O trabalho em questão versa sobre os desafios para a elegibilidade de mulheres lésbicas como solicitantes de refúgio com base em orientação sexual. Investigo como os pressupostos ocidentais modernos de formação do Estado-nação, das noções de cidadania, de legalidade e ilegalidade são obstáculos para o reconhecimento jurídico de mulheres que amam mulheres e foram perseguidas em seus Estados de origem, não tendo outra opção a não ser fugir.
Meu interesse reside em investigar como a regulamentação da fronteiras e sexualidade podem ser associadas ao lidar com refugiadas lésbicas, pois observamos problemas no que diz respeito ao reconhecimento de certos estados sobre o medo bem fundamentado de perseguição por orientação e / ou identidade de gênero como categoria passível de refúgio.
Interessa-me avaliar como as construções de nexo causal no campo do Direito dizem mais respeito às visões do tomador de decisões do que às múltiplas possibilidades de vivências e experiências de mulheres lésbicas oriundas de Estados do Sul Global.
Dentro os desafios de nexo causal estão a dificuldade de comprovar fundado temor de perseguição quando esta vem de atores não-estatais e frequentemente ocorre no âmbito privado.
Proponho portanto uma análise de que o pessoal é internacional (Enloe, Cynthia Enloe, 2018) e que questione a suposta coerência entre os enquadramentos sobre o que é ser refugiada e o que é ser lésbica, transgredindo a verdade do sexo (Foucault, 1980) e do refúgio (Spijkerboer, 2011)
Como metodologia, baseio-me em análise documental e análise de discurso de processos jurídicos de solicitação de refúgio que ocorreram entre 2005 e 2016 na Inglaterra, além análise bibliográfica dos acúmulos que autoras de refúgio tem feito sobre a invisibilidade lésbica. (Wessels, 2011; 2013). Analiso como os pressupostos envolvidos no reconhecimento de uma mulher lésbicas relacionam-se a uma visão heteronormativa e ocidental sobre dissidências sexuais, levando essas mulheres a terem de buscar provas de sua sexualidade, seja através de narrativas, seja através do corpo (performance, imagem, diagnóstico patologizante, etc) enquanto a heterossexualidade nunca precisa ser comprovada (Blank, Hanne, 2013). Nesse sentido, aponto pistas de como uma política do refúgio pode ser menos colonizadora (Dustin, Moira, 2018) e mais sensível a compreender diferentes realidades e corporalidades do que é ser lésbica ao redor do mundo.
Introduction
Os debates tradicionais de refúgio não levam em conta questões de gênero. O imaginário social sobre refugiado é de um homem. Os principais documentos internacionais que versam sobre o direito dos refúgio não fazem menção explícita à questões de gênero.
As solicitações de refúgio com base em orientação sexual e identidade de gênero começam a aparecer nos anos 1990, segundo Janna Wessels (2011). Nos anos 2000, o Alto Comissariado das Nações Unidas cria uma diretriz com recomendações específicas para dissidências sexuais (UNHCR, 2011). O debate sobre refúgio e diversidade sexual cresce à medida que a pauta dos direitos humanos para dissidências sexuais ganha maior visibilidade no cenário internacional e no direito internacional dos direitos humanos. Alguns Estados começam a compreender a orientação sexual e a identidade de gênero como elementos constitutivos e imutáveis de uma pessoa.
O objetivo deste trabalho todavia, é apontar para questões específicas de mulheres lésbicas que são solicitantes de refúgio com base em orientação sexual. Interessa-me compreender em que medida os dispositivos legais contemplam ou não as mulheres lésbicas. Meu argumento é que mesmo as diretrizes e recomendações que tentam “incluir” a diversidade sexual como um eixo de análise e que fazem o esforço de investigar a LGBTIfobia como possíveis constituintes de fundado temor de perseguição pecam ao não considerar experiências distintas que mulheres lésbicas podem ter. Nesse sentido analiso os discursos presentes em processos judiciais de solicitação de refúgio de mulheres lésbicas e tento apontar as incongruências que surgem ao considerar a categoria LGBTI 1 (que é a utilizada atualmente pela ONU e por outras organizações internacionais como a ILGA) como um grupo amorfo, monolítico. Destaco também que os enquadramentos sobre sexualidades sob lentes ocidentais coloca vidas de mulheres lésbicas em risco em dois sentidos: as experiências de ser dissidência sexual em outros Estados nem sempre correspondem ao imaginário ocidental do que seria considerado uma experiência LGBTI. Além disso, as manifestações de violências contra mulheres lésbicas tem particularidades pois há uma dupla discriminação: por ser mulher e por negar a heterossexualidade.
Refúgio como fenômeno político e histórico:

Retomemos a Convenção de 1951 também conhecida como Convenção de Berlim. O artigo 1 segunda cláusula diz que refugiado é:
“A. For the purposes of the present Convention, the term “refugee” shall apply to any person who: (2) As a result of events occurring before 1 January 1951 and owing to wellfounded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence as a result of such events, is unable or, owing to such fear, is unwilling to return to it.” (The Refugee Convention, 1951)
Vale dizer que a importância da Convenção de 1951 é que trata-se do primeiro documento que estabelece cláusulas de inclusão, cessação e exclusão de quem é refugiado, ou seja, estabelece limites temporais, geográficos e contextuais de quem é passível de ser protegido sob a lei do refúgio.
A Convenção tem particular importância pois os documentos criados anteriormente para sanar o “problema” do refúgio era passageiro e não havia um grau de comprometimento tão grande quanto à época da Convenção com o objetivo de pensar soluções conjuntas para uma questão ainda naquele momento, considerada regional. Dezesseis anos depois surge o Protocolo de 1967, refletindo as mudanças políticas do período que incluem as lutas pela descolonização de Estados na África e na Ásia e a maior proeminência desses Estados no tabuleiro geopolítico. O Protocolo reconhece a condição de refugiado como uma categoria que pode atingir cidadãos não-europeus e também engloba conflitos posteriores a 1951. O refúgio não é um conceito auto-evidente, está historicamente localizado e não pode ser compreendido fora da lógica estatal que institui a diferenciação entre inside e outside no
mundo político. Essa noção binária que faz parte da construção do Estado Nação, bem como das noções de cidadania produzem as figuras de quem não está incluído em uma condição nem outra (Haddad, 2008). É o caso do refugiado, que está fora do escopo de proteção do Estado de origem e o esforço da comunidade internacional em termos de mecanismos de proteção vão na linha de reincluí-lo nessa lógica.
