INTRODUCTION:
We received your email instructions in relation to this loss on Thursday afternoon 9th July 2009 and having obtained further relevant contact details we arranged a site inspection at XXXX, Limerick Road, Roscrea, XXXXX at 2pm on Friday 10th July 2009.
Our enquiries regarding the circumstances surrounding this claim were made more difficult as the assistant manager of XXXX, a Mr XXXXX , was not familiar why this consignment of meat was refused at their original destination resulting in their being forwarded for temporary storage at the XXXXX facility in Roscrea, XXXXXX .
We have however endeavoured to obtain details surrounding the circumstances of the incident and our current advices are as set out within our previous email dated 15th July 2009 and as follows.
DESCRIPTION OF INSURED AND CONSIGNMENT:
We require further particulars as regards your Insured in order for us to be able to comment in relation to their involvement in this matter. Please confirm that we are acting for the Haulage Contractors' Insurers. The product being transported, is a meat product, known as pork skirtings. A consignment of 20 pallets in total was transported from Spain via France, into England and onto Dublin for further transport to XXXXX Kildare, Republic of Ireland.
The total combined weight of the 20 pallets was 21.951 tonnes less the pallet weight of .46 tonne leaving a net meat product weight of 21.491 tonne.
CIRCUMSTANCES OF LOSS:
The consignment originally left its destination in Spain as per the packing list on the 3rd July 2009. The product was subsequently transported through France and onto temporary storage in Oxford in England. We are aware from our enquiries that a Mr XXXXXX , believed to be a driver, picked up the delivery in Oxford and drove the consignment to Birkenhead outside Liverpool for transport by ferry to Dublin. The contractor undertaking the final transport section was a Mr XXXXX from Wexford, Ireland.
The consignment was shipped through Dublin with the lorry driver subsequently arriving at it's advised destination in XXXXXX Kildare at approximately 6am on the 8th July 2009. The entire consignment was rejected following inspection on the basis that the external wrapping on a number of the pallets had been breached due to likely friction of the material during transport. Some of the internal wrapping on the individual blocks had also been breached and in this regard some of the meat product was visibly uncovered.
We understand that following its rejection, the consignment was subsequently transported from XXXX Kildare by lorry to the coldstorage centre in Roscrea, XXXXXX . This is where we carried out our visual inspection of the consignment.
By the time of our inspection it was apparent that sections of the pallets on which the meat products were stored were visibly uncovered. It however should be noted that only 8 of the 20 pallets within the -28 degree celsius coldstorage facility could be inspected at ground level during our meeting on Friday 10th July 2009.
The remaining 12 pallets were stored close to roof level of the warehouse on racked shelving units. A Marine Adjuster from XXXXX Ireland, LLoyds Agents, had inspected all 20 pallets individually on Thursday the 9th July 2009 and have a full inventory of damaged stock items along with photographs of all individual pallets. We have requested sight of this listing to facilitate with our on -going investigations.
NATURE AND EXTENT OF DAMAGE:
As outlined above,the full extent of the damage sustained to the consignment it is not yet apparent. Initial indications from the Marine Adjuster who was able to fully inspect the consignment are that approximately 16 of the 20 pallets had been affected with the external and internal wrappings having been damaged due to friction and movement sustained during the transportation process. All 20 pallets were rejected at their destination point.
Within each individual pallet are approximately 50 individually wrapped blocks of the pork skirting products. We understand that there is a range in terms of quantity of blocks, which actually sustained damages with on some pallets only 2 or 3 blocks having being damaged whilst up to 15 or 16 individual blocks had sustained damages on one of the most damaged pallets. It is not yet known what salvage value exists in the undamaged products, in particular those pallets on which certain individual blocks may have been damaged but which themselves had been mostly or predominantly undamaged. Our enquiries in relation to the salvage aspect are also continuing.
CONDITIONS OF CARRIAGE:
We believe CMR Conditions applied to this transit.
RESERVE FOR INSURERS:
We would wish to advise that no indication in relation to valuation on the product have been provided to date. However, placing a wholesale value of €1 per kg then an overall consignment valuation of €20,000.00 approximately has been estimated. Again, this is "best guess" and valuation need to be confirmed.
In factoring in addition exposure in relation to transportation and storage costs, we are recommending for an overall reserve of €10,000.00 to be held at this time.
It is our view that the damage is relatively minor and that the consignment holds significant salvage value. The product should either be returned to the Consignor or repackaged for sale in Ireland. At present storage costs are accumulating, although this has not been determined to date.
RECOVERY:
As we are uncertain of your Principals' interest in this matter for the Haulier or Consignor, we seek clarification and your requirements regarding the Recovery Aspect.
