As he returned to the lorry and lifted one leg up, a sudden thought flashed into his mind. He stood rigid in his place, trying to do or say something. He thought of shouting, but immediately realised what a stupid idea that was. He tried to finish climbing into the lorry, but didn’t feel strong enough. He thought that his head would explode. All the exhaustion which he felt suddenly rose in his hands and began to pull his hair to expel the thought. But it was still there, huge and resounding, unshakeable and inescapable. He turned to look back to where he had left the corpses, but he could see nothing, and that glance simply set the thought ablaze so that it began to burn in his mind. All at once he could no longer keep it within his head, and he dropped his hands to his sides and stared into the darkness with his eyes wide open.
The thought slipped from his mind and ran onto his tongue: “Why didn’t they knock on the sides of the tank?” He turned right round once, but he was afraid he would fall, so he climbed into his seat and leaned his head on the wheel.
“Why didn’t you knock on the sides of the tank? Why didn’t you say anything? Why?”
The desert suddenly began to send back the echo:
“Why didn’t you knock on the sides of the tank? Why didn’t you bang the sides of the tank? Why? Why? Why?”

حالما عاد الى الشاحنة و رفع احدى ساقيه, لمعت في راسة فجاة فكرة. وقف بلا حراك مكانه محاولا ان يفعل او يقول شيئا. فكر بالصراخ و لكنه ادرك فورا بانها فكرة غبية. حاول ان ينهي صعود الشاحنة و لكنه لم يكن قويا كفاية. اعتقد بان راسه سينفجر. انتشر كل الارهاق الذى شعر به فجاة الى يديه و بدا يشد شعره بشدة لكي يتخلص من ذلك الاعتقاد. لكنها مازالت هناك, كبيرة و مدوية و ثابتة و لا مفر منها. استدار و نظر الى المكان الذي ترك فيه الجثث و لكنه لم يرى شيا. أبقت تلك اللمحة ببساطة على الاعتقاد حيا و لذلك بدا ذلك الاعتقاد يشغل تفكيره. و فجأة لم يتحمل الابقاء به في راسه لمدة اطول, و القى بيداه الى جانبيه و حدق في الخفاء بعيناه الشاخصتان.
خرج الاعتقاد من راسه و انطلق لسانه ليقول: " لماذا لم يطرقوا على جوانب الدبابة؟" استدار فجاة الى اليمين و لكنه كان خائفا من السقوط, لذلك صعد الى مكانه و اتكى راسه على العجلة.
"لماذا لم تطرقوا على جوانب الدبابة؟ لماذا لم تقولوا شيا؟ لماذا؟"

Source text - English WASHINGTON – Astronomers say they have for the first time spotted a planet beyond our own in what is sometimes called the Goldilocks zone for life: Not too hot, not too cold. Juuuust right.
Not too far from its star, not too close. So it could contain liquid water. The planet itself is neither too big nor too small for the proper surface, gravity and atmosphere.
It's just right. Just like Earth.

منهجية المفاوضات
الجزء الأول
أولاً: التفرقة بين الناس والمُشكلة:-
علينا أن نعرف أن من يقوم بالمفاوضات هم بشر بأسماء وشخصيات، ومشاكل، وتاريخ وطموحات ومخاوف ومصالح وخصوم وأصدقاء، إنهم يمثلون الطرف الآخر الذي قد يكون مُمثلاً بعدة جهات من وزارات أو مؤسسات اقتصادية ودينية واجتماعية، أو حتى أحزاب مختلفة، هؤلاء الأشخاص يختلفون بشخصياتهم وتصرفاتهم ومفاهيمهم وآرائهم وخلفياتهم وتصرفاتهم.
لا بد أن نُدرك:
أ. أن العامل الإنساني في أية مفاوضات قد يكون عنصراً مُساعداً أو مُدمراً.
ب. إن بناء علاقات الثقة والعمل والاحترام والتفاهم والتعارف إلى العائلات وحتى الصداقة، قد تُسهم إسهاماً كبيراً في خلق أجواء مُناسبة للتوصل إلى اتفاقات.
وعلى صعيد آخر، فإن أي شخص قد يغضب ويثور ويكتئب ويشك ويخاف ويُشكك، وقد يكون عدائياً. وقد يشعر بالإهانة أو الانتقاص من الكرامة، وقد يرى بعضهم الحلول أو عدمها من خلال مصالحهم وتطلعاتهم. وبطبيعة الحال فإن ذلك سيقود حتماً إلى تعقيدات وسوء تفاهم وتصعيد، مما يعني دخول المفاوضات في دوامة قد يكون لها أول وليس لها آخر، مما قد يعني فشل المفاوضات، أو على أقل تقدير تعطيلها، أو تحويلها إلى مساجلات لتسجيل النقاط وتبادل الاتهامات على حساب مضمون المفاوضات ومصالح الأطراف.
إن عدم أخذ حساسية الأشخاص وتفهم شخصياتهم بوصفهم بشراً سيقود إلى ردود أفعال بنتائج كارثية على المفاوضات، ومهما كانت التحضيرات التي تقوم بها خلال المفاوضات، قد يكون من المُناسب أن تسأل نفسك على الدوام: هل أُعطي اهتماماً كافياً إلى مشاكل الأشخاص الذين يُشاركون في المفاوضات؟ وحتى نتفادى مثل هذه الانعكاسات على المفاوضات يجب:-
1. التنبه أن لكل مفاوض مصالح في مضمون المفاوضات وفي العلاقات الشخصية.
2. مراعاة طبيعة العلاقات الشخصية للمفاوضين.
3. الإيمان بأن التفاوض على المواقف سيضع العلاقات الشخصية ومضمون المفاوضات في دائرة الصراع.
4. الفصل بين العلاقات الشخصية والمضمون.
5. تفهم وجهات نظر الأطراف الأخرى، إذ أن وجهات نظرهم قد تُشكل جزءاً من الحل، وقد تُضيف إلى المُشكلة.
6. محاولة النظر إلى الأمور كما يراها الطرف الآخر.
7. عدم تصور أن مخاوفك هي ذات مخاوف الأطراف الأخرى.
8. عدم لوم الطرف الآخر أو الأطراف الأخرى على المشاكل التي تُعاني منها. فلوم الآخرين على مشاكلك هو أمر سهل ويدخل في إطار البحث عمّن سيتحمل أسباب المشاكل، مما يعني إضافة مشاكل جديدة إلى المشاكل القائمة.
9. تبادل وجهات النظر مع الأطراف الأخرى.
10. البحث عن فرص تثبت للأطراف الأخرى أنك تفهم وجهات نظرهم، أو على الأقل أنك تحاول الفهم.
11. محاولة إظهار أن الحل الذي تُحاول أن تتوصل اليه يضمن مصالحهم أو جزءاً منها، وأنك على استعداد لفعل ذلك.
12. محاولة تفهم وجهة نظر الأطراف الأخرى عند صياغة المقترحات.