Reconhecimento de direitos da diversidade sexual
Proponho aqui uma discussão sobre o estado dos direitos de diversidade sexual ao redor do globo. É bem relevante a abordagem da ILGA sobre as dimensões da homofobia em termos de criminalização da homossexualidade, restrição legal de temas relacionados, proteção contra discriminação e reconhecimento (relacionado a positivação de direitos como casamento igualitário e adoção). Até o fim de 2019, segundo dados do Report da ILGA, 68 Estados criminalizavam consensual same-sex sexual acts. (ILGA 2020). Segundo o State Sponsored Homophobia Report, desses 68 Estados, 18 (mais as Ilhas Cook) são específicas para homens, nos termos da lei. Não significa dizer que mulheres não sofram discriminação ou que a lesbianidade lá seja permitida, representando na verdade um empecilho até para comprovar a discriminação.

Eu destacaria duas questões que devemos nos atentar: 1) muitos países “defendem” os direitos LGBT como uma liberdade de existência, de não perseguição, mas que não significaria acessar a direitos que, reconhecendo os estigmas e as discriminações LGBTIfóbicas, garantiriam direitos frente ao Estado como herança, casamento civil, leis de não discriminação e de criminalização da violência. Uma perspectiva estritamente liberal considera desnecessária a consolidação de direitos positivos, propositivos para a população cisheterodissidente pois considera que o direito primário a ser preservado é de não interferência no espaço privado. (Borrillo, 2010) Essa noção de não interferência ao espaço privado, para nós mulheres, é extremamente problemático, pois o espaço privado funciona historicamente nas sociedades capitalistas e coloniais como um espaço de reprodução social e a família é uma instituição que serve para reprodução social e para a manutenção do status quo. Em um sentido mais macro, a família funcionaria como guardiã dos valores nacionais. Nesse sentido, sexualidade e nacionalidade estão estritamente ligados e são em muitos Estados marcadores importantes para a concessão de nacionalidade (jus sanguinis). Uma visão diga-se de passagem patriarcal. Muitos extermínios de povos acontecem com estupro sistematizado de mulheres de determinada cultura, como forma de “aniquilar” a linhagem. Nesse sentido, verificamos como a economia política do sexo (Rubin, 2017) é atravessada pela figura da mulher como mantenedora da cultura nacional e portanto, uma extensão do território nacional e portanto, da soberania do Estado. Outra questão que merece destaque no mapa da ILGA é a herança colonial refletida em Estados que criminalizam a homossexualidade. A colonialidade é refletida também quando para comprovar seu fundado temor de perseguição, a defesa do solicitante precisa respaldar que o Estado de origem não é suficientemente progressista como o Norte Global, ou seja, o próprio processo de reconhecimento da categoria de refugiado muitas vezes implica reforçar uma noção estereotipada de civilização e barbárie. (Dustin, 2018)
Refugee based on sexual orientation and gender identity (SOGI)
Em se tratando de refúgio por orientação sexual e identidade de gênero, além de cumprir os requisitos de elegibilidade sobre quem é refugiado ou não, os solicitantes ainda precisam ter uma performance coerente com os padrões de inteligibilidade (Butler, 2004) ocidentais sobre o que é ser uma dissidência sexual.

As decisões tomadas no âmbito da jurisprudência, no entanto, careciam de diretrizes mais formais sobre os critérios de elegibilidade algo que surgiu na década seguinte. Nos anos 2000, o Alto Comissariado das Nações Unidas cria uma diretriz com recomendações específicas para dissidências sexuais (UNHCR, 2011).
O debate sobre refúgio e diversidade sexual cresce à medida que a pauta dos direitos humanos para dissidências sexuais ganha maior visibilidade no cenário internacional e no direito internacional dos direitos humanos. Alguns Estados começam a compreender a orientação sexual e a identidade de gênero como elementos constitutivos e imutáveis de uma pessoa.
Todavia, o reconhecimento do refúgio em razão de orientação sexual por vezes exige uma coerência com as visões ocidentais pré-concebidas sobre o que é ser LGBTI por exemplo no Ocidente e do que é ser LGBTI no Oriente Médio. Varia de acordo com aspectos sociais, culturais, linguísticos, jurídicos. E o refúgio LGBTI traz esse desafio. O solicitante está submetido a precisar adequar-se à categoria de refugiado nos termos da Convenção mas também precisa ser enquadrado como LGBTI muitas vezes a partir do que as autoridades (juiz, agentes migratórios ou a polícia) considerem LGBTI. (WESSELS, 2011)
As consequências da imagem que certos Estados ocidentais constrõem no tocante aos direitos da diversidade mostram uma perspectiva hierárquica e evolucionista que fica implícita na economia política do refúgio: se por um lado a não criminalização das relações homossexuais em alguns Estados representaria uma vitória para as comunidades LGBT, por outro reforça estereótipos coloniais de civilização e barbárie. (Puar, J, 2010)
O reconhecimento de refúgio com base em orientação sexual e identidade de gênero geralmente é feito a partir do entendimento de que essas categorias compõem um grupo social específico. Apesar de nos anos 2000 terem sido desenvolvidos alguns instrumentos diretivos sobre refúgio e sexualidade, a maior parte tratava de orientação sexual e identidade de gênero de uma forma mais ampla. As diretrizes do UNHCR, por exemplo, oferecem definições sobre cada uma das letras que compõem a sigla LGBTI. Na análise dos méritos, recomendam que leve-se em conta os riscos de perseguição e que a perseguição anterior não seja um requisito obrigatório. Ressalta também os efeitos psicológicos que a discriminação e o próprio estigma que a homossexualidade pode ter no Estado de origem podem afetar a vida dos solicitantes de refúgio.
According the Guideline on International Protection number 02 (“Membership of a particular social group”) within the context of Article 1A(2) of the 1951 Convention and/or its 1967 Protocol relating to the Status of Refugees, o reconhecimento de um grupo social específico precisa ser feito compreendendo as mudanças sociais e políticas dos grupos e também o entendimento da comunidade internacional sobre tal grupo. A jurista Lyliana Jubilut (2007) considera que um grupo social específico pode ser constituído a partir de três critérios: auto-identificação, percepção social e existência de um agente de perseguição.
