Eine umfassende Freizeichnung in Allgemeinen Geschäftsbedingungen (hier: eines Gebrauchtwagenkaufvertrags), nach der die Haftung des Klauselverwenders auch für Körper-und Gesundheitsschäden sowie für sonstige Schäden auch bei grobem Verschulden ausgeschlossen ist, hält einer Inhaltskontrolle am Maßstab des § 309 Nr. 7 lit. a und b BGB nicht stand (im Anschluss an Senat, Urt. v. 22.11.2006 – VIII ZR 72/06, BGHZ 170, 67;
Urt. v. 19.09.2007 – VIII ZR 141/06, BGHZ 174, 1).

Sachverhalt: Mit Kaufvertrag vom 04.10.2007 erwarb der Kläger von dem Beklagten einen gebrauchten Mercedes-Benz ML 55 AMG zum Preis von 33.000 €. Der Verkauf erfolgte über den Streithelfer, einen Gebrauchtwagenhändler, der das Fahrzeug im Auftrag des Beklagten veräußerte. Der Kaufvertrag enthält einen formularmäßigen Gewährleistungsausschluss, wonach das Fahrzeug
„… gebraucht, wie ausgiebig besichtigt, unter Ausschluss jeglicher Gewährleistung im Hinblick auf sichtbare und unsichtbare Mängel, insbesondere bezüglich des Kilometerstandes, früherer Unfälle und etwa auftretender Schäden infolge früherer Unfälle …“ veräußert wird. Auf der Rückseite des Kaufvertragsformulars ist unter der Überschrift „Gewährleistung“ zusätzlich bestimmt:
„Das Fahrzeug ist verkauft unter Ausschluss jeder Gewährleistung. Ansprüche auf Wandlung, Minderung oder Schadensersatz sind, soweit gesetzlich zulässig ist, ausgeschlossen, und zwar sowohl wegen erkennbarer als auch wegen verborgener Mängel …“
Das Fahrzeug, welches einen Kilometerstand von 59.000 aufwies, wurde dem Kläger am 12.10.2007 übergeben. Am 13.10.2007 bemerkte er ein „Klackern“ des Motors.
Mit der Behauptung, das Fahrzeug habe bei Übergabe an ihn einen Motorschaden aufgewiesen, verlangt der Kläger die Rückabwicklung des Kaufvertrages. Das Landgericht hat die auf Rückzahlung des Kaufpreises und Ersatz von Aufwendungen nebst Zinsen, Zug um Zug gegen Rückgabe des Fahrzeugs, gerichtete Klage nach Beweisaufnahme abgewiesen. Der Gewährleistungsausschluss sei wirksam, weil der Kläger nicht bewiesen habe, dass der Streithelfer den Sachmangel arglistig verschwiegen habe. Das Oberlandesgericht hat die Berufung des Klägers zurückgewiesen.
Seine Revision führte dazu, dass das Berufungsurteil aufgehoben und dieSache zur neuen Verhandlung und Entscheidung an das Berufungsgericht zurückzuverwiesen wurde.
Translation - English Ineffective Warranty Disclaimer (“Buyer Beware”) Clause in Used Automobile Sales Contract
A comprehensive disclaimer of liability in the General Terms and Conditions of a used automobile sales contract, which purports to absolve liability for damages for personal injury as well as other damages, even in cases of gross negligence, does not withstand scrutiny under Section 309, No. 7 subsections a and b of the German Civil Code (referring to Civil Supreme Court judgment of November 22, 2006 – 8th Civil Panel 72/06, Supreme Court Reporter 170, 67; and Civil Supreme Court judgment of September 19, 2007 – 8th Civil Panel 141/06, Supreme Court Reporter 174, 1).

Summary of Facts: Under a sales contract dated Oct. 4, 2007, the plaintiff purchased a used Mercedes-Benz ML 55 AMG at a price of 33,000 EUR from the defendant. The sale was carried out by the intervenor, a used car dealer, who sold the vehicle on behalf of the defendant. The sales contract contains a boilerplate warranty disclaimer clause, according to which the vehicle is sold:
“…used, substantially as is, under disclaimer of any warranty with regard to patent or latent defects, in particular with respect to the kilometer reading, previous accidents or collisions, and any damage occurring due to previous accidents or collisions…” In addition, on the back of the sales contract form, under the heading “Warranty”, it is provided that:
“The vehicle is sold under disclaimer of any warranty. Claims for rescission, abatement or damages are barred insofar as legally permissible, in the case of both discernable and hidden defects…”
The vehicle was delivered to the plaintiff on October 12, 2007 with an odometer reading of 59,000 kilometers. On October 13, 2007, the plaintiff noticed a clicking noise in the engine.
The plaintiff asserts that the vehicle had a damaged engine on delivery, and demands that the sales contract be rescinded. After taking evidence, the lower court rejected the claim for repayment of the purchase price, and compensation for expenses plus interest, in exchange for return of the vehicle. The warranty disclaimer clause was enforceable because the plaintiff did not prove that the intervenor fraudulently concealed the defect. The state Supreme Court dismissed the plaintiff’s appeal.
The plaintiff’s further appeal to the German Supreme Court resulted in a reversal of the regional appellate court’s judgment and the case being remanded back to the regional appellate court for a new hearing and decision.