13. إقرار وتفهم عواطفهم إن أردت أن يقوموا بتفهم عواطفك؛ لأن العواطف مشروعة، واسمح على الدوام بأن يتم التعبير عنها منك ومنهم.
14. محاولة عدم الرد على الهجمات العاطفية أو مُحاولات تسجيل النقاط.
15. أبراز الاحترام لرموز الأطراف الأخرى، وما يؤمنون به وما يحترمونه، وخاصة في مناسباتهم الدينية والوطنية.
16. المحافظة على الاتصالات والتواصل، فبدون ذلك لن يكون هناك مفاوضات.
17. التحدث دائماً بطريقة يستطيع كل من يسمعك أن يفهمك جيداً، على ألا تتحدث عن نفسك، أو عنهم، بل من الضروري أن يكون الحديث في سياق الهدف.
18. يأتي كل ذلك حتى تستطيع أن تبني مع الأطراف الأخرى علاقات عمل حقيقية وفعالة.
ثانياً: المصالح:-
التركيز على المصالح وليس على المواقف، ذلك أن عليك أن تُدرك أن أية مفاوضات ترتكز على اختلاف المواقف، ولما كان الهدف هو الاتفاق بشأن هذه المواقف، فإن أعضاء أطراف المفاوضات يركزون ويفكرون بالمواقف، مما يقود إلى تعطيل المفاوضات، وبالتالي يجب التركيز على:
- تزاوج المصالح وليس المواقف:
فيجب عند معرفة التناقض في المواقف دراسة أسباب اتخاذ هذه المواقف من كل طرف، وسنجد أن المواقف تتطور استناداً لما نراه لمصالح نريد الحفاظ عليها وعدم المساس بها. وبالتالي وبدلاً من التركيز على المواقف، يتم التركيز على المصالح، وعندها تكون الاحتمالات كبيرة لإيجاد حلول تستوعب مصالح الأطراف.
- الإدراك بأن المصالح هي الطريق لتعريف المشاكل:
المُشكلة الأساسية في المفاوضات تكمن في تضارب المواقف، ولكن عناصر الصراع غالباً ما تتضمن الحاجات، والرغبات، والمخاوف، وهنا يبدأ البحث عن الحلول الخلاقة من خلال المُحافظة على المصالح وتحقيق ما يعتقده كل طرف أنه مصلحة له.
- معرفة أن المواقف المتضاربة تحتوي على مصالح مُشتركة، ومصالح متضاربة:
فغالباً ما نتصور أنه ونتيجة لتضارب مواقفنا مع الآخرين فإن مصالحنا ستكون حتماً متضاربة. فإذا ما أردنا بناء مُجمع على سبيل المثال، فإننا نعتقد أن الطرف الآخر لا يريد البناء، وإذا ما أردنا تقليل ثمن سلعة، فإننا نعتقد أن الطرف الآخر يريد حتماً رفع الأسعار، ولكن إذا ما فحصنا بدقة مصلحتنا في البناء أو تقليل السعر، وفحصنا في مصلحة الطرف الآخر برفض البناء أو رفع السعر، سنجد أن الخلاف قد يكون على الموقع وليس على فكرة البناء، وقد نجد أن رفع السعر قد يكون خوفاً من الخسارة، وبالتالي نترك تصوراتنا لما نعتقده عن مواقف الطرف الآخر، ونبدأ في البحث عن كيفية تزواج المصالح.
- كيف نُحدد المصالح؟:
إن المواقف تكون مُحددة وواضحة، ولكن المصالح غالباً ما تكون غير مُحددة وغير مُفصح عنها، وبالتالي كيف نبدأ بالتعرف إلى المصالح؟ وما نعنيه هنا هو أنّ التعرف إلى مصالح الطرف الآخر سيكون مهماً وإن لم يكن بدرجة معرفة مصالحنا، فقد يكون موازياً لها، وعليك أن تسأل نفسك لماذا يطرحون مواقفهم شكلاً وتوقيتاً؟ وقد تستطيع أن تسأل بصراحة لماذا تطرحون هذا الموقف، وما الذي تسعون للحصول عليه؟ وما الذي يعنيه الأمر لكم؟ وبذلك تُشعرهم بأنك تُحاول تحديد ما يرونه لمصالحهم. قد يرون أنه من المُناسب طرح مصالحهم كما يرونها، بدلاً من أن تتوصل إلى استنتاجات مُبالغ فيها أو منتقصة حول مصالحهم. وبقدر أهمية السؤال لماذا؟ فإن السؤال لم لا؟. سيكون بذات الأهمية، لِمَ لَمْ يتخذوا القرار؟ ما هي المصالح التي تمنعهم من اتخاذ القرار؟ فالمهم من هذه المسألة أن تُحاول التعرف إلى ما يفكرون به في هذه المرحلة؟ ويختلف ذلك من حالة إلى أخرى.
هناك اختلاف من حالة إلى أخرى، فالمفاوضات أثناء احتجاز رهائن شيء، والمفاوضات حول بيع أو شراء أرض أو عمارة شيء آخر، وإن كانت تتضمن وجوب طرح أسئلة مثل: لماذا؟ ولم لا؟
- ثم علينا أن نفهم أن وراء المواقف يكون - غالباً - التفكير بالربح والخسارة:
ما الذي يُفكر الطرف الآخر أنه سيؤثر فيه سلبياً إذا ما اتخذ قراراً بهذا الاتجاه أو ذاك؟وقد يُفكر أنه إذا لم يتخذ القرار فإنه لن يخسر شيئاً، وقد تتعلق مسائل الربح والخسارة بكيفية رؤية الآخرين لنا، ما الذي سيقولونه عنا؟ هل تنازلنا أكثر مما يجب؟ لماذا غيرنا مواقفنا؟ وكيف سيُفسر ذلك لدى من نُمثلهم؟
- عليك أن تُدرك أن لدى الطرف الآخر مصالح مُتعددة مثلك تماما:
فالمصالح لها استمرارية قبل المفاوضات وخلالها وبعدها. عليك أن تتعامل مع الطرف الآخر من خلال فهم مصالح كل من يُشارك، ومن هم خارج طاولة المفاوضات كحلفاء مثلاً. وستجد هنا أنه ليس لدى أي طرف مصلحة واحدة يُحددها ويتفق عليها الجميع، لكن مجموعة مصالح يسعى الطرف إلى تحقيقها، إدراكاً منه بأن أي اتفاق يجب ألا يقود إلى تفسخ الجبهة الداخلية أو شرخ في تحالفات الطرف الذي تقوم بالتفاوض معه. فمثلك تماماً، هناك أطراف عدة تُشارك معك (في طرفك) من المفاوضات. ومما لا شك فيه، فإن الإعداد من جانبك يتطلب فهماً دقيقاً لكيفية أخذ مصالح الجميع بعين الاعتبار، فما قد يعتبره فرد غير مهم، قد يعتبره شخص آخر في الجبهة التي تُمثلها مهماً للغاية.
