The past decade was the decade of utilizing the rules of international law by courts in Israel. One of the dramatic developments we’ve witnessed in recent years in the arena of international law has been an increase in the blurring of boundaries between international law and national court systems: international law’s scope of activity has expanded gradually (e.g. the development of guidelines to regulate activity within respective countries, such as human rights laws and environmental protection laws), and a growing number of state courts apply international law guidelines to sensitive political issues once considered outside the bounds of state courts and international courts.
For example, recently British courts relied on international treaties in accepting compensation claims in the case of an Iraqi prisoner who was tortured to death by British soldiers in Iraq; Spanish courts relied on international norms when they had military figures from Argentina and Guatemala face criminal charges for committing crimes against humanity; and in 2006 the US Supreme Court rejected the military court system set up by President Bush to hold Guantanamo Bay prisoners on trial as a violation of the Geneva Convention.
These processes have not bypassed Israel. In fact, Israel is among the world leaders in the number of references to international law appearing in the rulings of its Supreme Court and in the “quality” of the references, i.e. the sensitivity of the issues in which international law was used and the central role international law played in rendering those decisions. For instance, based on international law, the Supreme Court decided on cases that dealt with the route of the security barrier, the policy of targeted killings and arrests without trial of Hizbullah operatives in Israel (in part to serve as bargaining chips to bring back captives).
Furthermore, the use of international law has not been limited to cases related to the Israeli-Palestinian conflict. The Supreme Court also relied on international law in considering questions related to extradition procedures, violence against children, integrating special-needs children into the mainstream educational system and trafficking in humans. It should be noted that the manner in which international law has been used in Israel during the past decade differs from the way it was used in previous decades. In the past, the Supreme Court made use of international law primarily as a “comparative law,” i.e. a set of non-binding rules that had a relatively minor impact on judicial procedure. In contrast, during the current decade, the court has been inclined more and more to view international law within the rubric of mandatory laws that form a part of Israeli law, and today international law serves as an important tool for interpreting Israeli laws and assessing the constitutionality of military and government activities.
What explanations can be offered for the above changes and what are their ramifications? Certainly these trends can be attributed, in part, to the globalization process and the strengthening of international enforcement mechanisms. These developments enhance the visibility of international law, “raise the price” of violating the guidelines and encourage local courts to take them into account. Furthermore, the possibility of using legal procedures against Israel and against senior Israeli officials in foreign or international courts (which occurred in respect to the separation barrier, and in attempts to apply criminal proceedings in European courts to Ariel Sharon, Doron Almog and senior officials involved in the assassination of Salah Shehadeh, head of Hamas’ military wing) gave Israeli courts an incentive and legitimacy to apply international law: the threat of external legal interference prompted the Israeli court to take action to reduce normative gaps between Israeli law and international law, and thereby to reduce the likelihood of foreign legal proceedings.
In other words, by applying international law, Israeli courts obviate the need for foreign courts to interfere with Israeli affairs. Moreover, applying international law also enables courts in Israel to influence how the contents of international law take shape and to try to adjust its guidelines, as much as possible, to fit the needs of the State of Israel and the challenges it faces. Indeed, a number of the Israeli Supreme Court’s decisions in the past decade were considered important international precedents (although some other Supreme Court decisions were considered controversial outside of Israel).
Still, strengthening the status of international law raises thorny questions regarding their legitimacy. The Knesset’s limited involvement in creating commitments to international laws (which is part of the Knesset’s modest task of forging pacts) means applying international law by the court is done without public debate and without substantial political support – which has at times been called “undemocratic.” However, it appears that in the coming decade there will be no alternative other than to reassess the rules regulating how pacts are made by the State of Israel, as proposed in the constitutional proposals currently before the Constitutional, Law and Justice Committee. This would achieve a better match between the growing status of international law in Israeli courts and the democratic mechanisms for overseeing the process.

Excerpt from Al Hachaim Ve'al Hamavet ("Between Life and Death"), a novel by celebrated Israeli writer Yoram Kaniuk.
