Source text - Russian 07 февраля 2014г. в Арбитражный суд Свердловской области от заявителя поступило сопроводительное письмо во исполнение определения суда от 20 января 2014г.
Обстоятельства, послужившие оставлению требования без движения, устранены в срок установленный судом.
В соответствии с частью первой статьи 51 Арбитражного процессуального кодекса Российской Федерации третьи лица, не заявляющие самостоятельных требований относительно предмета спора, могут вступить в дело на стороне истца или ответчика до принятия судебного акта, которым заканчивается рассмотрение дела в первой инстанции арбитражного суда, если этот судебный акт может повлиять на их права или обязанности по отношению к одной из сторон;; они могут быть привлечены к участию в деле также по ходатайству стороны или по инициативе суда.
С учетом того, что требования заявителей основаны на договоре уступки прав требования No10-12/13 от 10.12.2013 с ЗАО «REDACTED», наименование которого согласно данным ЕРЮЛа 20.01.2014 изменено на ЗАО «REDACTED», то указанное лицо - ЗАО «REDACTED», как первоначальные кредитор привлекается судом к участию в рассмотрении требования заявителя в качестве третьего лица, не заявляющего самостоятельных требований на предмет спора.
В соответствии с п. 4 ст. 71 Федерального закона «О несостоятельности (банкротстве)» в этом случае требование кредитора о включении в реестр подлежит рассмотрению в судебном заседании.
Translation - English On 07 February 2014 in the Sverdlovsk Region Arbitration Court a covering letter was filed from the applicant pursuant to the court ruling of 20 January 2014.
The circumstances that resulted in the claim being left without action were remedied in the period determined by the court.
Pursuant to Part One of Article 51 of the Arbitration Procedure Code of the Russian Federation, third parties who do not file independent claims in respect of the subject in dispute may enter the case on the side of the claimant or respondent prior to the adoption of a judicial act which terminates the consideration of the case by an arbitration court of the first instance, where this judicial act may influence rights and duties thereof in respect of one of the parties. They may be likewise be joined to a case on the petition of the parties or on the initiative of the Court.
Given that the applicant’s claim is based on an agreement on the cessation of legal claims No. 10-12/13 of 10.12.2013 with CJSC “REDACTED”, whose name according to data from the National Register of Legal Entities was amended on 20.01.2014 to CJSC “REDACTED”, then such entity, CJSC REDACTED, as the original creditor, is brought by the court to participate in the consideration of the applicant’s claims as a third party who does not file independent claims in respect of the subject in dispute.
In accordance with Paragraph 4, Article 71 of the Federal Law “On Insolvency (Bankruptcy)”, in this case the creditor’s claim regarding inclusion in the register is subject to review in a court hearing.

Source text - Russian 5.8. Содержание счетов-фактур и товарных накладных, оформленных Поставщиком по форме ТОРГ -12, должно соответствовать Спецификации к Договору.
5.9. Погашение авансового платежа производится путем его удержания из сумм, подлежащих выплате Поставщику за поставленное Оборудование, выполненные работы пропорционально стоимости Оборудования, выполненных работ до полного погашения аванса.
5.10. Стороны ежеквартально производят сверку расчетов по настоящему Договору.
Поставщик не позднее 10 (Десятого) числа месяца, следующего за последним месяцем квартала, направляет Покупателю акт сверки расчетов в двух экземплярах. Покупатель не позднее 10 (Десяти) календарных дней со дня получения акта сверки расчетов, при отсутствии возражений, подписывает его, и второй экземпляр возвращает Поставщику.
5.11. Цена Договора является твердой и не подлежит каким-либо изменениям, за исключением случая, изменения Объёма поставки и технических требований к Оборудованию, влияющих на компоновку и состав поставляемого Оборудования.
5.12. Все изменения в Договоре, связанные с Объёмом поставки, техническими требованиями и сроков оформляются дополнительными соглашениями к настоящему Договору.
6. IIPАВА И ОБЯЗАННОСТИ СТОРОН
Поставщик обязав:
6.1. Поставить Оборудование, выполнить работы согласно Техническим требованиям (Приложение #2) в соответствии со Спецификацией (Приложение #1) и в сроки, предусмотренные Календарным: планом (Приложение #3).
6.2. Официально передать Покупателю информацию о начале производства Оборудования в течение 5 (Пяти) календарных дней после получения уведомления Производителя.
6.3. В согласованные в Приложении #3 сроки, представлять представить необходимую для проектирования исходную информацию по Оборудованию, а именно:

5.9 Repayment of the advance payment shall be made by deduction from the amounts payable to the Supplier for the delivery of the Equipment, work performed in proportion to the value of the Equipment, work performed until the full repayment of the advance.
5.10 The Parties shall produce a quarterly reconciliation of accounts under this Agreement. The Supplier shall no later than the 10th (tenth) day of the month following the last month of the quarter send the Buyer a reconciliation report in duplicate. The Buyer shall no later than 10 (ten) calendar days after the receipt of the reconciliation report, in the absence of objections, sign it and return one copy to the Supplier.
5.11 The price of the Agreement is fixed and shall not be subject to any amendments except in case of amendments to the Scope of the supply and technical requirements for the Equipment, which affect the layout and composition of the supplied Equipment.
5.12 All amendments to the Agreement relating to the Scope of delivery, technical requirements and deadlines will be made as an additional arrangement to this Agreement.
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
The Supplier undertakes:
6.1 To supply the Equipment, perform the work in accordance with the Technical Requirements (Appendix 2) according to the Specifications (Appendix 1) and to the deadlines set out in the Timetable (Appendix 3).
6.2 To officially transfer to the Buyer information regarding the commencement of the manufacture of the Equipment within 5 (five) calendar days following receipt of notice from the Manufacturer.
6.3 In accordance with the terms of Appendix 3, to provide the necessary background information for the design of the Equipment, namely:
