English term

to set off any claims against YY´s claims on him

English to French Other Law: Contract(s)
XX is not entitled to set off any claims against YY´s claims on him, unless his claims are not contested on the part of YY.

Discussion

This shall also apply if individual claims or all of YYs claims have been included in a current account and the balance has been struck and accepted.

XX shall be entitled to resell or use the Products in the ordinary course of his business, even before he acquires title to the Products, provided that he herewith assigns all claims and ancillary rights against the respective buyer or third parties that are derived from the effected sales

XX's claims for defects require that he has properly complied with his obligations to inspect the Products upon delivery and to notify YY

Selected