Translation - English After these things had happened – after the sickness and after the death and after the pain and after the laughter and after the betrayal and after the old age and after the kindness and love and after the son of a fool who caused his mother such grief and after the woman of valor conjured up for me in the good within the abyss – after all these things I woke up from the waking sleep I’d been in for four months. Things were bad and good and sad and hopeless and there was a miracle and what happened happened and what didn’t happen but could have happened didn’t happen, and I remembered. It was night. A night shrouded in its own darkness. It brought bad dreams and I woke up dazed with sleep, I was healthy, in my apartment at Rechov Bilu 13, and suddenly I remembered that at night I’d dreamed about screwdrivers. I had no need for a screwdriver so I looked for and couldn’t find one, but in the spot where the screwdriver could have been had it been instead I found an old map of Tel Aviv, and since I was already holding the map I put it down and went out to drink some coffee and eat a croissant, which here they call a corassan, and I went back home to the map and thought I’d look for the street I live on. I laid the map out on the table and wandered with my finger until it came to a soft landing, but not on Rechov Bilu where I live and not on the corner near the intersection of Balfour and Sderot Rothschild where I spent the first three years of my life, but on Arlozoroff and Eduard Bernstein, near the place where I really did grow up. Of course I had no choice other than to drive to the corner of Arlozoroff and Bernstein which, except for the years I spent walking through the sand, I had passed by for eight years, ten months a year, almost every morning, while walking back and forth from my parents’ home to the “model” school I attended – a distance that would have allowed me, had I so chosen, to reach the moon.
On the street corner, which was already unsightly back then, stood the wretched home of Ajo, who was younger but two years more mature than me and was taciturn and rebuked and lonely and filled with hatred. I think he had been held back in third grade twice, or maybe that was somebody else, and he had blazing brown eyes and he got killed in the war in the battle for Nabi Samuel shortly after running into me in the dining hall of Kiryat Anavim, where he recognized me before I reminded him where we knew one another from. We would dig the pits for the dead before the battles, so all that was left to do was to return after the battle and bury the dead, and since I was the only one who knew Ajo, I was asked to write his name in ornate handwriting, but I knew only his nickname Ajo, I don’t even know if he had a name when he was born, and to tell the truth I can’t even say whether he was born, I remember him as someone who has always been here, maybe because of the proximity to the Muslim garden of death that crept toward his home on the corner of Arlozoroff.
Ajo’s father had a bicycle repair shop on the corner of Jabotinsky, which was called Ingathering of the Exiles back then. The exiles had not yet been gathered in, but Jabotinsky had already been forgiven and the street was named after him, and that’s how the name was changed. His dog Topsie would run toward Rechov Shivtei Yisrael (“The Tribes of Israel”) from the other side of Sderot Keren Kayemet to meet up with Von Sternberg the composer, who he loathed. Even for his day-to-day attire the composer would wear a German marching uniform and wave a bamboo stick and had a scary look with big bulging eyes, and he was married to Genia, a pretty woman who was my first love and who raised his son and became a nun in Lebanon. Sternberg the putz wrote a composition that three people in the city could listen to without becoming suicidal and called it “The Twelve Tribes of Israel,” named after his street, and my father Moshe said he was lucky he didn’t live on Rechov Me’ah She’arim (“One Hundred Gates”).
I would play with Topsie the dog on my way to school and Ajo would get angry at his dog, who wagged his tail at me, and he was jealous and would yell at Topsie, but Topsie liked me and sensed that I liked him and he would wait for me every morning with his tail wagging until one day Ajo got annoyed and jealous and sicced Topsie on me and shouted at him to bite me. Topsie, who liked me but belonged to Ajo, panicked and tried to bite him but then got frightened and his tail stood up straight and his eyes raged and he let out a terrible howl and started toward me, and Ajo shouted again, and Topsie no longer knew who he had a greater duty toward and he bit me because he had no choice. Poor Topsie was taken for an examination at the animal health department and I had to get 20 shots in my belly. I would walk with my mother Sarah to the Strauss Health Clinic on Rechov Balfour and every week they would give me shots with an enormous needle and after my dose of suffering we’d leave, go down to Allenby, and my mother Sarah would buy me an ice cream at Shneer, calling it a “small consolation” for what I’d endured.

לקראת אמצע שנת 1985 ניצב המשק הישראלי על עברי פי פחת. היפר-אינפלציה מסחררת, שהגיעה באפריל של אותה שנה לשיעור שיא של 737 אחוזים (במונחים שנתיים), לצד מאזן תשלומים שלילי, איימו להמיט אסון על הכלכלה הלאומית. המשבר החריף לא הותיר בפני קברניטי המדינה כל ברירה; כל מי שעיניו בראשו הבין כי אין מנוס מנקיטת צעדי חירום. בסופו של דבר, רק ממשלת אחדות לאומית, עם ראש ממשלה ממפלגת העבודה (שמעון פרס) ושר אוצר מן הליכוד (יצחק מודעי), יכולה הייתה לגייס את הנחישות הפוליטית הנדרשת להנהגת התכנית לייצוב המשק, שבביצועה הוחל בקיץ של אותה שנה. אולם את עיקר הקרדיט על ההבנה הנכונה של התהליך האינפלציוני וסיבותיו, שעמדה ביסוד שינוי המדיניות הדרמטי, יש לזקוף לזכות מחלקת המחקר של בנק ישראל.
