  -> собственно из этого я и исходил. ведь в предложении явное противпоставление тов. Блэка истцу, т.е. мне показалось, что следовательно тов. Блэк не истец

  -> мне кажется, что автора запроса больше интересует все-таки форма предложения, а не вопросы терминологии. В остальной части тектса он скорее всего уже использует какой-то перевод "истца".
agree  cheeter: только если это английское право, то "истец" будет "claimant" (после реформы 1998 г. "plaintiff" в гражданском судопроизводстве заменен на "claimant", поскольку иск - это "claim"). - А у меня степень магистра права получена в Кембридже в 2002 гг.

  -> надо сказать, что за последние 5 лет я переводил документацию, связанную по крайней мере с тремя достаточно крупными процессами, которые велись в Англии, так там истец всегда назывался именно "Plaintiff", хотя в данном случае вопрос не в этом состоит
