der Verkäufer deshalb ein Exekutionsverfahren (= Vollzug) führen muss oder die Sache sicherstellt, bedeutet das den Rücktritt vom Vertrag.

The party will have to turn to the courts if the other party does not surrender the object voluntarily. The logical consequence is that the contract will be rescinded. Rescission is a consequence, not the aim of the enforced surrender