אף שמטרתה המיידית של התכנית לייצוב המשק הייתה בלימת עליית המחירים המסחררת, היא שיקפה את ההכרה המתגברת בקרב קובעי המדיניות כי השיטה הכלכלית דמוית הסוציאליזם שהונהגה בישראל פשטה את הרגל. שיטה זו הפקידה בידי הממשלה כוח כלכלי עצום והעניקה לה בעלות על תעשיות המחצבים, האנרגיה, התקשורת והייצור הביטחוני, ושליטה מלאה או חלקית בשוקי ההון, מטבע החוץ והאשראי. בעקבות זאת, בשלושים ושבע השנים הראשונות לקיומה של המדינה עוצבה המדיניות המוניטרית של ישראל כתוצר לוואי של פעילות ממשלתית בתחומים אחרים. שער החליפין שימש מכשיר לתמיכה בייצוא, ועל שער ריבית במובן המקובל אפשר היה רק לחלום; הממשלה הנהיגה מגוון שערי ריבית כדי להשיג מטרות בתחום המדיניות התעשייתית, ואילצה את בנק ישראל להדפיס כסף כדי לממן את גירעונותיה.
הרפורמה של 1985 שינתה את כללי המשחק. היא פירקה את המערכת הנרחבת והמסובכת של הכלכלה הריכוזית והוציאה את הממשלה משוקי ההון, האשראי ומטבע החוץ; היא הפחיתה את משקלו של תקציב הממשלה בתוצר, הן מצד המסים והן מצד ההוצאות; היא הפריטה נכסים רבים שהיו בבעלות המדינה; והנהיגה מדיניות מוניטרית שלצורך ניהולה הוענקה לבנק ישראל עצמאות בשלבים – עד אוטונומיה בפועל, שממנה הוא נהנה כיום.
התמורות העמוקות שעברו במהלך רבע המאה האחרון על כלכלת ישראל, ובעיקר על התנהלותה המוניטרית, הן נושאו של הספר בנק ישראל: כלכלה פוליטית בעידן ניאו-ליברלי, שראה אור ב-2009. המחברים, דניאל ממן מאוניברסיטת בן-גוריון וזאב רוזנהק מן האוניברסיטה הפתוחה, מציבים במוקד מחקרם את הבנק המרכזי של מדינת ישראל – הסוכן הראשי, לטענתם, של "פרדיגמת המדיניות הניאו-ליברלית", המושלת כיום במשק – ומבקשים לעקוב אחר התהליכים שהביאו להתמקמותו "בעמדת מפתח בשדה הפוליטי-כלכלי ובמנגנון המדינה". זוהי סוגיה חשובה, ללא ספק, כזו הראויה לדיון נוקב ורציני, אלא שהטיפול הבעייתי – שלא לומר המרושל –שהם מעניקים לה גורם עוול לנושא, כמו גם לקורא הסקרן.

ממן ורוזנהק פותחים את ספרם בציטוט טענתו של יעקב פרנקל, שכיהן כנגיד בנק ישראל בשנים 1991–2000, כי ההיסטוריה המודרנית של הכלכלה הישראלית מתחילה בשנת 1985. ואמנם, המחברים גורסים כי "התכנית לייצוב כלכלי שהופעלה באותה שנה… מסמנת את פתיחתו של תהליך הדרגתי, אך עמוק ומקיף ביותר, של שינוי הכלכלה הפוליטית בישראל, בייחוד במה שנוגע לאופנים שבהם המדינה מעורבת בזירה הכלכלית".
לטענת ממן ורוזנהק, התוצאה המשמעותית ביותר של יישום תכנית הייצוב ב-1985 הייתה החלפתו בפועל של "מודל המדינה המפתחת", שעליו הושתתה כלכלת ישראל בעשורים הראשונים, בפרדיגמה הניאו-ליברלית. המודל המקורי ייעד למדינה מעורבות נמרצת בהכוונת המערכת הכלכלית באמצעות פיקוח והקצאת משאבים, במטרה להניע צמיחה ולספק תעסוקה מלאה לאוכלוסייה. לצורך זה השתמשה הממשלה בבנק המרכזי ככלי לשליטה בשוק ההון ולמימון גירעונותיה התקציביים. הסדר הניאו-ליברלי, לעומת זאת, מבקש לצמצם למינימום את הבקרה ואת הוויסות "מלמעלה", ובמסגרתו, מסבירים המחברים, "תפקידה הנאות של המדינה בפרט ושל הפוליטיקה בכלל בתחום הכלכלה הוא רק ליצור את תנאי היסוד המאפשרים את פעילותם היעילה של השווקים ושל השחקנים שבתוכם".