Conforme aponta o UNHCR, há duas abordagens preconizadas no no common law: uma que valoriza o critério de imutabilidade (se pensamos a orientação sexual ou a identidade de gênero como fator constitutivo da identidade de uma pessoa e que não pode ser escondida, mudada, trocada) e uma segunda abordagem que privilegia a percepção que a sociedade para identificar uma pessoal como pertencente a esse grupo. (UNHCR, 2019, pp. 94-95). Isso significa que o reconhecimento de refúgio por orientação sexual e identidade de gênero aplica-se não apenas para LGBTI’s mas para pessoas que sofrem perseguição por serem percebidas como tal.
O fundado temor de perseguição, segundo o UNHCR (2011) dois fatores, objetivo (fundado) e subjetivo (temor). Na prática, os critérios dependem muito da perspectiva que o tomador de decisão tem a respeito do que representa essa violência e dos riscos que uma pessoa pode correr. Uma questão marcante é o critério de discrição (discretion reasoning), temática trabalhada por Janna Wessels (2011).
Dentro da Convenção de 1951 há de se destacar o trecho “ is unable or, owing to such fear, is unwilling to return to it” presente no primeiro parágrafo. Isso significa dizer que segundo a Convenção, há uma preocupação com o possível retorno do solicitante de refúgio e dos riscos que ele correria ao retornar. Essa preocupação é esquecida algumas vezes na análise do mérito dos casos, como citarei adiante.
Lesbofobia como fundado temor de perseguição
A suposta neutralidade com que mesmo o refúgio LGBTI é analisado representa um obstáculo para compreender os riscos de perseguição baseados em orientação sexual que uma mulher lésbica pode correr.e exigência de uma consonância com padrões ocidentalizados sobre ser dissidente sexual.
A lesbofobia se verifica de diferentes maneiras: discriminação na família, no território, lesbofobia institucional e estatal (com o não reconhecimento de direitos civis e também não proteção contra violências específicas perpetradas contra esse grupo).
Compreendendo a heterossexualidade como uma instituição e regime políticos (Wittig, 2010 Rich, 2010, Curiel, 2013) há uma pressão para a correspondência de expectativas de sexo, gênero, expressão sexual, orientação e práticas sexuais. Em muitas sociedades, optar por não casar-se com um homem é uma grave transgressão de normas. Esse é um ponto crucial na análise da fragilidade do argumento de “critério de discrição” alegado por muitos tomadores de decisão. O caso HJ and HT Iran and Cameroon versus UK (2010) - em que os solicitantes de refúgio eram homens gays - representou uma ruptura na interpretação comum de que uma pessoa não heterossexual pode viver discretamente para evitar perseguição em um Estado onde há criminalização da homossexualidade (jurídico formal ou por costumes).
As manifestações de violência lesbofóbica muitas vezes não são consideradas como fundado temor de perseguição pois ocorrem no ambiente privado. Mais uma vez a dicotomia de espaço público e privado vai invisibilizar as violências a que mulheres em geral, e lésbicas principalmente estão suscetíveis no âmbito privado. O âmbito privado funciona como um produtor de indivíduos que devem cumprir os papéis sociais esperados. Nesse sentido, a família enquanto instituição opera cotidianamente impondo as normas de gênero e cobrando a performatividade desses indivíduos. No caso das mulheres, a família opera para que não transgridam as normas de feminilidade e consequentemente de heterossexualidade. Uma política mais justa de migrações e refúgio precisa levar em conta os atravessamentos de gênero e as manifestações de violência que ocorrem em casa.
Se geralmente a família a escola nos levam a não desenvolver nossa sexualidade de forma livre, mas sim de maneira castradora e com culpa, principalmente para as mulheres, é desafiador e por vezes um risco de estigma social, perseguição e até morte negar-se a casar e ter filhos com um homem. Nesse sentido, falar de casamento forçado não é apenas um casamento arranjado em que a família do noivo paga um dote ou os terríveis casamentos infantis, mas também os casamentos que são impostos socialmente de uma forma que não é extremamente agressiva mas que não significa que não seja violenta. A homofobia familiar (SCHULMAN, 2009) reside também em ignorar a orientação sexual do ente familiar que é homossexual. A transgressão das normas de gênero pode representar um estigma dentro da família e na comunidade e muitas vezes uma pessoa não heterossexual tem que lidar com o tratamento diferenciado por parte da família que não reconhece sua sexualidade e as relações que constrói. Nesse sentido, as exclusões familiares podem ser mais ou menos graves (SEDGWICK, 2016).
A violência familiar e vinda de conhecidos e pessoas da comunidade pode se expressar através de xingamentos, agressões físicas, psicológicas, estupro corretivo e terapias de conversão sexual, violências que são respaldadas culturalmente pela heteronormatividade e que pode ter como consequências o auto extermínio e o lesbocídio, ou seja, a morte de mulheres lésbicas em razão de sua orientação sexual (Peres, Soares, Dias, 2018). Explicar a violência sofrida em casa, por entes familiares e também a incapacidade de instâncias do governo de agir frente a essas agressões, ou mesmo a conivência das autoridades com essas violências é uma questão que influencia diretamente na aquisição de fundado temor de perseguição para a concessão de refúgio.
Millbank (2002) mostra que em comum aos homens gays, está a reação violenta quanto à demonstrações de homossexualidade em público (ocupação dos espaços públicos, com ou sem afeto). Esse ocupar espaço público é visto como uma transgressão. Todavia, são os homens gays que mais são violentados no espaço público, porque ocupam mais o espaço público, pois não deixam de ser homens e é socialmente aceito que estejam ocupando os espaços públicos. Quando se negam aos padrões de heteronormatividade, são agredidos mas já estão no espaço público. As lésbicas terão mais empecilhos para ocupar os espaços públicos e antes mesmo de ocuparem podem já ter recebido muitas represálias sociais dentro do âmbito familiar 1) por serem mulheres e viverem em uma sociedade que vai tentar impor um padrão de comportamento do que é ser uma mulher ideal, desde padrão de beleza até como comportar-se 2) porque esse padrão inclui a heterossexualidade como norma e no menor sinal de desvio, as mulheres sofrem reprimendas também.