Erfolgreiche Bilanz für erstes Jahr der „Zero Pellet Loss“-Initiative in Österreich.
(Wien, 3. Juni 2016) „Plastik und Mikroplastik gehören nicht in die Umwelt“, sind sich Bundesminister Andrä Rupprechter und EU-Umweltkommissar Karmenu Vella einig. Bei einem Besuch im Borealis-Werk in Schwechat informierten sich die beiden heute, Freitag, über technische Neuerungen gegen Plastik in der Umwelt. Die enge Zusammenarbeit mit der Industrie zeigt bereits Wirkung: Die 2015 von Rupprechter gemeinsam mit der Kunststoffindustrie gestartete „Zero Pellet Loss“-Initiative hilft, den Austritt von Kunststoffgranulat in die Umwelt zu vermeiden. Im ersten Jahr konnten die Betriebe ihre Kunststoff-Verluste um 90 % reduzieren. „Für eine plastikfreie Umwelt müssen wir europaweite Lösungen finden. Ich bin stolz, dass Österreich dabei eine Vorreiterrolle übernimmt“, betonte Rupprechter.
Auch auf der Agenda von EU-Umweltkommissar Karmenu Vella steht das Thema Plastik ganz oben, insbesondere im Zusammenhang mit dem europäischen Paket zur Kreislaufwirtschaft. Dieses liefert einen zentralen Ansatzpunkt, um den Lebenszyklus von Kunststoffen und das Recycling zu optimieren. „80 % des Abfalls im Meer besteht aus Plastik. Eine der stärksten Antriebskräfte, um diesen Prozentsatz zu reduzieren, ist Abfall in eine wirtschaftliche Chance umzuwandeln. Das bezeichnen wir im Wesentlichen als Kreislaufwirtschaft. Die von Herrn Bundesminister Rupprechter geförderte Zero Pellet Initiative ist ein Beispiel für diesen Ansatz. Die Europäische Kommission arbeitet hart daran zu gewährleisten, dass derartige Beispiele für eine Kreislaufwirtschaft in der gesamten EU zur Norm werden“, so EU-Umweltkommissar Karmenu Vella.
Ein Jahr „Zero Pellet Loss“-Initiative in Österreich
Um Plastik in der Umwelt zu reduzieren, hat Umweltminister Andrä Rupprechter im Frühling 2015 mit dem Fachverband der Chemischen Industrie Österreichs (FCIO) einen „Zero Pellet Loss“-Pakt geschlossen. Er beinhaltet einen Zehn-Maßnahmen-Plan zur Vermeidung des Austritts von Kunststoffgranulat in die Umwelt. Jährlich werden durchschnittlich 41 Tonnen Kunststoff über die Donau abtransportiert, ca. 90 % davon sind auf Einträge auf Grund von Windverfrachtung, Abschwemmung und Littering zurückzuführen.
Seit dem Beginn der Initiative ist die Anzahl der teilnehmenden österreichischen Unternehmen stetig gewachsen – und der Anteil an verlorenen Kunststoff-Teilchen deutlich geschrumpft. Mittlerweile wurden laut Umsetzungsbericht des FCIO bei einer Gesamtproduktions- und Verarbeitungsmenge von rund 2 Millionen Tonnen Kunststoff in Österreich die Verluste von 4,9 Kilo/Tag auf weniger als 1 Kilo/Tag reduziert.

Successful First Year of the “Zero Pellet Loss” Initiative in Austria.
(Vienna, June 3, 2016) Federal Minister Andrä Rupprechter and EU Environment Commissioner Karmenu Vella agree: “Plastics and microplastics don’t belong in the environment.” During a visit to the Borealis plant in Schwechat near Vienna today, they caught up on technical innovations to combat plastics in the environment. The close cooperation with industry is yielding results. The Zero Pellet Loss initiative that Rupprechter launched with the plastics industry in 2015 is helping to prevent the release of plastic granules into the environment. In the first year, the businesses were able to reduce their plastics losses by 90%. “We must find Europe-wide solutions for a plastics-free environment. I am proud that Austria has taken a pioneering role in the process,” emphasized Rupprechter.
The topic of plastics is also at the top of EU Environment Commissioner Karmenu Vella’s agenda, especially in connection with the European Circular Economy Package. This package provides a central starting point for optimizing the life cycle and recycling of plastics. “80% of marine litter consists of plastic. One of the strongest driving forces for reducing this percentage is to transform waste into an economic opportunity. This is essentially what we describe as the circular economy. The Zero Pellet Loss initiative promoted by Federal Minister Rupprechter is an example of this approach. The European Commission is working hard to ensure that examples of a circular economy such as this become the norm in the EU,” according to EU Environment Commissioner Vella.
Year One of the “Zero Pellet Loss” Initiative in Austria
Environment Minister Andrä Rupprechter reached a Zero Pellet Loss pact with the Trade Association of the Chemical Industry of Austria (FCIO) in the spring of 2015 in order to reduce plastics in the environment. This pact contains a ten-step plan to avoid releasing of plastic granules into the environment. An average of 41 metric tons of plastics are transported along the Danube River annually, about 90% of which are documented as being attributable to wind and rain deposits and litter.
Since the beginning of the initiative, the number of participating Austrian companies has grown steadily – and the proportion of lost plastic particles has shrunk considerably. According to the FCIO’s Implementation Report, the losses of plastic have now been reduced from 4.9 kilograms per day to less than 1 kilogram per day. During this time, Austrian was producing and converting approximately 2 million metric tons of plastic.