REMARKS:
Our general enquiries are on-going at present and in the interim we would request a detailed account of the particulars of your Insured and the Insurance policy in place.
Please provide details of the policy number, the claim reference number, the policy and insurance type, the policy inception date, the policy excess and the general particulars of your Insured.

Recibimos sus instrucciones por correo-e el jueves 9 de julio de 2009 por la tarde, y una vez que obtuvimos detalles adicionales de las personas y lugar de contacto, concertamos una inspección en el almacén frigorífico XXXX (Coldstore), en Limerick Road, Roscrea, XXXXXX para el viernes 10 de julio de 2009 a las 2 p.m.

DESCRIPCIÓN DEL ASEGURADO Y DE LA MERCANCÍA:
Necesitaríamos conocer más detalles acerca del Asegurado para poder analizar su participación en el siniestro. Le agradeceríamos nos confirme que actuamos en nombre de los Aseguradores del Contratista del Transporte.
La mercancía en cuestión era un producto cárnico conocido como “falda” (“skirtings”). Un total de 20 pallets se transportó, vía Francia, desde España a Inglaterra y de allí a Dublín, con destino a Nass XXXXXXX, República de Irlanda.
El peso total del conjunto de los 20 pallets era 21,951 toneladas, menos el peso del pallet, de 0,46 ton., lo que deja un peso neto de producto cárnico de 21,491 toneladas.
CIRCUNSTANCIAS DEL SINIESTRO:
La mercancía salió de España el 3 de julio de 2009, según la “packing list”, y fue transportada a través de Francia hasta un almacén temporal en Oxford, Inglaterra.
Hemos sabido, por nuestras indagaciones, que un Sr. XXXXXX , se cree que conductor, recogió la mercancía en Oxford y continuó hasta Birkenhead, en las afueras de Liverpool, para trasladarse a Dublin en ferry.
El Contratista que se hizo cargo de la última etapa del transporte fue un Sr. XXXXXXX , de Wexford, Irlanda.
La mercancía fue embarcada hasta Dublin y el conductor del camión arribó a su destino pautado en XXXXXXX , Co Kildare aproximadamente a las 6 a.m. del 8 de julio de 2009.
El envío fue rechazado en su totalidad luego de su inspección, sobre la base de que la envoltura externa de un número de pallets estaba rasgada, posiblemente debido a roces del material durante el transporte. Igualmente, parte de la envoltura interna de las cajas individuales estaba rota, de manera que podía verse algo del producto descubierto.
Entendemos que, después de ser rechazada, la mercancía fue trasladada en camión desde Naas, XXXX al centro de almacenamiento refrigerado de Roscrea, XXXXXX. Allí fue donde llevamos a cabo la inspección ocular de la mercancía.
En el momento de nuestra inspección pudimos ver claramente que algunas secciones de los pallets donde se encontraba la carne estaban descubiertas. No obstante, hacemos notar que el 10 de julio de 2009 durante nuestra reunión, sólo pudimos inspeccionar 8 de los 20 pallets almacenados a -28ºC en la cámara del almacén, que estaban situados en el nivel más bajo, ya que los otros 12 pallets se encontraban situados cerca del nivel del techo del almacén, en estanterías.
Un perito de XXXXXXXXXX Irlanda, Agente de LLoyds, había inspeccionado los 20 pallets por su cuenta el jueves 9 de julio de 2009, y tiene un inventario completo de las partidas dañadas, así como fotografías de cada pallet. Hemos solicitado acceso a esa lista para facilitar nuestro trabajo pericial.
NATURALEZA Y ALCANCE DE LOS DAÑOS:
Como hemos esbozado, el alcance total de los daños en este siniestro aún no está claro. Los primeros indicios del perito que pudo inspeccionar todas las partidas son que unos 16 pallets, de los 20, habían resultado afectados por los daños en las envolturas tanto externas como internas, resultado de fricciones o movimientos sufridos durante el transporte. Los 20 pallets fueron rechazados en destino.
En cada pallet había aproximadamente 50 cajas de los productos de cerdo “skirting” envueltas individualmente. La cantidad de cajas que resultó dañada es variable. En algunos pallets sólo 2 o 3 cajas estaban dañadas mientras que hasta 15 o 16 cajas habían sufrido daños en uno de los palets en peor estado.
No se conoce aún el valor de salvamento de los productos sin daños, en particular de aquéllos pallets en los que algunas cajas hayan podido resultar dañadas, pero que en su mayoría no tenían daños.
Seguimos investigando este extremo.
CONDICIONES DE TRANSPORTE:
Creemos que las condiciones del CMR son aplicables a este transporte.