O que chamo de lesbofobia estatal é a presunção de heterossexualidade para as mulheres e a forma como o Estado ignora a possibilidade de existência de mulheres que se relacionam com outras mulheres. Isso reflete a falta de resoluções específicas nos serviços de saúde, por exemplo, bem como nos discursos que associam a mulher aos cuidados e reprodução social nos termos heterossexuais. A lesbofobia estatal pode ser observada também através da misoginia que impera no reconhecimento de direitos LGBTI que refletem a invisibilidade das mulheres lésbicas no grupo “LGBTI”.
Por vezes as violências não são perpetradas pelo Estado diretamente, mas por grupos paramilitares, pessoas próximas da vítima quando falamos de violência contra mulheres, de forma parecida com os algozes de violências contra a mulher em geral (família, vizinhos, conhecidos, colegas de trabalho e chefes). Destaco a permissibilidade social que existe nos atos de violência contra mulheres lésbicas, quer pela política do esquecimento (NAVARRO SWAIN, 2004) das mulheres como atores sociais autônomos, como sujeitas e pela baixa probabilidade de responsabilização de quem perpetra tal violência. Se o Estado não dá respostas para as violências que essas mulheres passam ou é conivente com essas violências, pode-se configurar um fundado temor de perseguição.
Como consequência, algumas mulheres vão conseguir dar vazão à sua sexualidade apenas quando mais velhas e depois de terem se casado com homens para cumprir com as expectativas sociais e pressões familiares. Uma vez expressando sua lesbianidade e tendo temor de seguir no seu território de origem, comprovar a sua sexualidade torna-se um desafio quando as instâncias migratórias não levam em conta os contextos culturais.
Levando em conta as vivências específicas que a lesbianidade pode trazer, pontuo no tópico seguinte algumas considerações sobre sete processos jurídicos no Reino Unido, que ocorreram entre 2005 e 2016. Pontuo as principais questões conflituosas na análise de mérito dos casos. Tratam-se de casos de solicitantes de diferentes Estados de origem. Todas as aplicações foram feitas na Inglaterra. Os casos selecionados estão disponíveis na plataforma RefWorld, sendo, portanto, de livre acesso ao público. Os sete processos datam de 2005 a 2015. Interesso-me pela construção dos nexos causais a partir das provas exigidas e ofertadas para cada caso, que geralmente incluem a narrativa da solicitante de refúgio, parecer de especialistas sobre o Estado de origem, artigos de imprensa, bem como relatórios de organismos internacionais e ONG’s locais.
Na análise desses processos, fica evidente como o corpo ocupa um lugar central na análise do mérito de um caso de refúgio por orientação sexual. Em alguns casos são solicitados pareceres médicos físico e psicológicos, narrativas tanto da solicitante de refúgio quanto de ex-parceiras em que detalham seus cotidianos, sua história, mostrem fotografias, falem de suas práticas sexuais. Por exemplo, no processo da Amare (2005) a narrativa construída por ela não corresponde ao padrão de inteligibilidade exigido pelo juiz de que: ela como lésbica em seu país não precisaria temer, porque conseguiu ter relações afetivas escondidas lá. Em outros casos, não ter tido uma relação lésbica previamente no território de origem funciona como uma prova contrária à lesbianidade, bem como o não pertencimento a grupos de ativismo e/ou de sociabilidade lésbica. Não ter passado por violência no território de origem também é tido como um fator desfavorável para o deferimento do processo. Isso mostra como são exigidas narrativas e experiências de sofrimento para que o direito à mobilidade seja autorizado. Marcando certa incoerência, em um caso de SB (Uganda) v. Secretary of State for the Home Department, 2010 os relatos de prisão arbitrária sofrida pela solicitante de refúgio por ter sido percebida como lésbica foram consideradas, em primeira instância como incidentes.
Em um outro caso, é interessante notar a quebra de expectativa do Estado com respeito a figura do refugiado. No processo do caso SW (lesbians - HJ and HT applied) Jamaica v. Secretary of State for the Home Department, 2011, a narrativa da revisão processual alega que: “The appellant is educated, sophisticated and articulate.” como características que merecem ser destacadas, assim como sua nacionalidade e orientação sexual. Quanto ao critério de discrição, o Estado por vezes assume que o futuro da solicitante não será prejudicado caso ela haja discretamente, baseando-se nas experiências escondidas ou não experienciadas no passado pela solicitante.
A construção de redes sociais no Estado de origem e no Estado de destino também é uma discussão recorrente. Frequentemente serve de prova para orientação sexual se a solicitante teve relação no Estado de origem e se foi perseguida por isso. Ao mesmo tempo, espera-se que em um estado “mais livre” a solicitante tenha relações afetivas publicizadas, nos termos do que é considerado ser lésbica no Ocidente.
Durante essa análise verifiquei que o tempo age como um fator importante na construção de argumentos que constituem os nexos causais da solicitação: no caso por exemplo, no início da solicitação não havia um projeto de lei que criminalizasse a homossexualidade na Etiópia. No momento da revisão do processo há um projeto de criminalização em curso. Esse projeto passa a operar como um elemento objetivos nos termos da lei que poderia ser considerado como um elemento objetivo de perseguição. Vê-se nesse exemplo, como a existência de uma lei serve como uma prova de perseguição maior do que a alegação de não aceitação social.
O tempo nos processos de solicitação de refúgio tem um papel importante: quem advoga em defesa da solicitante por vezes aponta o temor da solicitante de retornar ao Estado de origem e ser perseguida, apoiada na Convenção de 1951. Nesse ponto, o tempo futuro possui um papel central e os argumentos contrários à concessão de refúgio buscam alegar ausência de perseguição no tempo passado.
Conclusions
A análise desses processos mostrou-se uma oportunidade exemplar de verificar como a invisibilidade lésbica manifesta-se no discurso genérico de homossexualidade que apaga a dupla opressão de gênero e orientação sexual, atrelado à raça e nacionalidade bem como a maneira como o Direito é construído e a relação com o Estado com o tema cidadania e com quem não é sujeito de direitos. Dentro desse grupo supostamente homogêneo, há as lésbicas, cujas experiências no processo jurídico serão diferenciadas tanto pela forma como Estado e o Direito são construídos, de forma não-neutra e vinculados à preservação de nacionalidades, à defesa de um padrão de cidadania masculinista, patriarcal e heterossexual.