ولتأثير القرار على رؤيتنا لمصالحنا أهمية كبرى، فهل سيقود القرار إلى تقوية مكانتنا كأشخاص أو إضعافنا؟ هل سيوجه من نمثلهم أو بعضهم اللوم والاتهامات لنا؟ كيف ستكون التبعات الآنية والتبعات بعيدة المدى نتيجة للقرار الذي سيتم اتخاذه؟ ما هي التبعات السياسة والاقتصادية والدينية والنفسية والأمنية للقرار أو للقرارات المطلوب منا اتخاذها؟
ما هو تأثير ذلك على الرأي العام؟ وكيف سيقوم الخصوم بتوظيفه ضدنا؟ هل ستكون هذه سابقة جيدة أو سيئة؟ كيف سيبنى عليها في المستقبل، وخاصة في مجال الانعكاسات القانونية؟
هل سيقود اتخاذ مثل هذا القرار أو ذاك إلى منعنا من تحقيق ما نريد مستقبلاً؟ هل القرار متوافق مع مبادئنا أو مع ما نستند إليه من شرعيات؟
قد يقود ذلك إلى التفكير بأن تأجيل اتخاذ القرار سيكون في مصلحتك وأسهل عليك، ولكن هذا قد يُعتبر هروباً، وقد تكون له نتائج كارثية.
إنك في نهاية المطاف تتعامل مع خيارات إنسانية وليس مع مُعادلات حسابية، وقد يكون من المُفيد أن تضع ورقة لصناع القرار تُحدد فيها إيجابيات اتخاذ القرار وسلبياته. لكن في نهاية المطاف قد لا يكون هناك مفر من اتخاذ القرار، وعندها عليك توظيف مهارات تسويق القرار، كأن تقول: نحن وان لم نحصل على كل ما نُريد، فإننا حصلنا على نتائج، سعينا لها مُنذ زمن طويل، والجانب الآخر حصل على بعض الأمور التي كان يسعى لتحقيقها، ولكنه لم يحصل على كل ما أراد، والنتيجة إيجابية لنا وله، فحماية أرواح الناس هي الأساس، أو الفائدة على البيئة، أو استتباب الأمن، وغيرها مجتمعه أو منفردة قد تُشكل أساساً في ميزان عرضك ودفاعك عن اتخاذ القرار، دون أن تقول إنك أُجبرت على ذلك، أو لم يكن أمامك خيار، أو أنك مضطر، فآخر ما تريد أن تقوله لمن تُمثلهم: إنه تم إجبارك على اتخاذ القرار رغماً عنك؛ لأنّ هذا سيخلق ردود أفعال داخلية خطيرة، لن تنظر إلى القرار المُتخذ، ولكن ستبدأ في خلق مواقف وطرحها، وشعارات، ومخاوف، وتهديدات على حياة ومصالح من تُمثلهم.
- أقوى المصالح هي الحاجات الإنسانية الأساسية:
في البحث عن المصالح الأساسية خلف المواقف المُعلنة، ابحث عن الدوافع عند ذلك عليك أن تُفكر بمجموعة من العوامل كالأمن، وكيف يرونه، وأوضاعهم الاقتصادية، والانتماء، والسيطرة على الأمور، والأهم كيف ينظرون إلى الندية بينك وبينهم؟
عليك أن تفعل وتقوم بذلك، من خلال استحداث قائمة بهذه الأمور كلها، وهذا لا يُساعدك - فقط - على تذكر الأمور، بل سيُساعدك على تحسين قدرتك على تقييم الأمور مع كل تطور، ومع كل نقطة تسجلها على القائمة. فالمعلومات في نهاية المطاف ستُشكل مصدر قوة لك إذا كنت تسعى للتوصل إلى اتفاق، وفي هذه الحالة تستطيع - أيضاً - تطوير أفكار جديدة.
- الحديث عن المصالح:
إذا كان هدف المفاوضات هو خدمة مصالحك، فالحديث عنها وعن مصالح الطرف الآخر سيُساهم في تحقيق أهدافك. فإذا ما أردت فعلاً للطرف الآخر أن يتفهم مصالحك فعليك الحديث عنها، وأن تُحاول خلال ذلك إقناعهم بأهميتها بالنسبة لك، وبذلك فإنهم سيقومون بالشيء ذاته، سواء أكانوا يعبرون عن قبولهم لما تطرحه، ويحاولون في الوقت نفسه إقناعك بتفهم مصالحهم وأخذها بعين الاعتبار، أو إذا ما كانوا لا يقبلون بها، ويحاولون إقناعك بأن ما تطرحه يتناقض مع مصالحهم، وبذلك تكون محدداً حازماً وواضحاً في طروحاتك، وهذا يعني أن تكون منطقياً في طروحاتك. فالمسألة في هذا المجال ليس تسجيل النقاط، بل مُحاولة تجاوز ذلك إلى إرساء دعائم مُحددة لمصالحك ولأهميتها، وهم سيقومون بالشيء ذاته، مما يعني أنك تكون قد أدخلتهم فعلاً في طريق التوصل إلى الحل على أساس تزواج المصالح.
- عليك أن تتطلع إلى الأمام وليس إلى الوراء:
في الكثير من الأحيان يكون الحديث عن الماضي وما قام به الطرف الآخر دخولاً في إطار تسجيل النقاط، ومحاولة إثبات أن الطرف الآخر أخطأ أو ارتكب أخطاءً في الماضي، وهنا فإن مُحاولة إثبات أخطاء الآخرين ستقودهم حتماً إلى طرح ما يعتقدون أنها أخطاء ارتكبتها أنت، ويتعمق السجال حول الماضي، وما تراه أخطاء، وما يعتقدونه صواباً، وهنا تتحول المفاوضات إلى مُناظرات ومساجلات.
ثالثاً: طرح الخيارات لخلق الأرضية المُشتركة:
الخيارات وتحديدها وتوظيفها لخلق الأرضية المُشتركة تعني القدرة على الوصول إلى مُربع الأخذ والعطاء، وهنا ستكون قد وصلت إلى مرحلة مُتقدمة لإيجاد الحلول وبهذه المرحلة عليك:
1. التشخيص:
في بداية المفاوضات يُحاول كل طرف أن يُثبت مواقفه وصحتها وعدالتها؛ وذلك سعياً لتحقيق الانتصار ولو كان ذلك على حساب الطرف الآخر. وهذا لن يقود إلى نتيجة، فلو تمت الأمور بهذا الشكل لما كان هناك حاجة للمفاوضات أصلاً.
وهنا فإن نجاح المفاوضات يعني البدء في تشخيص المسائل بعيداً عن إطلاق الأحكام المُسبقة أو مُحاولة أخذ كل شيء، أو تثبيت مواقفك، أو مُحاولة إقناع الطرف الآخر أن عليه حل مشاكله كافة، وليس على حساب ما تطلبه منه لحل مشاكلك.
