IN RE: STANDING FAMILY LAW
COURT ORDER FOR MANATEE,
SARASOTA AND DESOTO COUNTIES

WHEREAS, pursuant to the authority vested in Rule 2.215, Florida Rules of Judicial Administration, establishing a standing family law court order that addresses the parties' responsibilities in original actions for dissolution of marriage, separate maintenance, annulment or paternity is necessary for the efficient and proper administration of justice,
NOW, THEREFORE, IT IS ORDERED as follows:
1. A standing family law court order, attached hereto as "Exhibit A" shall be filed in original actions for dissolution of marriage (with or without children), separate maintenance, annulment or paternity. This order does not apply to Title IV child support cases. The Clerk of Court shall reject any filing that does not include a copy of the standing order in original actions described herein.
2. The Clerk of Court shall post a copy of the standing family law court order on its website so that it is readily available to the Petitioner and/or Petitioner's counsel when the case is filed.
3. It is the responsibility of the Petitioner and/or Petitioner's counsel to provide the Respondent with a copy of the standing family law court order by including it with the petition at time of service. In cases where the Clerk of Court forwards the petition to the sheriffs office for service, the Clerk shall verify that the Petitioner included a copy of the standing family law court order for service.
4. Failure to comply with the terms of the standing family law court order may result in appropriate sanctions against the offending party.
5. The prior administrative order regarding the Standing Family Law Order, Administrative Order 2013-15A-12, is hereby VACATED effective today. However, that Administrative Order remains in effect for all cases filed from its effective date
of September 20,2013, until October 15,2013.
6. This Administrative Order is effective immediately and shall remain in effect until amended by further administrative order of the Chief Judge.

DI FAMIGLIA PER LE CONTEE DI MANATEE,
SARASOTA E DESOTO

RITENUTO CHE, ai sensi dei poteri conferiti nellʼarticolo 2.215 del Florida Rules of Judicial Administration (Regolamento in materia di amministrazione giudiziaria), che stabilisce che, ai fini di unʼamministrazione corretta ed efficiente della giustizia, è necessaria unʼordinanza esecutiva in materia di diritto di famiglia che affronti le responsabilità delle parti nei procedimenti principali di scioglimento del matrimonio, inerenti i provvedimenti connessi alla separazione di fatto, annullamento di matrimonio o paternità,
SI DISPONE QUANTO SEGUE:
1. Unʼordinanza esecutiva in materia di diritto di famiglia, riportata in allegato (Allegato A) dovrà essere depositata nei procedimenti principali di scioglimento del matrimonio (anche in assenza di prole), inerenti i provvedimenti connessi alla separazione di fatto, di annullamento di matrimonio o paternità. La presente ordinanza non si applica ai procedimenti relativi al mantenimento dei figli disciplinati dal Titolo IV. Il cancelliere rifiuterà tutti i depositi a cui non sia allegata copia dellʼordinanza esecutiva nei procedimenti principali quivi descritti.
2. Il cancelliere pubblicherà una copia dellʼordinanza esecutiva in materia di diritto di famiglia sul sito Web della cancelleria, al fine di renderlo facilmente accessibile al Ricorrente e al legale dello stesso all’atto del deposito dell’istanza.
3. Il Ricorrente, ovvero il legale dello stesso sono tenuti a far pervenire al Resistente una copia dellʼordinanza esecutiva in materia di diritto di famiglia accludendo la stessa al ricorso al momento della notifica. Il Cancelliere che dovesse inoltrare il ricorso allʼufficio dello sceriffo per farne eseguire la notifica, dovrà verificare che il Ricorrente abbia allegato una copia dellʼordinanza esecutiva in materia di diritto di famiglia per la notifica.
4. La mancata osservanza delle condizioni previste dallʼordinanza esecutiva in materia di diritto di famiglia potrà comportare adeguate sanzioni nei confronti della parte responsabile dellʼinosservanza.
5. La precedente ordinanza relativa allʼordinanza esecutiva in materia di diritto di famiglia, recante numero 2013-15A-12, è REVOCATA con effetto immediato.
La suddetta ordinanza rimane tuttavia efficace per tutte le istanze depositate a partire dalla data di efficacia del medesimo, 20 settembre 2013, e fino al 15 ottobre 2013.
6. La presente ordinanza è da ritenersi efficace con effetto immediato e rimarrà tale finché non sia modificata tramite una successiva ordinanza del presidente del tribunale.
