English term

Predatory Soliciting Clause

English to Arabic Law/Patents
contractual promise to the employing company under which a contractor, usually an ex-employee, agrees not compete with the original client by contracting with business competitors. Also found in third party contracts with agencies or brokers. These clauses are enforced, although courts will look unfavorably on a clause that imposes an undue hardship on the employee, such as a broad prohibition that forecloses an employee from working in his/her particular trade, or that has an unnecessarily broad geographic scope or time frame.

بند تفادي المنافسة الجائرة

Cambridge defines predator, inter alia, as:

If a company uses predatory pricing, it offers goods at such a low price that other companies cannot compete with it.
The airline has reduced its prices so sharply that it has been accused of predatory pricing.

So preditory is sort of unfair competition. Since the ex-employee might have access to company pricing policy.

Solicitation is defined as:

solicitation
noun
FORMAL
The solicitation of business was regarded as unethical. [U]
They endured regular telephone solicitations by double glazing companies. [C]

Therefore Preditory Soliciting Clause is designed to provide legal protection for employers from unfair competition by their ex-employees. Therefore the Arabic term could be constructed as following:

بند التعهد بالإمتناع عن المنافسة الجائرة

بند التعهد بالإمتناع عن المنافسة المجحفة

بند تحاشي المنافسة الجائرة

بند تفادي المنافسة الجائرة