إن نقطة الانطلاق في خلق الخيارات تعتمد على قدرتك على التمييز بين الخيارات والقرارات، فطرح الخيارات هو الطريق المُساعد لاتخاذ القرارات، وليس القرار بعينه. وخلق الخيارات يعتمد على وجوب اتباع التفكير الخلاق. وهنا تبرز الحاجة إلى الدعوة إلى جلسة للعصف الفكري (Brain storming) والتهيئة لمثل هذه الجلسات ضرورية جداً من خلال الاتفاق على مجموعة من القواعد الأساسية:
أ. التفكير بصوت مرتفع وطرح الأفكار لا يعني قبولك بها، أو تسجيلها عليك بوصفها مواقف.
ب. قد يكون من المُفيد الاتفاق على قاعدة (ألا شيء متفق عليه، قبل الاتفاق على كل شيء).
ج. اتفق مع الطرف الآخر على الهدف.
د. اختر مجموعة صغيرة من الطرفين.
ه. حدد بيئة مُناسبة لمثل هذه الجلسات، في مكان غير رسمي، وفي أجواء مختلفة عن أجواء المفاوضات الرسمية، كأن تدعوهم إلى غداء أو عشاء مُخصص للعصف الفكري، بعيداً عن الرسميات، وعن تسجيل ما يدور خلال النقاش وما يُطرح من أفكار. قد تُسجل بعض الأفكار بالاتفاق المُشترك بين الجانبين.
و. أعطِ الجميع فرصة مُتساوية لطرح ما يريدون، أو رفض أو قبول، أو طرح أية أسئلة دون قيود.
ز. قد يكون من المُناسب ألا تجلسوا في مواجهة بعضكم بعضاً كفريقين، فالاختلاط في الجلوس قد يُساعد على خلق الأجواء المُناسبة، خاصة بعد تحديد القواعد واجبة الإتباع خلال الجلسة وتوضيحها.
ح. شجع دائماً على إطلاق العنان للأفكار دون قيود أو تعقيدات. فالهدف الأساسي من هذه الجلسات هو البحث عن الأفكار الجديدة التي لم تُطرح في السابق.
ط. احرص على وضع قاعدة لعدم تسجيل النقاط أو تبادل اللوم.
ي. اسأل على الدوام عند طرح أية أفكار، إذا ما كان بإمكانك الاتفاق على تسجيلها في محضر خاص للاستخدام المستقبلي، وبالاتفاق الكامل مع كل الحاضرين من الطرفين.
ك. بعد انتهاء الجلسة حاول تحديد أهم الأفكار، وحاول صياغتها على شكل خيارات تراعي أن كل ما يُسجل لن يُجحف بمواقف وطروحات أي من المُشاركين. فالقاعدة (لا شيء متفق عليه إلا عند الاتفاق على كل شيء).
ل. حاول إدخال التحسينات على ما تسمعه من أفكار الآخرين، دون أن تُسجلها لنفسك.
م. بعد كل ذلك قيّم كل ما طُرح، وطوره بطريقة خلاقة، ثم أعرضه على إنفراد على كل من شارك في الجلسة، وخذ ما تسمعه منهم من آراء، فأنت في طريقك للتمهيد إلى القرارات عبر ما تتفق عليه معهم من خيارات.
ن. إذا ما توصلت إلى ورقة مُحددة بالخيارات، اطرحها على الطرفين بنقاش مفتوح مع تحديد الهدف، وإذا ما توصلت إلى تبني الورقة من طرف، اذهب واعرضها على الطرف الآخر، دون أن تقول إنك أنهيت النقاش مع هذا الطرف، بل إنك ستقوم بعرض نتيجة ما تتوصل إليه معهم على الطرف الآخر لاحقاً. وبذلك سيشعرون بالمُشاركة في صناعة الخيارات، أو أن لهم اليد العُليا، وهذا مُهم للغاية، وفي نهاية المطاف، فإن أي اتفاق مُشترك يعني الشراكة في اتخاذ القرار بين الجانبين، وأن الخيارات هي من صنع الجانبين.
س. ثم تبدأ بعد ذلك بمناقشة الخيارات؛ بهدف التوصل إلى اتخاذ قرارات مُشتركة من الجانبين.
ع. خاطب كل من تتحدث إليه أثناء صياغة الخيارات بأكثر من خيار لكل مسألة؛ وذلك للمُساعدة على توسيع الآفاق وتبيان الفائدة المرجوة للجانبين.
ف. كلما كانت الخيارات واسعة، كانت الفرص أفضل للبدء في عملية اختيار الخيارات، وتثبيت ما هو مناسب، وشطب ما هو غير مُناسب.
ص. اطلب من الجميع دراسة ما هو مطروح من خيارات واعرضها على الآخرين؛ وذلك لتعزيز الثقة بأنك فعلاً تبحث عن أرضية مُشتركة، ولا تُحاول تثبيت خيار على حساب مصلحة هذا أو ذاك، فالعنصر الأساسي هو أن يشعر كل طرف أن هذه الخيارات جاءت نتيجة لتبادل الأفكار والنقاش العميق والحر لكل هذه المسائل، وليس من خلال مُحاولات التمرير أو الخداع أو الإملاء.
ق. إذا لم يكن بقدرتك التوصل إلى اتخاذ القرارات حول مضمون ما تبحثه فحاول أخذ القرارات على القواعد الإجرائية. فالمهم أن تستمر عملية بناء الخيارات، وهنا عليك أن تتخذ من القواعد الإجرائية المتفق عليها نقطة انطلاق للخيارات الموصلة إلى القُدرة على اتخاذ القرارات حول المضمون، وعليك أن تُركز على الشمولية وعدم الاشتراط والإلزامية والقابلية للتطبيق.
ر. ابدأ الآن بتحديد ما تم الاتفاق عليه كمصالح مشتركة، من خلال ما تم الاتفاق عليه من خيارات، ففي مضمون الخيارات وعلى حدودها تكمن المصالح، فهي بالأساس كانت الدافع وراء طرح الأفكار ونقاشها وتحويلها إلى خيارات. فالجميع يُدرك أن الهدف من هذه الجلسات هو التوصل إلى القدرة على اتخاذ القرارات التي تخدم مصالح المُشاركين كلهم، وليس على حساب أي منهم، وهنا تكون صناعة نقطة الارتكاز للأرضية المُشتركة، أو وضع حجر الأساس لبناء الاتفاق.
