An exclusion from a civil liability insurance policy:

...sont de même exclus les dégâts de passage aux voies et propriétés publiques ou privées.

I read it as "damage caused to public/private thoroughfares/property from the simple fact of using them/passing by them". Would "incidental damage" be correct? Otherwise, I predict the need to paraphrase!

If this exclusion were not incorporated, would there be cover for damage caused to the public highway by using it? "Passage" here is about rights-of-way, which raises the question of whether the rights-of-way referred to are used by the owner to access the highway or private property, or whether they are rights across the owner's land used by others.