Desse modo, os processos analisados me mostraram possibilidade de resistências e brechas nos mecanismos que não foram feitos por e para não heterossexuais, pobres, negros, habitantes do Sul Global, mas que reapropriados podem representar possibilidades de fratura nesse sistema.
Lutar por uma política de refúgio mais justa não significa dizer que o direito é uma concessão bondosa do Estado, mas sim que é fruto de lutas e disputas dos movimentos sociais. Tampouco acredito que o reconhecimento da diversidade sexual e das especificidades das identidades seja um fim em si mesmo. Sabemos que as ferramentas do Direito tem sido historicamente utilizadas para manutenção do status quo, mas enquanto pudermos acessá-las estrategicamente, seu uso pode garantir que mulheres lésbicas que saíram de seus países de origem fugindo da lesbofobia possam ter garantido o direito humano de mobilidade. Uma política de refúgio mais justa e que leve em conta a discriminação contra dissidências sexuais precisa atentar-se para as especificidades das experiências. Pontuo duas dimensões que merecem atenção: noções menos colonizadoras sobre o que é ser dissidência sexual, compreendendo os contextos político, sócio e culturais e compreender que muitas das violências que atravessam as mulheres lésbicas são cometidas em espaço privado. Nesse sentido, internacionalizar essas demandas é essencial para compreender que a misoginia e a lesbofobia faz com que essas violências sejam descredibilizadas em muitas instâncias locais.
É preciso implodir as visões estereotipadas e fetichizadas sobre mulheres lésbicas de modo a compreender a singularidade que suas experiências podem ter e que operam de formas distintas em territórios outros. O critério de discrição não deveria mais ser utilizado, pois deve-se levar em conta que uma vida “discreta” para mulheres pode representar casamento forçado para atender às pressões sociais. Essa transformação será possível à medida que as vozes dessas sujeitas forem levadas em consideração. Os movimentos sociais de mulheres lésbicas e de refugiadas tem atuado ativamente na produção de visibilidade através da arte e de campanhas internacionais. (Lewis, 2013). Por enquanto o que assistimos imperar é uma necessidade de coerência entre as narrativas dessas mulheres com as noções estereotipadas sobre homossexualidade feminina.
Translation - English Abstract
This article addresses the challenges for eligibility of lesbian women as asylum seekers based on sexual orientation. I investigate how the modern Western assumptions of creation of the nation-state, the notions of citizenship, legality and illegality are obstacles to the legal recognition of women who love women and have been persecuted in their states of origin, having no other option but to escape.
My interest lies in investigating how the regulation of borders and sexuality can be associated with lesbian refugees, since certain states have issues recognizing well-founded fear of persecution based on sexual orientation and / or gender identity as a category eligible to applying for asylum.
I am interested in assessing how the constructions of causal nexus in the field of law relate more to decision makers’ viewpoints than the multiple possibilities and experiences of lesbian women derived from states of the Global South.
Amongst the challenges of causal nexus are the difficulty of proving a well-founded fear of persecution when they are caused by factors unrelated to the state and that often take place in the private sphere.
Then, I propose an analysis based on the premise that what is personal is international (Enloe, Cynthia Enloe, 2018) which questions a supposed coherence between being a refugee and what it is to be a lesbian, transgressing the sexual truth (Foucault, 1980) and asylum (Spijkerboer, 2011)
As a methodology, I rely on documents and discourse analysis of legal asylum applications that took place between 2005 and 2016 in England, in addition to bibliographic analysis of several authors that specialize on asylum touching the issues of lesbian invisibility. (Wessels, 2011; 2013). I analyze how the assumptions involved in the recognition of a lesbian woman are related to a heteronormative and western view on sexual dissent, leading these women to having to prove their sexuality, either through narratives or their own bodies (performance, image, pathological diagnosis, etc.) while heterosexuality never needs to be verified (Blank, Hanne, 2013). In this regard, I point out clues as to how asylum policies can be less colonizing (Dustin, Moira, 2018) and more sensitive to embracing different realities and corporealities on what it is to be a lesbian around the world.
Introduction
The traditional debate on asylum seeking does not take into account gender issues. Our social imaginary on the figure of a refugee is that of a man. The main international documents that discuss refugee rights do not explicitly mention gender implications.
Asylum seeking based on sexual orientation and gender identity starts in the 1990's, according to Janna Wessels (2011). In the 2000’s, the United Nations’ High Commissioner creates a guideline with specific topics on sexual dissidences (UNHCR, 2011). The debate over asylum seeking and sexual diversity grows as discussions on human rights for sexual dissidences increase in visibility internationally and in international human rights. Some states start acknowledging sexual orientation and gender identity as immutable and constitutive elements of human beings.
This article aims at exposing specific issues lesbian women face when applying for asylum based on their sexual orientation. It interests me illustrating to what extent legal proceedings do or do not contemplate lesbian women. My argument on this matter is, even guidelines and recommendations that attempt to “include” sexual diversity as an analytic standpoint and which make an effort into investigating LGBTphobia as a possible justified well-founded fear of persecution, fail to consider distinct experiences lesbian women might live through. In this sense, I analyze the discourse in legal proceedings regarding lesbian women requests for asylum and try to point out inconsistencies that arise when dealing with the LGBTI category [1] (which is currently used by the UN and other international organizations such as ILGA) as an amorphous, monolithic group. I also point out that framing sexualities through a Western gaze place lesbian women's lives at risk in two different ways: the experiences of being of a sexual dissent in other nations not necessarily corresponding to the Western perspective of what would be considered an LGBTI experience. Moreover, the way violence against lesbian women distincts itself considering they face a double discrimination: for being a woman and ultimatly denying heterosexuality.