2. المعايير المُشتركة:
الإصرار على المعايير الموضوعية: فهذا يُعتبر محوراً ومرتكزاً رئيساً للتوصل إلى الاتفاق، فمهما كانت قدراتك على طرح معادلات يربح من خلالها كل طرف، ولا يشعر أحد أنه خسر كل شيء، أو أن طرفاً ربح كل شيء، مهما كانت وسائل صناعة الخيارات، وإقامة العلاقات القائمة على الصدق والصراحة، فهناك حقيقة بأن هناك مصالح متضاربة ولا يمكن احتواؤها من خلال التعامل بمُعادلات الربح – مُقابل – الربح. فأنت تريد أن تُقيم البناء، والطرف الآخر لا يريد أن يتم ذلك، وأنت تُريد إيصال البضائع إلى الدولة الأخرى، ومصالح بضائعها قد تتأثر سلباً بذلك. وأنت تُريد الحصول على لاعب كرة قدم لناديك، والنادي الآخر لا يُريد. إنها المصالح المُتضاربة ولا يمكن تغطيتها بكل معادلات المفاوضات العلمية والمنطقية، فكيف السبيل إلى الاتفاق؟ عليك أن تُركز على ما يلي:
أ. الحصول على القرار على أساس ما تريد سيُكلفك غالياً وقد لا يتحقق؛ لأن العرض سيُقابل بطرح مُقابل، وهكذا تتحول المسائل إلى حيز العناد. والنتيجة الحتمية لذلك هي تحديد كل طرف لما يريد، دون حتى مُحاولة التوصل إلى أرضية مُشتركة تأخذ بعين الاعتبار التوازن المطلوب لما يُريده كل طرف.
ب. حاول الحصول على القرار الذي تريده، من خلال طرح معايير موضوعية. فلو فرضنا أنك مُهندس تتفاوض على عقد عمل مع شركة تعمل في الصحراء، فعليك أن تحرص على معرفة طبيعة العقود التي وقعت مع مهندسين آخرين، ثم إبراز سنوات الخبرة والمشاريع التي ساهمت في إنجازها. وعدد الأيام أو الأسابيع أو حتى الأشهر التي سوف تقضيها في الصحراء، كل ذلك من خلال مقارنتك لما تم في العقود الأخرى لمن يحملون مثل مؤهلك وخبراتك. فإن كانت الشركة قد تعاقدت مع مهندس بنفس سنوات الخبرة، وبذات حجم الإنجازات، وقدمت له حوافز لعائلته كتذاكر سفر أو تأمين صحي، وسكن مع تكييف في الصحراء وإجازات مدفوعة، فإنها لا يمكن أن تُقدم لك عقداً أقل مما قدمته في عقودها الأخرى.
أنت في هذه الحالة اعتمدت على التفاوض على أساس مبادئ وصدق وعدالة. وبالتالي ستكون النتيجة عادلة. وإن لم تستطع تحسين شروط العقد، فإنك ستكون قد حافظت على الأسس ذاتها.
كان بإمكان المُهندس أن يدخل في المفاوضات حول العقد، دون الحصول على معلومات عن العقود الأخرى، وطبيعة العمل، وبإمكانه طرح خبراته والجامعة العريقة التي تخرج فيها والإنجازات التي حققها وما يتوقعه من راتب وامتيازات، فإن كان ما يطلبه المهندس أعلى بكثير مما قدمته الشركة للآخرين، فلن توقع الشركة عقداً معه. وإن طلب أقل مما حصل عليه من سبقوه، فستعرف الشركة أنه لم يعتمد على الأسلوب المنطقي والعلمي للتوصل إلى اتفاق، خاصة في إعلانات الوظائف التي لا تُعلن عن متطلبات الكفاءة والخبرة وظروف العمل والحوافز التي ستقدمها بما في ذلك الراتب، والسكن، والسيارة، والتأمين وغيرها. ويتطلب التوصل إلى المعايير الموضوعية في حالة المهندس والشركة:
1. معرفة العقود السابقة.
2. مقارنتها بشهادة المهندس وخبراته وإنجازاته وعمره.
3. توافق العقد مع شروط النقابات المتخصصة أو قوانين الدولة.
وعليه فأنت تُثبت من خلال ذلك أنك موضوعي، ودقيق وتهتم بالتفاصيل، وأنك تُرتكز إلى قاعدة التساوي والمبادئ والحكمة، ونستطيع القول: إن أساس الارتكاز وقاعدته في مفاوضات المهندس كانت المنطق الذي لا يُمكن أن تكون دون اعتماد المعايير الموضوعية.
ج. الوصول إلى المعايير الموضوعية يعني قدرتك على حماية نفسك. فالشركة أقوى منك، وقد تستخدم أقدر المحامين، أو تكون قد عرفت ظروفك وحاجتك للعمل. فما فائدة الخيارات وفهم المصالح إذا ما كانت الشركة في موقع مساومة أقوى من موقعك؟ هذه هي الحالة بالغالب، فقد يكون لدى الشركة عشرات الطلبات للوظائف المطروحة، فما الذي تفعله في هذه الحالة؟
الجواب: حماية نفسك من خلال التمسك بالموضوعية والمبادئ والتساوي مع الآخرين. فلا شركة تُريد أن تُلصق بها تُهمة طرح فرص غير مُتكافئة على أناس يتساوون بالشهادات والخبرات والإنجازات، وهذا لا يعني أنك تستطيع أن تطلب راتباً أكبر من رواتب الآخرين.
فعندما تذهب لشراء سيارة ثمنها عشرة آلاف دولار، لا يمكنك إقناع صاحب وكالة السيارات بأن يبيعها لك بألف دولار، تماماً كما لا يمكنك شراء منزل كلف بناؤه 100 ألف دولار ب 20 ألف دولار فقط.
نحن نريد للمهندس الذي يريد الحصول على عقد عادل أن يحمي نفسه بالمعايير الموضوعية التي تحدثنا عنها. ومما لا شك فيه، فإن المُهندس وبعد معرفته لطبيعة العقود التي وقعتها الشركة في الماضي، سيكون قد حدد لنفسه أفضل عقد يُمكن الحصول عليه. أي سقف أعلى، وأسوأ عقد يمكن الحصول عليه، أي سقف أدنى. وبالتالي واستناداً إلى الحقائق الموضوعية فانه يكون قد وفر الحماية لنفسه من خلال خلق سقف توقعات واقعي. فالهدف من دخوله في المفاوضات مع الشركة هو الحصول على أفضل نتيجة مُمكنة، لكن ما هي الخيارات في حالة تعذر المفاوضات حول الحصول على أفضل عقد؟ ماذا لو صممت الشركة على عرض مُحدد، نتيجة لوجود طلبات كثيرة؟ أو لأنها تُريد تخفيض قيمة العقود السابقة؟ هنا على المهندس أن يُفكر بما هو أفضل بديل لعقد يتم عبر المفاوضات؟ فإذا لم تُفكر بالذي سيحدث إذا لم تتوصل إلى عقد عبر المفاوضات تكون بالفعل قد دخلت العملية كمن يُلقي نفسه ببركة سباحة دون أن يكون قد تعلم السباحة. قد تكون متفائلاً بإمكانية الحصول على وظيفة في شركة أخرى. أو أنك قد تقول: إذا ما صممت على ما أريد فسأحصل عليه. أو أن الشركة لا يمكنها أن تستمر دون خبراتي، وما أستطيع تقديمه من خدمات. فكّر بهذه الطريقة وتذكر أن من يُلقي بنفسه في بركة السباحة دون القدرة على السباحة فإن مصيره الغرق، أو على الأقل تعريض نفسه للغرق. إذا ما كان حول بركة السباحة من يستطيع القيام بعملية إنقاذ. قد يكون في الغرفة التي يتم فيها التفاوض على العقد مع المهندس، من لديه الرغبة في مُساعدة المهندس على تفادي الفشل وعدم الحصول على الوظيفة، كأن يقوم بتنبيه المهندس إلى المخاطر المترتبة على استمراره في عناده، إذا ما كان فعلاُ يُريد الوظيفة، كأن يطلعه على قائمة من تقدموا بطلبات للحصول على الوظيفة.