דעה רווחת גורסת שעליית קרנה של הפרדיגמה הניאו-ליברלית במהלך שלושים השנים האחרונות היא תולדה של גלובליזציה אגרסיבית, שאילצה מדינות רבות לאמץ את הדגם של "השוק החופשי"; אותן מדינות הניחו שאם לא יעשו כן – ישתרכו מאחור, ואולי אף ייענשו בידי המוסדות הפיננסיים של הקהילה הבינלאומית. אולם ממן ורוזנהק סבורים כי גם אם יש אמת מסוימת בדעה זו, אין היא משקפת במדויק את המציאות, משום שהיא יוצרת את הרושם שמדובר בתהליך בלתי נמנע, כמעט אוטומטי. לדידם, המעבר לכלכלת שוק מונע במידה רבה בידי גורמים בזירה המקומית. בלשונם, "המהפכה הניאו-ליברלית אינה תולדה של תהליכים דטרמיניסטיים… אלא פרי הפעולות של שחקנים פוליטיים… בהתאם לאינטרסים מוסדיים, מעמדיים ואחרים".
תפקיד כזה בדיוק, קובעים מחברי הספר, מילא בנק ישראל. לדבריהם, בנקים מרכזיים נוטים להאמין שהשוק החופשי הוא המנגנון הטוב ביותר להקצאת משאבים ושוללים את מעורבות המדינה בכלכלה. בנק ישראל איננו יוצא מן הכלל. ממן ורוזנהק מתארים אותו כגוף המוסדי העיקרי הניצב בחזית ההתנגדות לפרדיגמת המדינה המפתחת; נאמן לגישה הניאו-ליברלית, הבנק סבור כי יציבות פיננסית היא מטרת-העל של המדיניות הכלכלית ורואה באינפלציה איום מרכזי, חמור יותר מאבטלה.
ממן ורוזנהק מתחקים אחר התנתקותו ההדרגתית של בנק ישראל מן הכבלים שהשית עליו משרד האוצר ואחר התבססותו ככוח אוטונומי ורב-השפעה במשק הישראלי. התעצמותו הדרמטית של בנק ישראל התאפשרה, לטענתם, הודות למיקומו המוסדי ב"תפר שבין השדה המקומי לשדה הגלובלי". הבנק גייס בהצלחה את האקדמיה ואת המוסדות הכלכליים הבינלאומיים (בעיקר את קרן המטבע הבינלאומית) כדי ליצור את הרושם שהחלפת מודל המדינה המפתחת בשיטה הניאו-ליברלית היא מהלך מקצועי-מדעי, כורח המציאות בעידן הגלובליזציה. בחסותו של שינוי זה, זכה הבנק לעצמאות הנכספת, שנמנעה ממנו במסגרת המבנה המוסדי של המדינה המפתחת.
מעללי בנק ישראל, כפי שהם מתוארים בין דפי הספר, כמו מעידים על אסטרטגיה של שחרור – או השתלטות – בשלבים. הרפורמה של 1985 קיבעה את שער החליפין ברמה של 1,500 שקלים (ישנים) לדולר והביאה לצמצום מרחיק לכת בגירעון בתקציב הלאומי. בשלב זה הייתה הממשלה מעורבת עדיין בקביעת שער החליפין, כך שבנק ישראל לא היה חופשי לעצב את המדיניות המוניטרית כראות עיניו. הפיחות הראשון בשער השקל לאחר הרפורמה בוצע בינואר 1987 – על דעת הממשלה. מאחר שגם לאחר תכנית הייצוב עמדה האינפלציה על שיעור ניכר של חמישה-עשר עד עשרים אחוזים לשנה, נדרשו פיחותים נוספים, שהובילו בסופו של דבר ליצירת "רצועת הניוד" סביב שער החליפין המרכזי בפברואר 1990. רצועת הניוד קבעה תחום שבתוכו יכול היה שער החליפין לנוע באופן חופשי, בדומה להסדרים שהונהגו באיחוד האירופי טרם הנהגת האירו. התערבותו של בנק ישראל בשוק מטבע החוץ נדרשה רק במקרה ששער החליפין איים להבקיע את הרצפה (תיסוף) או את התקרה (פיחות) של רצועת הניוד. הניידות החלקית של שער החליפין העניקה לבנק המרכזי חירות מסוימת בתמרון שער הריבית, שינוי שהיה בבחינת התקדמות משמעותית בדרך להשגת עצמאות מוסדית מלאה. לאורך השנים הבאות פחתה חשיבותה של רצועת הניוד עד שב-1998 הפכה ללא-רלוונטית; שער החליפין נעשה נייד לחלוטין ובנק ישראל החל לנהל את המדיניות המוניטרית באמצעות שער הריבית, בלי שלממשלה – אשר בשלב זה נסוגה כבר משוק ההון – תהא השפעה כלשהי על החלטותיו.
