Objectives
The objective of this Memorandum is to encourage mutual cooperation between the Parties in the field of healthcare and medical sciences. The Parties shall facilitate and enhance mutual cooperation between them in the areas decided upon on the basis of mutual interest.
Article 2
Areas of Cooperation
The areas of cooperation include, but are not limited to, the following:
CLINICAL AREAS
a. Healthcare infrastructure, including design, build and operation of facilities
b. Prevention and treatment of disease (inclusive of but not limited to diabetes, cardiovascular disease, oncology, etc.)
c. Digital health (e-health, big data, etc.)
d. Clinical education and training (of the workforce or in particular clinical areas)
e. Genomics, genetics and personalised medicine
POLICY AND HEALTHY SYSTEM ISSUES:
a. Anti-microbial resistance
b. Public health policy
c. Public-private partnerships
d. Investment
e. Health insurance
f. Clinical and research collaboration
Article 3
Forms of Cooperation
The Parties shall work towards facilitating their cooperation in the field of health care through the following:
a. Encourage and enhance mutual understanding between their relevant competent authorities in charge of all the issues related to healthcare.
b. Encourage the establishment of direct communication contacts between their relevant competent authorities in charge of all the issues related to health care through sharing expertise, systems and processes.
Article 4
Expenditure
Each Participants shall bear its own expenses in the course of implementing this Memorandum, unless the Parties jointly decide otherwise.
Article 5
Supervision and Follow-up
To provide supervision and coordination between the activities stipulated in this Memorandum and to ensure optimal conditions for the execution of such activities, the Parties shall form a joint committee comprising representatives from both Parties. This committee shall hold its meetings alternately in the two countries.
Article 6
Applicable Law
The provisions of this Memorandum shall be implemented in accordance with the laws and regulations applied in the country of each Participant and its international obligations.
Article 7
Settlement of Disputes
Any dispute or conflict between the Parties arising from the interpretation or implementation of this Memorandum shall be settled amicably through diplomatic channels.
Article 8
Amendments
The provisions of this Memorandum or any of its texts may be amended upon mutual written consent of the two Parties. Such amendment shall enter into effect according to the same procedures stipulated in Article 9 of this Memorandum.
Article 9
Entry into Force
1. This Memorandum shall enter into force …….. (___________) days from the date of receipt of the last notification by one Participant from the other, through diplomatic channels, that all legal and internal requirements for this Memorandum to enter into force have been completed.
2. This Memorandum shall be valid for a period of three (3) years, and shall automatically be renewed for a similar periods, unless either Party notifies the other, in writing, of its intention to terminate it at least (6) six months before the date of its termination or expiration, through diplomatic channels.
3. The termination or expiration of this Memorandum shall not affect the existing programs and activities until their completion, unless the Parties agree otherwise.
In witness thereof, the under signed authorized by their respective Governments have duly signed this Memorandum.
Translation - Spanish PRIMERA. OBJETIVO
El objetivo del presente Memorándum es fomentar la cooperación mutua entre las Partes en el ámbito de la salud y las ciencias médicas. Las Partes deberán facilitar y promover la cooperación mutua en las áreas establecidas sobre la base del interés mutuo.
SEGUNDA. ÁREAS DE COOPERACIÓN
Las áreas de cooperación incluyen, entre otras, las siguientes:
ÁREA CLÍNICA
a. Infraestructura sanitaria, incluido el diseño, construcción y funcionamiento de las instalaciones
b. Prevención y tratamiento de enfermedades (entre otras, diabetes, enfermedad cardiovascular, oncología)
c. Salud digital (e-salud, macrodatos, etc.)
d. Educación y capacitación clínica (del personal o en áreas clínicas específicas)
e. Genómica, genética y medicina personalizada
TEMAS DE POLÍTICAS Y SISTEMAS DE SALUD
a. Resistencia antimicrobiana
b. Políticas de salud pública
c. Asociaciones público-privadas
d. Inversiones
e. Seguros de salud
f. Colaboración clínica e investigativa
TERCERA. FORMAS DE COOPERACIÓN
Las Partes deberán trabajar para facilitar su cooperación en el ámbito de la salud de la siguiente manera:
a. Fomentando y promoviendo el entendimiento mutuo entre las autoridades competentes pertinentes a cargo de los temas relacionados con la salud.
b. Fomentando la creación de contactos directos de comunicación entre las autoridades competentes pertinentes a cargo de los temas relacionados con la salud a través del intercambio de experiencia, sistemas y procesos.
CUARTA. GASTOS
Cada Parte deberá solventar sus propios gastos durante la implementación del presente Memorándum, a menos que las Partes decidan conjuntamente lo contrario.
QUINTA. SUPERVISIÓN Y SEGUIMIENTO
A fines de proporcionar supervisión y coordinación entre las actividades estipuladas en el presente Memorándum, y para garantizar condiciones óptimas en la ejecución de tales actividades, las Partes deberán formar un comité conjunto compuesto de representantes de ambas Partes. Este comité deberá realizar sus reuniones de forma alternativa en ambos países.
SEXTA. DERECHO APLICABLE
Las cláusulas contenidas en el presente Memorándum deberán ser implementadas de conformidad con las leyes y normas aplicables en el país de cada Parte, y según sus compromisos internacionales.
SÉPTIMA. RESOLUCIÓN DE CONTROVERSIAS
Toda controversia o cualquier conflicto que surja entre las Partes a causa de la interpretación o de la implementación del presente Memorándum deberán ser resueltos de forma amigable a través de los canales diplomáticos.
OCTAVA. MODIFICACIONES
Las cláusulas o cualquier texto contenido en el presente Memorándum podrán ser modificados con el consentimiento previo por escrito de ambas Partes. Tales modificaciones tendrán efecto de conformidad con el mismo procedimiento establecido en la cláusula NOVENA del presente Memorándum.
NOVENA. VIGENCIA
1. El presente Memorándum entrará en vigencia a los ………. días contados desde la fecha de recepción de la última notificación de una de las Partes hacia la otra, a través de los canales diplomáticos, indicando que se han cumplido todos los requisitos legales internos para que el presente Memorándum entre en vigencia.
2. El presente Memorándum será válido por un período de 3 (tres) años y será renovado automáticamente por períodos similares, a menos que una de las Partes notifique a la otra por escrito, a través de los canales diplomáticos, su intención de rescindir el presente Memorándum con al menos 6 (seis) meses de anticipación antes de la fecha de rescisión o de expiración.
3. La rescisión o la expiración del presente Memorándum no afectará los programas y actividades existentes hasta que se completen, a menos que las Partes acuerden lo contrario.
En prueba de conformidad, los que suscriben, autorizados por sus respectivos Gobiernos, firman el presente Memorándum.