في المُقابل ودون أن تضع أفضل بدائل لعدم التوصل إلى عقد عبر المفاوضات، فإنك قد تعتقد أن عدم قبولك بالكامل بما يُطرح عليك سيعني أنك لن تحصل على وظيفة أخرى مما سيُعرضك وعائلتك للفقر والعوز وعدم القُدرة على تعليم الأبناء أو دفع الإيجار، أو تكاليف العلاج. فالإسراع بقبول ما يُعرض عليك، سيعني إمكانية الغرق أيضاً، وستسأل نفسك لفترات طويلة لماذا لم أطرح هذا البديل أو ذاك؟ أو لماذا لم أفكر بهذا الخيار؟.
بالتالي فإن أفضل خيار بالنسبة لك هو إن لم تتمكن من الحصول على عقد من خلال المفاوضات أن تُحاول

Methodology of the Negotiations
Part one
First: The distinction between people and the problem:
We have to know that those who run the negotiations are humans having names, characters, problems, history, ambitions, fears, advantages, opponents and friends. They represent the other side which might be represented by many directions through ministries or by social, religious and economic institutions or other different parties. Those people differ in their characters, behaviors, ideologies, opinions, backgrounds and behaviors.
We must recognize:
1. The human factor in any negotiations could be a helpful or destructive element.
2. Constructing relations of trust, labor, respect, understanding and acknowledgment to families and even to friendship might contribute largely to creating suitable atmospheres to reach agreements.
On another side, any person may get angry, arises, depresses, doubts, fears and be skeptical and may be aggressive. And he may feel the insult or detract from the dignity. And some of them may see the solutions or not through their advantages and perspectives. And in any case this will ultimately lead to complications, misunderstanding and escalation which means driving the negotiations into swirl has a beginning but not end, and which also means the failure of the negotiations or at least their obstruction, or leading them to arguments to score points and exchange charges at the expense of the content of negotiations and the interests of the parties.
Not taking into account persons’ sensitivity and understanding their personalities as being humans will lead to catastrophic reactions on the negotiations. And whatever the preparations which you practice through the negotiations were, it could be necessary to ask yourself regularly: shall I give enough interest to the problems of the people who share the negotiations? And in order to avoid such these reflections on the negotiations, we should:
1. Recognize that each negotiator has advantages in the content of the negotiations and in the personal relations.
2. Take into account the nature of personal relationships of the negotiators.
3. Believe that negotiating on the attitudes will lay the personal relationships and the content of the negotiations in the circle of conflict.
4. Separate between personal relationships and the content.
5. Understanding the view points of the other sides. This is because their view points could be part of the solution, and it could increase the problem.
6. Try to see things as seen by the other party.
7. Not imagine that your fears are like the fears of the other sides.
8. Not blame the other side or other sides for the problems that you suffer from. Blaming others for your problems is easy and enters in the search of who will carry the responsibility of the problems’ reasons, which means adding new problems to the present ones.
9. Exchange views with the other sides.
10. Search for opportunities to prove to the other sides that you understand their view points, or at least you are trying to understand them.
11. Try to show that the solution that you are trying to reach ensures their interests or part of them, and you are ready to do so.
12. Attempt to understand the perspective of the other sides in the process of formulating the proposals.
13. Recognize and understand their emotions if you want them to understand your emotions because emotions are legitimate, and let the emotions be constantly expressed by you and them.
14. Try not to respond to emotional attacks or attempts to score points.
15. Show respect for the symbols of other sides, and what they believe in and respect, especially in their religious and national occasions.
16. Maintain the communications and contact. So, without this there will be no negotiations.
17. Always speak in a way that let each one hears you to understand well, and take into account not talk about yourself or about them. But, it is necessary that the talk be in the target aim.
18. All of this comes so as to be able to build real and effective work relationships with other sides.
Second: interests:-
Focus on interests, not attitudes. This means that you have to recognize that any negotiations are based on attitudes’ divergence. And because the aim is to reach agreement about these attitudes, members of the negotiating parties focus on and think about the attitudes which lead to the obstruction of the negotiations. And so, it should be focused on:
1. Mating of interests, not attitudes:
We should, once we know the contradiction in the attitudes, study reasons of taking theses attitudes from each side. We will find out that the attitudes are developing in response to what we see for advantages we want to keep on and not to tamper. Therefore, instead of focusing on the attitudes, it is focused on the advantages. So, there will be many possibilities to find solutions absorb advantages of the sides.
2. Recognizing that advantages are the way to define the problems:
The basic problem in the negotiations is the contrast between attitudes, but elements of the conflict usually include needs, desires and fears. So, here is the beginning of the search for the creative solutions through keeping on the advantages and achieving what each side thinks as its advantage.
3. Knowing that contradicted attitudes include joined and contradicted advantages:
Usually we imagine that the result of our attitudes’ contradiction with the others is that our advantages will ultimately be contradicted. So, for example, if we want to build a society, we think that the other side does not want to build. And if we want to reduce the goods price, we think that the other side will really increase the prices. But, if we examine accurately our advantages in building or reducing prices and examined the advantage of the other side by refusing building or increasing prices, we will find out that the conflict could be on the position and not on the idea of building. And we may find out that increasing the prices could be the result of fear of the loss. So that, we understand our perceptions of what we think about the attitudes of the other side, and we begin searching for a way of mating interests.
4. How do we define advantages?
Attitudes are defined and clear, but advantages usually are not defined and are not shown clearly. Therefore, how do we start knowing the advantages? What do we mean here is that knowing the advantages of the other side will be very important and even though it is not as knowing our advantages, it could parallels them, and you have to ask yourself why do they present their attitudes in form and in time? You could ask frankly: why do you present this attitude? And, what do you want to achieve? And what does that matter mean to you? And by this you make them feel that you are trying to define what they see for their advantages. They could see that it is better to present their advantages as they see them instead of getting exaggerated or reduced conclusions about their advantages. And as the question why is important, so the question why not will have the same importance, why did not they take the decision? What are these advantages that prevent them from taking the decision? The important thing in this issue is to try understanding what they are thinking about in this stage. And this defers from case to case.
There is a difference from case to case, so the negotiations during detention of hostages are one thing, and the negotiations about selling or buying a land or a building are another thing. And even it includes the necessity of asking questions like: why? And why not?
5. We have to understand that behind attitudes there is-usually-thinking about profit and loss:
What does the other side think that it will affect it negatively if it takes a decision in this way or that? And it may think that if it does not take the decision, it will lose nothing. And the attitudes of loss and profit may be affected by how the others view us, what will they say about us? Did we relinquish more than what it should be? Why did we change our attitudes? And how this will be explained by those that we represent?
