Si tratta dello studio effettuato da un consulente fiscale sugli aspetti tributari della vendita di due proprietà immobiliari site in Croazia ed appartenenti ad una società italiana.

Due premesse indispensabili:
1) il testo non è scritto da un madrelingua;
2) nel 2002, l'Amministrazione fiscale ha concesso alla società l'esclusione dal sistema IVA che la società aveva sollecitato. Problema: si sono verificate diverse irregolarità e l'Amministrazione non avrebbe mai dovuto emettere il Decree (che io ho pensato di tradurre come "atto" o "ordinanza") di esclusione. Sta di fatto che lo ha fatto.

However, in accordance with the formal period of limitation of rights Tax Authorities have for taking actions for the purpose of determining tax liabilities, repealing of the Decree on the Company’s exit from the VAT system and ordering the Company to retrospectively restore used and refunded prepaid tax in order to exit the VAT system, an ******absolute limitation***** occurred, hence Tax Authorities have no right to re-examine the integrity of the Decree from 2002 and 2003, by which the taxpayer proceeded, and has been proceeding since.

Mia traduzione provvisoria:

A ogni modo, se si prende in considerazione il periodo formale di limitazione dei diritti (???) a disposizione dell’Amministrazione fiscale per determinare eventuali debiti d’imposta, annullare l’atto di esclusione della Società dal sistema IVA ed esigere la restituzione delle imposte anticipate, utilizzate e rimborsate (???) − passo previo all’esclusione dal sistema IVA −, è evidente che si è verificata una ********limitazione assoluta*********** (???); l’Amministrazione fiscale, di conseguenza, non ha alcun diritto di riesaminare l’integrità dell’atto del 2002 e 2003, in base al quale il contribuente ha agito sino ad oggi.
