Samo na osnovu mog osjećaja, na žalost nemam primjer kojim bih ovo potkrijepila. Možda bi pomoglo da navedete i član 9 (c), možda se iz njega može nešto bolje razaznati.

1) you could also say '...shall be considered insolvent'...
poduzetnici se smatraju nesolventnimi(bankrotiranimi?) sukladno
though since you suggest this already it may not work stylistically in Croatian
2) It may also be possible to say '...shall be declared insolvent' but in this case it would have to be an official announcement by a court e.g. the court declared / pronounced him insolvent, you may use something with 'izreci'

OK, thanks for the additional context.
I would go for 'se smatraju nesolventnimi' not bankrupt since this is only within the confines of what appears to be a contract rather than an official declaration by a court.

Synonyms in English would be: considered / assumed to be (which is near Miomira's response) / regarded as / viewed as
if that helps.

I did wonder about that but found multiple references on banks' and government websites. What would be the proper adjective then?

(c) Deemed Insolvency
Either party shall be deemed insolvent (the “Insolvent Party”) if it (A) makes any voluntary arrangement with its creditors or becomes subject to an administration order or goes into liquidation (otherwise than for the purposes of amalgamation or reconstruction); or (B) an encumbrancer takes possession of, or a receiver any award judgement may be entered on an award by any court of competent jurisdiction.