ניצחונה של הפרדיגמה הניאו-ליברלית על פני מודל המדינה המפתחת לא הושג בן-ליל, מטעים הספר. הוא היה תוצאה של מאבק ממושך בין בנק ישראל ובין הממשלה – או משרד האוצר. כל אחד מן הצדדים פעל בהדרכת אינטרסים פוליטיים ומוסדיים, שהוסוו לעתים קרובות כשיקולים מקצועיים גרידא. כיום ידו של בנק ישראל על העליונה, אף שהשינויים המפליגים שחלו במעמדו טרם עוגנו בחוק. ממן ורוזנהק, כך עולה מן הספר, אינם רווים נחת מן המגמה הזו, המכפיפה לכאורה את המערכת הכלכלית ל"לוגיקה של השוק". הפרויקט הניאו-ליברלי שמוביל הבנק, כך הם מאמינים, לוקה באי-יציבות מבנית ופוליטית. הם מזהירים כי "השינויים בתהליכים של חלוקה וחלוקה מחדש של המשאבים בחברה והשלכותיהם החמורות על מבנה אי-השוויון היו מהירים ועמוקים במיוחד בישראל, יותר מבכל מדינה קפיטליסטית מתקדמת אחרת – דבר אשר עשוי להחריף את חוסר הנחת בקרב אוכלוסיות רחבות למדי מהמשטר הניאו-ליברלי". כדי למנוע תרחיש קטסטרופלי של התפוררות חברתית מוחלטת הם מציעים אפוא "מהלך של חיבור מחדש בין כלכלה לפוליטיקה", ש"יפתח מחדש את המרחב הפוליטי להשתתפות של נציגי אינטרסים חברתיים רחבים ומגוונים יותר", וישיב להמונים המדוכאים את הכוח שנגזל מהם בידי "מומחים מוסמכים בעלי ידע ומיומנויות טכניות, דוגמת אנשי הבנקים המרכזיים". המחברים מדגישים כי בכך לא יקיץ הקץ על הכלכלה הקפיטליסטית בישראל; התיקון שהם מציעים רק יחשוף את היסודות הפוליטיים שהיא מבקשת לטשטש ויאפשר "לשזור" אותה מחדש בחברה – תהא אשר תהא כוונתם בכך.

ברי שממן ורוזנהק אינם אוהדים נלהבים של כלכלת השוק החופשי. למעשה, הם טורחים לכלוא את המושג "חופשי" במרכאות כאשר הוא מופיע בהקשר זה כדי להצביע על הסילוף העומד ביסודו. סדר היום האידיאולוגי שלהם ניכר לכל אורך הספר; למרבה הצער, נראה שהוא גם מניע אותם לזהות את טביעות אצבעותיה של אידיאולוגיה בכל מקום – לעתים קרובות שלא לצורך. אפשר שהסיבה לכך היא העובדה שהשניים אינם כלכלנים כי אם סוציולוגים. כך או כך, היכרות מעמיקה יותר עם הדיסציפלינה שהם מתיימרים לנתח ולבקר הייתה חוסכת מהם לא מעט טעויות.
מבחינה אחת, לפחות, הספר קולע לאמת: מאז 1985 אכן עבר בנק ישראל שינוי עמוק, שהעניק לו אוטונומיה גמורה לאחר עשורים שבהם היה עושה דברה הנרצע של הממשלה. הכפיפות למשרד האוצר, שאפיינה את דפוסי פעולתו עד אותה שנת מפנה, הייתה יוצאת דופן בהשוואה למקובל במדינות המפותחות. אף שגם הבנקים המרכזיים של צרפת ושל בריטניה, לדוגמה, לא היו עצמאיים לגמרי בשנים עברו, הם לא סרו לחלוטין למרותן של ממשלותיהם. אולם חופש הפעולה שממנו נהנה כיום בנק ישראל אינו חריג. הבנק המרכזי האירופי, המופקד על ניהול המדיניות המוניטרית של גוש האירו, פועל אף הוא כגוף עצמאי, וכזה הוא המצב גם בארצות-הברית, באוסטרליה, בניו זילנד ובמדינות נוספות.