RESERVA:
Hasta el momento no tenemos indicaciones acerca de la valoración del producto. No obstante, si consideramos un valor al mayor de 1€ por kg, se ha calculado la valoración de la totalidad de la mercancía en aproximadamente 20.000 €, pero, insistimos, se trata de nuestra estimación, y debe confirmarse la valoración.
Teniendo en cuenta el transporte y los gastos de almacenamiento, recomendamos una Reserva total de 10.000 €. En nuestra opinión, los daños son relativamente menores, y la mercancía tiene un valor de salvamento significativo.
El producto debería devolverse al Remitente o reempaquetarse para su venta en Irlanda. Los gastos de almacenamiento se están acumulando, aunque no se han establecido hasta ahora.
RECOBRO:
Debido a que no conocemos los intereses de su Cliente, si como Transportista o Consignador, necesitaríamos sus aclaraciones e instrucciones en cuanto al aspecto del Recobro.
Continuamos con nuestro trabajo pericial y entretanto les solicitamos detalles del Asegurado y de la póliza correspondiente, número de la póliza, referencia del siniestro, tipo de póliza y cobertura, período de vigencia de la póliza, franquicia, y datos particulares del Asegurado.

NARRATIVE:
On December 29, 2011 we learned that damages had occurred to shipment during some point in transit. Specifically were informed damages occurred at Port of Santander Spain by stevedores while in stow on vessel at which point it was moved to final stowage in the cellar area of M/V “COURAGE”. We have no knowledge why the Rail Carshell was not returned to manufacturer at this point for inspection and possible repairs? Nonetheless we were instructed to carrier out survey inspection of damaged Rail Carshell on arrival at XXXX , Inc. in Milwaukee Wisconsin a few later after email of 12/29 as shipment was being shipped on ocean vessel and would take time to arrive. We kept in communications with Mr. XXXXXXX at XXXX and on shipment arriving we made arrangements to meet with XXXX and inspect same.
When we arrived at XXXX we were greeted by both Gentlemen. We went back into the dry/covered warehouse location where damaged Rail Carshell and several dozens of other passenger and commuter rail cars were housed. Apparently each individual rail car is custom built to customers needs and they are sold to State Governments, private companies and Transportation Groups. This particular Rail Carshell, Cab-Car. 05 specifically, was reportedly being built for an Oregon State Rail Company. The “shell” of the rail car was built overseas and on arrival in Milwaukee the cars are then equipped with electronics, lights, seats and everything that goes into completing a rail car that passengers will ultimately use on a daily basis in the state of Oregon. This was the front or lead car where engineer would be steering the machine.
Rail Carshell C-2240/5060810A-005 was a brand new “shell” that was with horizontal stripes with green color on top, white in the middle and red on bottom. The very top front area of the unit had an area that was heavily scored, ripped open and inners exposed. The damages were consistent of the unit being involved in an accident caused by rough handling and possibly striking a very heavily solid object. The damages were across the entire width of the top panel and imbedded scratches appeared that the unit had been dragged against an object; again. Repairs and new paint would not be an option and a new panel would have to be made, damaged panel removed which included the front windshield and lights. The new door reportedly was being made in Germany. Discussions with XXXX rendered this panel would be disposed of and new panel was already ordered and being made.
Digital photos were taken during our survey and will be provided with this report as well as estimate costs provided by XXXX during the attendance.
PACKING:
No packing for this shipment.
CAUSE OF DAMAGE:
Based on our investigation, photos provided and reports provided by RTS we are of opinion that damages occurred as result of rough and heavy handling by stevedores at Port of Santander Spain.
RECOMMENDATIONS & FUTURE ACTION:
We recommend panel is placed on the rail car and therefore can be used as intended.
ESTIMATE OF LOSS / SUGGESTED RESERVE:
Based on initial reports and observations at the time of survey, we suggest a reserve in the amount of USD$300,000.00. This cost was an estimate from XXXX for replacement panel and several other charges such as labor, customs import, paint, and miscellaneous charges. We will need supporting invoices and documentation to confirm the values as they seem rather high in our opinion and costs such as rental car, per diem, hotel, etc. are added on. We were of the impression that XXXX -Milwaukee employees could carry out these repairs and not XXXX -Europe 2 different employees were needed. Further there is a crane rental charge of $30,000 for unknown reasons as cranes are readily available at XXXX and this panel is not all that heavy in the first place.

