The said article provides for, in its first paragraph, the application of the lex loci commissi delicti, in other words, that the law that applies to the substantial relation is the one used in the place where the event had occurred. But the monopoly of this rule, which typified the normative panorama prior to Public Law No 218/1995, is challenged by the second paragraph of the same article, which identifies in the lex patriae the law that may be applied in the case where the unlawful act had involved only resident citizens of the same State.