ממן ורוזנהק מציגים את השתחררותו של בנק ישראל מתכתיבי הממשלה כמהפך "פרדיגמטי", אלא ששימושם התכוף במונח זה פגום מעיקרו. דוגמה בולטת היא התייחסותם ל"פרדיגמה הקיינסיאנית" (על שמו של הכלכלן המהולל ג'ון מיינרד קיינס), ש"שלטה בדרך כלל בשדה הפוליטי-כלכלי של מדינות המרכז עד סוף שנות השבעים", בטרם נאלצה לפנות את מקומה – למורת רוחם של המחברים – לשיטה הניאו-ליברלית. דא עקא שאי-אפשר לייחס לתיאוריה הקיינסיאנית ולמדיניות המבוססת עליה מעמד של "פרדיגמה", וספק אם אפשר לתארה כדגם של שליטה ממשלתית בשוק ההון. ראשית, קיינס לא הציע מבנה מוסדי שונה מזה שהתקיים במערב לפני משבר שנות השלושים. שנית, הוא מעולם לא התכוון לנסח מרשם למדיניות כלכלית מקיפה של התערבות ממשלתית נמרצת במשק, בוודאי לא בשוק ההון. לבסוף, וחשוב מכל – קיינס מעולם לא שלל את כלכלת השוק החופשי, לא על בסיס אידיאולוגי ולא על בסיס מעשי.
רצוי אפוא להעמיד דברים על דיוקם. את עיקר משנתו של קיינס נוכל לסכם כך: בנסיבות מסוימות ייתכנו משברים כלכליים, דוגמת זה שפקד את העולם בשנות השלושים של המאה הקודמת, שמהם אי-אפשר להיחלץ רק באמצעות התאמות כאלה ואחרות בשווקים החופשיים, ואפילו לא בעזרת מדיניות מוניטרית תקיפה. במצבים כאלה, הציע קיינס, חייבת המדינה להפעיל אמצעים פיסקליים מסיביים, דהיינו ליצור גירעון תקציבי, כדי לעודד פעילות כלכלית ולסייע למשק. המדינה יכולה להנפיק אגרות חוב ולהשתמש באשראי שיינתן לה כדי להוציא אל הפועל פרויקטים ציבוריים, כגון סלילת כבישים. הזדמנויות התעסוקה החדשות שתיווצרנה בדרך זו תזרמנה לכיסיהם של העובדים הכנסות, שבעזרתן ירכשו מוצרי צריכה. בעקבות הגברת הצריכה תתרחב גם הפעילות במגזרים המייצרים מוצרים אלה, וכך יתאושש המשק בהדרגה. המתווה הזה איננו – ומעולם לא התיימר להיות – "פרדיגמה"; מדובר בתכנית למצב חירום, המבוססת על תפיסה מסוימת של התנהגות המערכת הכלכלית.
התיאוריה הקיינסיאנית והמרשם שהציעה כבשו בשעתו כליל את העולם המקצועי והפוליטי (בין המעטים שהעזו להתייצב נגדה בלט הכלכלן מילטון פרידמן). שלושים שנה חלפו עד שהמציאות הכריחה את עולם הכלכלה לבחון מחדש את תקפות הגישה הזו. מאמציהן של הממשלות המערביות להילחם באבטלה בשנות השישים והשבעים בשיטות קיינסיאניות – שממילא עוצבו לטיפול במשברים חמורים בהרבה – לא השיגו את מטרתם, אבל גרמו, לעומת זאת, לאינפלציה.
המחברים מזכים אפוא את קיינס ב"פרדיגמה" שאותה כלל לא התיימר להציע; ולא זו בלבד, אלא שדיונם בניאו-ליברליזם מותיר את הקורא מבולבל עוד יותר. התזה של הספר נשענת במידה רבה על הקביעה שסימני היכר חשובים של מערכת ניאו-ליברלית הם קיומו של בנק מרכזי עצמאי והשקפה הרואה באינפלציה איום כלכלי ראשון במעלה, שיש להיזהר מפניו דרך קבע. לנוכח קביעה זו לא נותר לנו אלא לתהות כיצד עלינו לסווג כלכלות שונות. האם אפשר, למשל, לקשור את הפרדיגמה הניאו-ליברלית למדינות המפותחות בתקופה שקדמה למלחמת העולם הראשונה – תקופה שהתאפיינה בגלובליזציה מרחיקת לכת? ואם כן, כיצד מתיישב הדבר עם העובדה שבארצות-הברית לא התקיים אז בנק מרכזי (ה'פדרל רזרב' הוקם רק ב-1914)?