Asylum seeking as a political and historical phenomenon:
The traditional debate on asylum seeking does not take into account gender issues. Our social imaginary on the figure of a refugee is that of a man. The main international documents dealing with refugee rights do not explicitly mention gender issues. In retrospect, let's look into the 1951 Convention, also known as the Berlin Convention. In the second clause of Article I (1), a refugee is defined as:
“A. For the purposes of the present Convention, the term “refugee” shall apply to any person who: (2) As a result of events occurring before 1 January 1951 and owing to well founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence as a result of such events, is unable or, owing to such fear, is unwilling to return to it.” (The Refugee Convention, 1951)
It is worth mentioning the importance of the 1951 Convention as the first document that establishes clauses on inclusion, cessation and exclusion of those deemed refugees, which means it establishes temporal, geographical and contextual limits on who is deemed eligible to be granted a refugee status.
The Convention is particularly important because previous documents created to solve the "refugee problem" were of temporary nature and there was no such commitment compared the Convention as to think of a joint solution to an issue still at that time considered regional.
Sixteen years later, the 1967 Protocol was created, reflecting the political changes of the period, which included the struggles for the decolonization of nations in Africa and Asia, working towards a greater prominence of these countries in the geopolitical scenario. The Protocol recognizes the refugee status as a category eligible to non-European citizens and that also includes conflicts after 1951. The asylum itself is not a self-evident concept, as historically it is located in—and cannot be comprehended outside—a state logic, which establishes clear lines between inside and outside the political world. This binary notion that is part of the foundations of the nation-state, as well as the concepts of citizenship, produce an imagery of those who are not included neither in one condition nor the other (Haddad, 2008). This is the case of a refugee, who is placed outside the scope of protection of their state of origin and the effort of the international community in terms of protective mechanisms work towards reincluding them in this scheme.
Recognition sexual diversity rights
At this point I propose a discussion on sexual diversity rights around the globe. It is quite relevant ILGA's approach on the multiple dimentions of homophobia in terms of the criminalization of homosexuality, legal restrictions of related topics, protection against discrimination and overall recognition (related to approval of rights to equal marriage and adoption). By the end of 2019, according to data from the ILGA Report, 68 nations criminalized consensual same-sex sexual acts. (ILGA 2020). According to the State Sponsored Homophobia Report, out of those 68 states, 18 (including the Cook Islands) specifically target men under the law. It does not mean women are not discriminated against or that lesbianism is allowed in these territories, it actually represents an obstacle in itself to prove discrimination against these women.

There are two issues I wish to highlight: 1) several countries “defend” LGBT rights as simply as a freedom of existence, a life free from persecution, but that does not mean accessing rights that, upon the recognition of LGBTIphobic stigmas and discrimination, would guarantee basic civil rights as inheritance, civil marriage, non-discrimination laws and criminalization of violence. From a strictly liberal perspective, it is considered unnecessary the consolidation of positive, purposeful rights for the Cisheterodissident population because it considers that the primary right to be preserved is of non-interference in people's private space. (Borrillo, 2010)
This notion of non-interference with the private space, for us women, is extremely problematic, since it serves historically in capitalist and colonial societies as a place for social reproduction and having the family as an institution that reproduces a social norm for the maintenance of the status quo. In a wider perspective, the family would serve as a guardian of national values. In this sense, sexuality and nationality are closely linked and are in many nations important factors for granting nationality (jus sanguinis). A patriarchal perspective, at the very least. Many exterminations of a people include systematic rape of women of a certain culture, as a means to “annihilate” their lineage. In this sense, we see how the political economy of sex (Rubin, 2017) is affected by women as being the guardians of a national culture; therefore, an extension of national territory and, consequently, of the nation's sovereignty.
Another issue that deserves to be highlighted on the ILGA map is the colonial heritage reflected in territories that criminalize homosexuality. Coloniality is also reflected when, in order to prove their well-founded fear of persecution, the applicant’s defense is required to sustain that their place of origin is not sufficiently progressive as the Global North, that is, the very process of recognizing the refugee category often means reinforcing a stereotyped notion of a civilization and a barbaric society. (Dustin, 2018)
Asylum seeking based on sexual orientation and gender identity (SOGI)
When it comes to applying for asylum based on sexual orientation and gender identity reasons, in addition to meeting the standard eligibility requirements to be granted the refugee status, applicants still need to perform consistently with Western intelligibility standards (Butler, 2004) about what it is to be of a sexual dissent.
Asylum claims based on sexual orientation and gender identity began to in the 1990s, according to Janna Wessels (2011). Decisions made within the framework of jurisprudence, however, lacked more formal guidelines on eligibility criteria, which would emerge in the following decade. In the 2000s, the United Nations High Commissioner created a guideline with specific recommendations for individuals of sexual dissent (UNHCR, 2011).
The debate on asylum seeking and sexual diversity grows as the human rights agenda on sexual dissidence attain greater visibility internationally and in international human rights law. Gradually, nations start comprising sexual orientation and gender identity as constitutive and immutable elements of an individual.
However, the approval of an application for asylum based on sexual orientation at times demands a certain coherence with preconceived Western views on, for example, what it is to be LGBTI in the West and what it is to be LGBTI in the Middle East. It varies according to social, cultural, linguistic and legal aspects. And the “LGBTI asylum” poses that challenge. Not only the applicant is subjected to the need of adapting to the classification of a refugee under Convention terms, but also needs to fit a category of LGBTI often according to what authorities (judge, migrant agents or the police) consider to be LGBTI. (WESSELS, 2011)
The consequences of the imagery created by certain western states on rights for diversity reveal a hierarchical and evolutionistic perspective that is implicit inside the political economy of asylum seeking: if on the one hand the non-criminalization of homosexual relations in some nations represent a victory for the LGBT community, on the other hand, it reinforces colonial stereotypes of civilization and barbarism. (Puar, J, 2010)
The recognition of refugee status eligibility based on sexual orientation and gender identity is usually done from an understanding that these categories make up for a specific social group. Even though some guidelines on this matter were developed in the 2000s, most of them dealt with sexual orientation and gender identity in a broader sense. The UNHCR guidelines, for example, offer definitions of each of the letters that make up the acronym LGBTI. When analyzing the merits, they recommend taking into account the risks of persecution and that previous persecution does not impose itself as a mandatory requirement. It also highlights the psychological effects that discrimination and the stigma itself homosexuality can carry in the nation of origin and how it can affect the lives of asylum seekers.