6. You have to know that the other side has various advantages like you:
The advantages have continuity before, during and after the negotiations. You have to deal with the other side through understanding the advantages of each contributor, and those who are outside the table of the negotiations as allies. And you will find out that not each side has an advantage determined and agreed on by all. But a group of advantages which the side seeks to achieve, and recognizing that any agreement should not lead to disintegration of the home front or a crack in the alliances of the side that you negotiate with. Extremely like you, there are many sides share you (in your party) from the negotiations. Undoubtedly, the preparation from your side requires quite understanding of how to take the advantages of the others in your mind, which could be viewed by anyone as unimportant, could be viewed by another one as very important in the front that you represent.
Decision’s effect has a great importance in our perspectives on our advantages, so will the decision lead to strengthen our status as persons or to weaken us? Will it lead those represented by us or some of them to the blame and accusations to us? How will the immediate and long run consequences, as a result of the decision which will be taken, be? What are the political, economic, religious, psychological and secure consequences of the decision or the decisions which we are required to take?
What is the effect of this on the public opinion? And how will the opponents employ this against us? Will this be a good or bad reality? How will it be build on in the future, and especially in the field of Legal Implications?
Will taking like this decision or that lead to preventing us from achieving what we want in the future? Is the decision in agreement with our principles or with the legitimacies that we base on?
This may lead to think that delaying decision taking will support your advantage easier for you, but this could be viewed as an escape, and could lead to catastrophic results.
You are, at the end, dealing with human choices and not with mathematical equations. It could be worthwhile to present a paper to the decision makers defining therein the positives and negatives of taking the decision. But at the end there might be no escape from taking the decision, and in that case you have to employ decision marketing skills, like saying: although we did not get all what we wanted, we got the results which we sought to achieve for a long time, and the other side got some things which it was seeking to achieve, but it did not get all what it wanted, and the result is positive for us and it. Saving human souls is the basic aim. The usefulness on the environment or prevalence of safety and others in groups or in individuals could be a base in the balance of your presenting and defending of the decision taking, without saying that you were forced to do that, or you did not have another choice, or you were compelled to do that. The last thing to say to those you represent is: you were forced to take the decision unwillingly, because this will result in dangerous inside reactions which will not look at the taken decision, but it will start creating and presenting attitudes, and slogans, fears and threads on the life and advantages of those that we represent.
7. The strongest advantages are the basic human needs:
In searching through the basic advantages behind declared attitudes, search for the motivations, and then, you have to think of some factors like safety and how they view it, their economic situations, affiliation and controlling the matters. And most importantly, how do they look at the parity between you and them? You have to act and do this through creating a list of all of these things, and this doesn’t help you only in just remembering things but it will help you in improving your ability of judging things with every development and with every point you score in on the list. At the end the information will be a source of strength for you if you were seeking to reach an agreement. And in this case you can also develop new ideas.
8. Talk about the advantages:
If the aim of the negotiations is to serve your advantages, the talk about them and about the advantages of the other side will contribute to achieve your aims. If you want the other side to understand your advantages, you should talk about them. And try through this to convince them with their importance for you. So they will do the same thing, whether they express their acceptance of what you present, and try to convince you at the same time to understand their advantages and take them in your mind, or if they do not accept them, and try to convince you that what you present is contradicted with their advantages, so that you are specific, firm and clear in your proposals, and this means to be logically in your proposals. The issue in this case is not scoring points, but trying to exceed that in order to lay definite supports for your advantages and for their importance, and they will do the same thing, which means that you entered them really in the way to reach the solution on the base of mating interests.
9. You have to look forward and not backward:
In many times the talking about the past and what the other side did is an entry in the scope of scoring points and trying to prove that the other side wronged or committed mistakes in the past, so trying to prove the faults of the others will necessarily lead them to present the faults that, as they think, were committed by you. And the argument will deepen about the past, and what you see as faults, and what they think to be right, and so, here the negotiations are driven to debates and diatribes.
Third: - presenting choices to create the common floor:
The choices, their definition and their employment to create the common floor mean the ability to reach the square of taking and giving. Here you will have been reached to an advanced stage to find solutions. And by this stage you have to do the following:
1. Diagnosis:
At the start of the negotiations each side tries to prove its attitudes, their validity and their fairness. This is seeking to achieve the victory even if it is at the expense of the other side. This will not lead to a result. If the things were achieved like this shape, there will be no need for negotiations previously.
Here, the success of the negotiations means the beginning of diagnosing the issues away from launching the prejudices, trying to take everything, proving your attitudes or trying to convince the other side that it should solve all its problems and not at the expense of what you ask it to solve your problems.
The launching point in the creation of choices depends on your ability to distinguish between choices and decisions. Presenting choices is the helpful way to take decisions, and not the decision itself. And creating the decisions depends on the necessity of following the creative thinking. And hence appears the need to invite for a session of brainstorming and the preparations for such these sessions is very important through the agreement on a group of basic rules:
• Thinking loudly and presenting the ideas do not mean your acceptance of them, or attaching them to you as being attitudes.
• It could be worthwhile to agree on a rule (nothing is agreed on before agreeing on everything)
• Agree with the other side on the aim.
• Choose a small group from the two sides.
• Select a suitable environment for such sessions, like unofficial place and in different atmospheres from the official negotiations atmospheres. Like inviting them to special lunch or dinner for brainstorming, and away from the formalities, and recording what is going on during the debate and the ideas that are being presented. Some ideas could be recorded by the mutual agreement between the two sides.
• Give the all a mutual opportunity to present what they want, or rejecting, accepting or presenting any questions without restrictions.
• It could suitable not to sit face to face as two teams. Mixing in the sitting may help to create the appropriate atmospheres especially after defining the rules that should be followed and clearing them during the session.
• Always encourage to unleash the ideas without restrictions or complications. The main aim of these sessions is the search for new ideas which were not presented in the past.
• Be sure to lay a base for not scoring points or exchanging the blame.
• Ask continually once presenting any ideas if you can not agree on scoring them in a special record for future use, and in full agreement with all the attendants from the two sides.
• Try to define the most important ideas after finishing the session. And try to formulate them in the form of options which take into account that all is being recorded will not be prejudiced by the attitudes and proposals of any of the attendants. The rule is (nothing is agreed on before agreeing on everything).
• Try to put improvements on what you hear of the others’ ideas without recording them to yourself.
• After all that evaluate all that was presented and develop it in a creative way, then present it individually to everyone attended the session. And take the opinions that you hear from them. You are in your way to pave for the decisions through the options that you agree on with them.
• If you reach a paper limited with options, present it to the two sides with an open debate in addition to defining the aim. And if reach to adapting the paper from one side, go and present it to the other side without saying that you finished the debate with this side, but you will present the result of what you reach with them to the other side lately. By this they will feel the share of making the options or that they have the upper hand, and this is very important. And at the end, any joint agreement means the participation in taking the decision between the two sides, and options are made by the two sides.
