Το κοινοτικό δίκαιο δεν απαγορεύει την εξάρτηση της αιτήσεως επιστροφής δασμών ή φόρων αντιθέτων προς το κοινοτικό δίκαιο, επί ποινή απαραδέκτου, από μη έχουσα αναδρομική ισχύ προϋπόθεση κοινοποιήσεως στη φορολογική υπηρεσία στην οποία υποβλήθηκε η δήλωση εισοδημάτων του ενδιαφερομένου κατά την αντίστοιχη φορολογική περίοδο.