According to the Guideline on International Protection number 02 (“Membership of a particular social group”) within the context of Article 1A (2) of the 1951 Convention and / or its 1967 Protocol relating to the Status of Refugees, the recognition of a specific social group has to be done embracing their likely social and political changes and also taking into account the understanding of the international community on said group. Jurist Lyliana Jubilut (2007) considers that a specific social group can be constituted based on three criteria: self-identification, social perception and the existence of an agent of persecution.
As indicated by the UNHCR, there are two preconized approaches in the common law: one that emphasizes the immutability criterion (whether we consider sexual orientation or gender identity as constitutive factors of a person's identity and that cannot be disguised, altered or exchanged) and a second approach that favours a social perception when identifying a person as belonging to the aforementioned group. (UNHCR, 2019, pp. 94-95). This means that the eligibility for asylum seeking based on sexual orientation and gender identity applies not only to LGBTI’s, but also to people who are persecuted for being perceived as such.
The well-founded fear of persecution, according to UNHCR (2011), two factors, objective (well-founded) and subjective (fear). In practical terms, the criteria depend heavily on the decision maker’s perspective on what this violence represents and the consequent risks that a person might come across. A striking issue is the discretion reasoning, a topic reasoned by Janna Wessels (2011).
Within the 1951 Convention, it is worth highlighting the following excerpt, extracted from the first paragraph: “is unable or, owing to such fear, is unwilling to return to it”. This means that, according to the Convention, there is a real concern over a possible reinstatement of the asylum seeker regarding the risks posed on them upon return. This predicament is sometimes overlooked in cases’ analysis of the merits, as I will discuss ahead.
Lesbophobia as well-founded fear of persecution
The alleged neutrality stance with which the LGBTI refugee applications are analyzed represents an obstacle to grasping the extent of the risks of persecution based on sexual orientation that a lesbian woman might go through, as well as the requirement to be in consonance with Western standards over being of a sexual dissident.
Lesbophobia manifests itself in different manners: discrimination inside the family, inside the territory, institutional and national lesbophobia (non-recognition of their civil rights and failing to impede specific violences perpetrated against this group).
Comprehending heterosexuality as a political institution and regime (Wittig, 2010 Rich, 2010, Curiel, 2013) there is a considerable pressure to correspond expectations regarding sex, gender, sexual expression, sexual orientation and sexual practices. In many societies, opting out of marrying a man is a solemn transgression. This is a crucial point in the analysis of the weakness of the “discretion criterion” argument used by many decision makers. The case HJ and HT Iran and Cameroon versus UK (2010)—in which the asylum seekers were gay men—represented a rupture in the common interpretation that a non-heterosexual person can live discreetly to avoid persecution in a country where homosexuality is criminalized (by formal laws or customs).
The manifestations of lesbophobic violence are often not considered as well-founded fear of persecution since they occur in the private sphere. Once again the dichotomy between public and private spheres invisibilizes the violences which women in general, and lesbians in particular, are susceptible to in the private field. The private sphere acts as a manufacturer of individuals who must fulfill the expected social roles. In this regard, the family as an institution in itself operates daily by imposing gender norms and demanding a certain performance from these individuals. As for women, the family works so they do not violate the norms of femininity and, consequently, heterosexuality. For fairer migration and refugee policies it is required taking into account gender particularities and violence manifested inside the home.
As the family and the school generally do not let us freely develop our sexuality, but so in a castrating and guilty manner, especially for women, it is challenging—and at times a risk factor for social stigma, persecution and even death—to refuse marrying and having children with a man. In this respect, talking about forced marriage is not only about arranged marriage—in which the groom's family offers a dowry—or the dreadful child marriages, but also marriages that are socially imposed in a way that are not extremely aggressive, yet, that does not mean they are not violent.
Familial homophobia (SCHULMAN, 2009) also resides in ignoring the sexual orientation of the family member who is homosexual. The transgression of gender norms can represent a stigma within the family and inside their community, and often times a non-heterosexual person has to deal with a distinguished treatment from the family, which does not recognize their sexuality or the relationships they build. In this respect, family exclusions can be more or less severe (SEDGWICK, 2016).
Violence perpetrated by the family, acquaintances or people from the community can be expressed through verbal, physical and psychological aggressions; corrective rape and sexual conversion therapies— forms of violence culturally supported by our heteronormative society—, which can result in self-extermination and lesbocide, in other words, the death of lesbian women due to their sexual orientation (Peres, Soares, Dias, 2018). Explaining the violence suffered inside the home—inflicted by family members—and also the failure of government instances to act against these aggressions—or even the conniving attitude of the authorities toward these violences—is a matter that influences directly in the addition of well-founded fear of persecution for the refugee status grant.
Millbank (2002) argues that, shared by gay men, are the violent reactions to demonstrations of homosexuality in public (occupation of public spaces, with or without display of affection). This occupation of public territories is seen as a transgression. However, it is gay men who are most victims of violence in the public sphere, because they occupy these spaces more, since they are first and foremost men, being socially accepted that they are occupy public spaces. When heteronormative standards are broken, they are attacked, but they already have access to the public space. Lesbians will have more obstacles when it comes to the occupation of public spaces and even before occupying they may have already suffer many social reprisals within the family 1) for being women and living in a society that will try to impose a behavioral standard based on an ideal woman, from beauty standards to how to behave 2) because this standard includes heterosexuality as a norm and at the slightest sign of deviation, women are reprimanded as well.
What I call state lesbophobia is the presumption of heterosexuality over women and the way the system ignores the possibility of women building relationships with other women. This reflects on the lack of specific resolutions in healthcare services, for example, as well as in discourses that associate women to carers and social reproductors of the heterosexual norm. State lesbophobia can also be percieved on the prevailance of misogyny throught the recognition of LGBTI rights that reinforce the invisibility of lesbian women in the “LGBTI” group.
Every so often violence is not perpetrated by the state directly, but by paramilitary groups, people close to the victim when considering violence against women, similarly to how perpetrators of violence against women operate in general (family, neighbors, acquaintances, co-workers and bosses). It is worth enphasizing the social permissiviness innate to acts of violence against lesbian women, whether due to the “forgetfulness policy” (politica de esquecimento) (NAVARRO SWAIN, 2004) of women as autonomous social players, as subjects and due to the unlikelihood of holding accountable those who perpetrate such violence. If the state does not respond to the violence that these women face or are complicit with these violences, it can be configured as a well-founded fear of persecution.