Explicación del Asegurado de las razones de que el embarque se enviara a EE.UU. en primer lugar, cuando los daños habían ocurrido en el puerto de carga. CIRCUNSTANCIAS:
El 29 de diciembre de 2011 tuvimos conocimiento de que los daños al embarque habían ocurrido en algún momento durante el tránsito. Específicamente, se nos informó que los daños se habían ocasionado en el Puerto de Santander, España, por los estibadores, cuando los vagones, que se encontraban en el barco, se estibaron finalmente en la bodega del M/V “COURAGE”. No sabemos por qué la carcasa no fue devuelta al fabricante en ese momento para inspección y posible reparación.
No obstante, recibimos su encargo de inspeccionar el vagón cuando llegara a XXXX Inc, en Milwaukee unos días después del correo-e de 29/12, ya que el embarque llegaba en un trasatlántico, y tardaría más en llegar. Entretanto nos mantuvimos en contacto con XXXXXX, de XXXX , y a la llegada de la carcasa hicimos arreglos para realizar la inspección junto con XXXX .
Cuando llegamos a XXXX fuimos recibidos por los Sres. XXXXXX. Volvimos al almacén cubierto donde se encontraba la carcasa y varias decenas de otros vagones de pasajeros y cercanías. Al parecer cada coche se fabrica por encargo, de acuerdo con las necesidades del cliente, y se venden a Organismos Estatales, empresas privadas y Grupos de Transporte. Esta carcasa en particular, el vagón 05, se había construido en el extranjero. A su llegada a Milwaukee los vagones se equipan con los sistemas electrónicos, luces, asientos, y demás elementos que completan un vagón de tren, que en última instancia van a utilizar cotidianamente pasajeros del Estado de Oregón. Esta carcasa correspondía a la parte delantera, vagón de cabecera, donde un ingeniero conduciría el convoy.
La carcasa C-2240/50608 10ª-005 era de nueva factura, con franjas horizontales verdes en la parte superior, blancas en el medio y rojas en la parte inferior. La parte frontal superior de la unidad presentaba una zona muy rayada, arrancada, por donde podía verse el interior del vagón. En nuestra opinión, los daños observados pueden corresponder a un accidente causado por un manejo brusco, posiblemente un choque contra un objeto sólido pesado ocurrido mientras el vagón era transportado, Los daños se localizaban a lo ancho del panel superior, y por los raspones profundos parece que la unidad haya sido arrastrada contra un objeto de nuevo.
Según XXXX , una reparación y repintado estaba fuera de cuestión, y tendría que fabricarse un nuevo panel, y desmontar el panel dañado, incluyendo el parabrisas frontal y las luces. En conversaciones con XXXX supimos que se desharían del panel dañado y que el nuevo panel ya se había encargado y se estaba fabricando.
Se hicieron fotos digitales durante nuestra inspección, que se les envían junto con este informe, así como el coste aproximado facilitado por XXXX durante la visita.

CAUSA DE LOS DAÑOS
Basándonos en nuestra investigación, las fotos facilitadas, e informes facilitados por RTS, creemos que los daños son resultado de un manejo brusco por parte de los estibadores en el Puerto de Santander, España.
RECOMENDACIONES & MEDIDAS FUTURAS
Recomendamos la sustitución del panel dañado del vagón por uno nuevo, para poder darle a éste el uso correspondiente.
ESTIMACIÓN DE LOS DAÑOS / RESERVA RECOMENDADA
Basándonos en los primeros informes y en nuestras observaciones en el momento de la inspección, sugerimos establecer como Reserva la cantidad de 300.000,00 $USA, que sería la estimación de XXXX por la sustitución del panel y otros cargos varios, como mano de obra, tasas de aduana, pintura y otros gastos. Necesitaremos facturas y documentación justificativas para confirmar los valores, ya que nos parecen bastante altos y se añaden gastos como alquiler de vehículo, comidas, hotel, etc. Tuvimos la impresión de que las reparaciones podían realizarlas empleados de XXXX Milwaukee y que no serían necesarios otros dos empleados de XXXX Europe. Además, hay un cargo por alquiler de grúa de 30.000 $USA por razones que desconocemos, ya que en XXXX hay siempre grúas disponibles y este panel en particular no es una pieza tan pesada.

Since 1975, on my
return from England, until 2012, I have been using English in all the companies
where I have worked, both translating and proofreading English and Spanish. In
1986 I obtained a Diploma of Written Translation in English and Spanish. From
2012 till present I have been working at home, as a freelance translator and
proofreader.
Apart from more than
30 years’ experience in general translation, I have experience in the fields of
Law (translation and proofreading of Patents and Trademarks, and Unfair
Competition contracts) (5 years), Insurance and Adjustment Reports in both
languages for International Transport Losses, both by sea and surface, theft,
water damages, fidelity (10 years). I have also proofread several books,
literature, novel and poetry, manuals, and many TFG (End of Studies’ theses)
for university students.