קושיות דומות אפשר להעלות באשר למשקי מערב אירופה וארצות-הברית בעשורים שקדמו לביטול הסכם ברטון-וודס בראשית שנות השבעים. כזכור, הסכם זה, שנחתם ב-1944, השתית את המערכת הפיננסית ואת הסחר הבינלאומי בין המדינות המתועשות על שערי חליפין קבועים; אולם אם ההסדר של ברטון-וודס – שקיינס היה אדריכלו – מנוגד ברוחו לניאו-ליברליזם, כפי שמציירים אותו המחברים, כיצד נוכל להסביר את עצמאותו המוחלטת של הבנק המרכזי הגרמני במהלך פרק הזמן המדובר, או את נחישותה של מערב גרמניה להילחם באינפלציה אפילו במחיר התרחבות האבטלה? ככלל, נראה שממן ורוזנהק שוגים בהבנת מהותו של ההסדר האמור. מתיאורם אפשר להסיק בטעות שהוא נועד לאפשר לשותפותיו לתפקד כמדינות מפתחות, העוסקות גם בחלוקה מחדש של ההכנסות. ברם, המניע לחתימה על הסכם ברטון-וודס היה הרצון להימנע מן המצב ששרר בתקופת השפל הגדול, כאשר מדינות שונות ניהלו מלחמת סחר נמרצת זו בזו ונאלצו לבצע שוב ושוב פיחות בערך המטבע המקומי כדי לעודד ייצוא ולרסן את הייבוא. המאבק הזה לא נשא פרי ורק העמיק את המשבר. קיבוע שערי החליפין נועד למנוע התפתחויות מעין אלה – לא ליצור סדר חדש שבו המדינה מחויבת "לנקוט פרקטיקות של מעורבות אינטנסיבית כדי לעצב ולכוון את הפעילות הכלכלית", כטענת המחברים.
ממן ורוזנהק טועים ומטעים גם כאשר הם כורכים את הפרדיגמה הניאו-ליברלית עם תפיסה הרואה באינפלציה "איום יסודי שיש למנוע בכל מחיר". בראש ובראשונה, אין דבר ששווה "כל מחיר"; רק מי שאינו כלכלן מסוגל להשתמש בניסוח גורף כזה. יתר על כן, האינפלציה נחשבת בעיני כלכלנים לבעיה חריפה בלי קשר לפרדיגמה כלשהי. גם הטענה שהניאו-ליברלים רואים בה איום חמור יותר מן האבטלה מעוררת תמיהה. הרי האינפלציה מסכנת את הצמיחה, ולכן עלולה לגרום לפגיעה בתעסוקה. ביסוד החשש מן האינפלציה עומד אפוא הפחד מאבטלה – כן, אפילו אצל חסידי השיטה הניאו-ליברלית.

כשם שממן ורוזנהק נוטים להתרשל בהצגת ה"פרדיגמות" שבהן הם עוסקים, כך הם נוטים שלא לדייק (בלשון המעטה) בתיאור הנסיבות שהובילו להתחלפותן. הם טוענים, למשל, שהמדינה המפתחת ירדה מגדולתה משום שהתעצמות "התאגידים הפיננסיים והתעשייתיים של הכלכלה הגדולה, הן בבעלות פרטית והן בבעלות ציבורית, ובמידה מסוימת גם ארגוני העובדים החזקים" ערערה את יכולתה לנהל את המערכת הכלכלית ביעילות. "תביעותיהם של הגורמים האלה לזכות במשאבים כלכליים שבשליטת המדינה הלכו וגברו", הם מוסיפים, "עד שהיא התקשתה לעמוד בדרישותיהם בלי לגרום לתהליכים אינפלציוניים ולקשיים במאזן התשלומים".