As a consequence, some women will only be able to live their sexuality to the utmost only when they are older, after having married men to fulfill social expectations and family demands. Once fully expressing themselves as lesbians and fearing to continue in their birthplace, proving their safic sexuality becomes a challenge once the migratory instances do not take cultural contexts into account.
Considering the specific experiences that lesbianism carry, I shall point out in the following topic some considerations over seven legal processes in the United Kingdom, which took place between 2005 and 2016. I shall highlight the main conflicting issues in the analysis of the cases’ merits.
These are cases of applicants from different nations of origin. All applications were processed in England. The following selected cases are available at the RefWorld platform, so, therefore, fully accessible to the general public. All seven legal proceedings date from 2005 to 2015. I am interested in building causal links based on the required and offered evidence in each case, which usually include the asylum seeker’s narrative, expert’s opinions on their place of origin, press articles, as well as reports from international organizations and local NGOs.
In the analysis of these processes, it is evident how the body is dealt with as a central aspect in the analysis of the merit of asylum seeking applications based on sexual orientation. In some cases, authorities requested medical evaluations (physical and psychological), statements from both the asylum seeker and their ex-partners, in which they had to detail their daily lives, their story, show photographs and talk about their sexual practices.
For example, in Amare's application (2005), the narrative constructed by her does not correspond to the standard of intelligibility required by the judge that: herself as a lesbian in her country would not need to be afraid, since she was successful at sustaining emotional relationships in a discreet manner.
In other cases, not having previously had a lesbian relationship in their territory of origin works as evidence against their lesbianity, as much as not belonging to any lesbian activism and / or social groups. Not having experienced violence in their place of origin is also seen as an unfavorable factor for the approval of their process. It goes to show how narratives and experiences on suffering are required so mobility rights are authorized.
Showing a certain inconsistency, in a case of SB (Uganda) v. Secretary of State for the Home Department, 2010 reports on arbitrary arrests suffered by the asylum seeker for having been perceived as a lesbian were deemed, in the first instance, as incidents.
In another case, it is interesting noting the break in expectation from the state regarding the refugee’s figure. In the SW case file (lesbians - HJ and HT applied) Jamaica v. Secretary of State for the Home Department, 2011, the narrative of the procedural review reads: “The appellant is educated, sophisticated and articulate.” as characteristics that deserve to be highlighted, as well as their nationality and sexual orientation.
As for the discretion criterion, the state at times assumes that the applicant's future will not be compromised if they act discreetly, based on their previous experiences of said nature or lack of experiences altogether in the past by the applicant.
The construction of social networks in both the state of origin and that of destination are also recurring topics of discussion. It often serves as proof of sexual orientation if the applicant has had a relationship in the state of origin and was persecuted for it. Moreover, it is expected that, once in a “freer” state, the applicant will have publicized affectionate relationships, according to what is considered to be a lesbian by Western standards.
During this analysis I verified that time acts as an important factor in the construction of arguments that constitute the causal nexus of the request: in the case Amare v. Secretary of State for the Home Department, 2005, for example, at the beginning of the request there was no active bill that criminalized homosexuality in Ethiopia. By the time the application was being reviewed, there is a bill to criminalize homosexuality underway. This bill starts being used as a concrete lawful element that could be considered an objective element of persecution. With this example, it is evident how the existence of a law serves as a greater proof of persecution than claims of social non-acceptance.
The part which time plays in the asylum application processes is that of great importance: those who advocate in defense of the asylum seeker, at times explicit the applicant's fear of returning to their place of origin and being persecuted, supported by the 1951 Convention. At this point, the future plays a central role and the arguments against granting the refugee status state the absence of persecution in the applicant’s past.
Conclusions
The analysis of these applications has proven itself to be an exemplary opportunity to verify how lesbian invisibility manifests itself inside a generic discourse on homosexuality, which erases the double oppression based on gender and sexual orientation, linked to race and nationality issues as well as how the Law is constructed and its relation with the state when it comes to citizenship and those who are not eligible to access their rights. Within this supposedly homogeneous group, there are lesbians, whose experiences in legal proceedings will be differentiated both by the way the state and the law are constructed, in a heavily biased manner and also linked to the preservation of nationalities, as well as the conformity to the standard patriarchal, masculine, heterosexual citizenship.
In this sense, the analyzed applications showed me the possibilities of resistance as well as loopholes inside mechanisms that were not designed by or for non-heterosexuals, impoverished people, black people and inhabitants of the Global South; but if properly reappropriated, they may represent possibilities to fracture this system.
Fighting for a fairer policy for asylum seekers does not mean that rights are benevolent concessions granted by the state, but actually the result of long lasting struggles and disputes advocated by social movements. Nor do I believe that the recognition of sexual diversity and the specificities of identities is the finishing line in itself. We are well aware of how the tools of law have historically served to maintain the status quo, but as long as we can access them strategically, its proper usage can guarantee that lesbian women who were forced out of their countries of origin on lesbophobic grounds may eventually be guaranteed to access their human right to mobility.
A fairer refugee policy that also takes into account discrimination against people of sexual dissents must deal with specificities in applicant’s experiences. Specially in two aspects: review and reverse colonizing notions on what it is to be of a sexual dissent, fully comprehending the political, social and cultural contexts involved, as well as understanding that many forms of violence experienced by lesbian women are committed in a private sphere. In this regard, the internationalisation of these demands is essential in order to comprehend that misogyny and lesbophobia systematically discredit these violences in many local instances.
It is vital to implode stereotyped and fetishized views on lesbian women in order to understand the uniqueness that their experiences may contain and that manifest in distinct ways according to the territory they occur in. The criterion of discretion should no longer be applied, as it must be taken into account that a “discreet” life for women may represent being forced into marriage in order to meet social demands. This transformation will only take place when these women’s voices are truly taken into account. Lesbian and refugee women’s social movements have been actively increasing visibility through art and international campaigns. (Lewis, 2013). For now, what we have seen prevail is a need for coherence between the narratives portrayed by these women and stereotyped notions of female homosexuality.