• After that begin debating the options in order to reach taking joint decisions from the two sides.
• Address each one you are speaking to during options formulation by more than one option for each affair; this is to help expanding the horizons and clearing the intended interest of the two sides.
• Whenever the options are wide, the opportunities are better for starting the process of choosing the options, fixing what is suitable and crossing what is not suitable.
• Ask all to study the presented options and display them to the others; this is to motivate the confidence that you are really searching for common floor, and you are not trying to fix an option at the expense of the advantage of this side or that. The basic element is that each side feels that these options came as a result of exchanging the ideas and the deep and free debate for all these affairs, but not through tries of passing, deception or dictation.
• If you do not have the ability to reach decisions taking about the content of what you are searching for, try taking the decisions on the procedural rules. The important thing is the continuity of options building process. Here you have to use the agreed on procedural rules as a launching point for the options leading to the ability to take decisions about the content, and you have to concentrate on the comprehensiveness, and not giving conditions or mandatory and the applicability.
• Start now defining what was agreed on as joint advantages. This is done through the options that were agreed on. It is in the content of options and on their borders are the advantages. It was basically the motivation behind presenting the ideas, debating them and changing them to options. Everyone recognizes that the aim of these sessions is reaching the ability to take the decisions that serve the advantages of all the participants, and not at the expense of any of them. And here is making the focal point for the common floor or putting the stone foundation to build the agreement.
2- Common standards:
The insistence on the objective standards: this considered a mainly center and a pivot to reach the agreement. Whatever are your abilities to present equations through which each side wins, and no one feels that he lost everything, or a side won everything, and whatever are the methods of making options and establishing the relations that are based on the honesty and candor, there is a fact that there are contradict advantages and they can not be contained through dealing with the equations of profit - for – profit. You want to found the structure and the other party does not want that to be done. And you want to reach the goods to the other country, and the advantage of its goods could be affected negatively by that. And you want to get a football player for your club, and the other club does not want that. They are the contradicted advantages, and it could not be covered by all equations of scientific and logical negotiations. So, what is the way to reach an agreement? You have to concentrate on the following:
a) Getting a decision based on what you want will cost you a lot and it might not be achieved, because the offer will be met by presenting an alternative. So, by this matters change to the space of obstinacy. And the ultimate result of this is that each side defines what it wants, and even without trying to reach a common floor which takes into account the wanted palace for what each side wants.
b) Try to get the decision that you want through presenting objective standards. if we suppose that you are an engineer who is negotiating at a job contract with accompany working in the desert, you have to ensure knowing the nature of the contracts that were signed with other engineers, then show years of experienced and the projects you contributed in their establishment. And the number of days, weeks or even the moths that you are going to stay in the desert. All this is done through your comparison of what was done in the other contracts of those who carry like your qualifications and experiences. If the company had contracted withy an engineer with the same years of experience and with the same amount of achievements, and it gave him incentives for his family like travel tickets or health insurance, and housing with conditioning in the desert and paid leaves, so it could not offer you a contract containing less than what it presented in its other contracts.
In this case, you depended on negotiating on a basis of principles, truth and justice. And therefore, the result will be just. And if you could not improve the conditions of the contract, you would have maintained the bases themselves.
It was possible for the engineer to enter the negotiations about the contract without getting information about the other contracts and the nature of the work, and he can present his experiences and the ancient university in which he was graduated, and the achievements that he made, and the expected salary and privileges. If what the engineer asks is much higher than that the company presented to the others, the company will not sign the contract with him. And if he asked lower than the predecessors, the company will know that he did not depend on the logical and scientific method to reach the agreement, and especially in the job ads which do not advertize the requests of competence, experience, work conditions and incentives that it will grant including salary, housing, car, insurance and others. And it requires reaching the objective standards in the case of the engineer and the company:
1. Knowledge of previous contracts.
2. Comparing them with the engineer’s certificate, experiences, achievements and age.
3. Contract’s compatibility with the specialized unions’ terms or the state’s laws.
And so, you are proving through this that you are objective and accurate and interested in details and you concentrate on the basis of equality, principles and wisdom. And we can say: the fulcrum and its rule in the engineer’s negotiations were the logic which can not be so without depending on the objective standards.
c) Reaching the standard objectives means your ability to protect yourself. The company is stronger than you, and it may use the most efficient lawyers. Or it could be that it knew your conditions and your need to job. So what is the importance of the options and understanding of the advantages if the company is in a stronger position of bargaining than yours? This is the case usually. The company could have tens of applications to the offered jobs. So what is that you need to do in this case?
Answer: protecting yourself throughout holding the objectivity, principles and equality with the others. There is no company desires to attach itself charge of presenting unequal opportunities to people who are equal in certificates, experiences and achievements. And this does not mean that you can ask a salary higher than the others’ salaries.
When you go to buy a car costs ten thousand dollars, you can not convince the owner of the cars agency to sell you it by one thousand dollars. Exactly as you can not buy a house its building cost 100 thousand dollars by just 20 thousand dollars.
We want for the engineer who wants to get a fair contract to protect himself by the objective standards that we talked about. There is no doubt that the engineer, after knowing the nature of the contracts that the company signed in the past, will have chosen for himself the best contract he could get. In other words, the highest or the worst roof of a contract he could get, or in other words, the lowest floor. And therefore based on the objective facts he will have provided protection for himself through making a realistic expectations roof. So the aim of his entrance the negotiations with the company is to get the best possible result, but what are the options in the case of the impossibility of the negotiations about getting the best contract? What if the company insisted on a limited offer as a result of the existence of many applications? Or because it wants to reduces the value of the previous contracts? Here the engineer has to think of the best alternative for a contract fulfilled through negotiations. If you do not think of what will happen if you do not reach a contract through the negotiations you will really enter the process as a one who throws himself into a swimming pool without being able to swim. You could be optimistic of the possibility of getting a job in another company. Or you could say: if I insist on what I want I will get it. Or the company could not continue without my experiences and what I can submit of services. Think in this way and remember that the one who throws himself in the swimming pool without the ability to swim his fate is the drowning, or at least exposing himself to the drowning. If it was around the swimming pool somebody can do the process of rescue, s/he could be in the room in which the negotiating is being done about the contract with the engineer, and who has the desire to help the engineer to avoid failure and not getting the job, it is like the one who warns the engineer about the risks that result in his continuance of his obstinacy, if he was really wanting the job, like showing him the list of those who delivered applications to get the job.
On the other hand, and without putting the best alternatives of not reaching the contract through the negotiations, you think that your not acceptance completely of what is being presented to you will mean that you will not get another job which will expose you and your family to poverty, destitution and the inability of teaching the sons or paying the rent, or the treatment costs. So by hasting of acceptance of what is offered to you will mean the possibility of drowning too, and you will ask yourself a lot of the time: why did I not present this option or that? Or why did I not think of this option?
So, the best option for you is: If you could not get the contract through the negotiations, you have to try:
