sud doista "ima nadležnost" u odnosu na ceo predmet (ne samo u odnosu na tuženika) ali naglasak je na tome da ta nadležnost pre nekog određenong datuma nije postojala.

Rečenica glasi The court acquired jurisdiction of the respondent on (date). Mislim da prijevod Sud ima nadležnost prema tuženiku u ovom kontekstu nema smisla. Zahvaljujem na pomoći

It doesn't happen often - the jurisdiction of a tribunal is perceived as something durable/permanent, but nothing is for ever.
What may happen more frequently is that some of the legislation applicable to the case changes, but here the whole case has been transferred to another tribunal as it has become competent / its jurisdiction changed.

39. Sud primećuje da on nije imao nadležnost u vezi sa ovim postupkom do 3. marta 2004. godine kada je Srbija ratifikovala Konvenciju. Sud smatra da period koji spada u njegovu nadležnost ratione temporis u odnosu na sporni postupak nije trajao neopravdano dugo, posebno zato što su u ovom periodu sudovi doneli dve presude na dva nivoa.

39. The Court observes that it did not acquire jurisdiction with respect to these proceedings until 3 March 2004 when Serbia ratified the Convention. The Court does not consider that the period falling within its competence ratione temporis in relation to the impugned civil proceedings lasted unreasonably long, in particular as, within this period the courts delivered two judgmentsat two levels.

disagree Daryo : in this particular sentence you can get away with that approximate translation ("nije imao"= didn't have) but strictly speaking it's not accurate, not exactly the same as "didn't acquire"