אם הצגת הדברים הזו נכונה, הרי היא סותרת את הנחתם של המחברים כי המרת הפרדיגמה האחת באחרת נבעה ממניעים אידיאולוגיים; הלוא הקשיים שהם מציינים הם אובייקטיביים. כך או כך, זהו תיאור שגוי. המאבק על העוגה הכלכלית בישראל (דהיינו על חלוקת הערך המוסף בין שכר לרווחים) לא ניטש בין התאגידים והארגונים המקצועיים ובין הממשלה, אלא בין המעסיקים לעובדים. אלא שהמעסיקים ידעו שהם יכולים לסמוך על התערבות המדינה, ולכן לא ניהלו מאבק עיקש מול העובדים, כמקובל בכלכלות חופשיות. ולראיה – במגזר הפרטי בישראל לא היו אז כמעט שביתות. המדינה אכן נענתה למעסיקים, בעיקר בשל חששה מאבטלה ומבעיות במאזן התשלומים, והפעילה את מכשיר הפיחותים כדי ליצור במתכוון אינפלציה (אפילו שם המציאו לה – "אינפלציה פונקציונלית") ולשחוק את כוח הקנייה הריאלי של השכר.
מה שבאמת הביא את המדינה המפתחת לסוף דרכה בישראל הוא הידלדלות ההשקעות, שבעקבותיה התפוגגה הסיבה העיקרית למעורבותה של הממשלה בשוק ההון. הסוס הזה נגמר עוד ב-1965 – מה שאחראי במידה לא מבוטלת למיתון של 1966–1967. האמברגו הצרפתי על מכירת נשק לישראל, בעקבות מלחמת ששת הימים, סלל את הדרך ליצירת הזדמנויות השקעה חדשות, הפעם בפיתוח מוצרים ביטחוניים (בעיקר מטוס הכפיר וטנק המרכבה), אבל גם אפשרויות אלה מוצו עד מהרה. רק חששה של הממשלה מפני שובו של מיתון נוסח 1966–1967 הניע אותה להמשיך בהשקעות סרק, שהניבו עודף קיבולת גדול בתעשייה ועשרות אלפי דירות שלא היה את מי לשכן בהן. פרדיגמת המדינה המפתחת פשוט לא עבדה – וזה מה שעשה את הרפורמה להכרח.
ממן ורוזנהק מתעקשים, מצדם, כי ההכרה בהשלכותיה ההרסניות של מעורבות הממשלה במשק היא "עיקרון אידיאולוגי". אולי כדאי להזכיר להם עד כמה הרסנית, למשל, הייתה המדיניות הכלכלית הריכוזית שהנהיגה ממשלת בריטניה בשנות השבעים, ועד כמה קרובה הייתה הממלכה המאוחדת להפוך למדינת עולם שלישי. האם הייתה זו אמנם רק אידיאולוגיה שהמאיסה את מפלגת הלייבור על הציבור הבריטי ושגרמה לבחירתה של מרגרט תאצ'ר לראשות הממשלה, או שמא אפשר להסתפק בהסבר פשוט יותר – שהידרדרותה החופשית של הכלכלה הלאומית פקחה את עיני המצביעים? והאם נוכל לתלות גם את נסיגתה של הודו ממודל המדינה המפתחת במהפכה רעיונית, שאירעה סתם כך, כרעם ביום בהיר? וכיצד יסבירו מחברי הספר, הכרוכים כל כך אחר שיגיונות אידיאולוגיים, את המקרה של סין, שזכתה לעדנה כלכלית רק לאחר שממשלתה ההינה להתיר את אחיזתה במשק, ושבה טרם זכה הבנק המרכזי לעצמאות?
טענתם של המחברים כי המעבר לניאו-ליברליזם הוא שהביא לגידול באי-השוויון בחלוקת ההכנסות ולהצבר הון רב בידי אוליגרכיה מצומצמת נשענת אף היא על מצע רעוע. מאחר שעיסוק רציני בטענה זו מצריך יריעה רחבה, אסתפק בשתי הערות. ראשית, קרוב לוודאי שהסיבה להתרחבות פערי ההכנסות בישראל אינה נעוצה ברפורמה של 1985 אלא בפריחת תעשיית ההיי-טק, שהפכה את ההון האנושי לגורם מרכזי הרבה יותר במשק. שנית, הצבר ההון אינו תולדה של עצם הרפורמה, אלא של אופן ביצועה. הרפורמה התאצ'ריסטית, למשל, לא הביאה לתוצאה דומה; בניגוד לדימוי הפופולארי שהצמידו לה מתנגדיה, היא לא יצרה שכבה חדשה ודקה של בעלי ממון שחגגו על גבם של ההמונים העמלים. היא רק הצילה את בריטניה מחורבן כלכלי מוחלט.

הבעיות שעליהן הצבעתי מחווירות בהשוואה לחולשה המרכזית של הספר – הדרך שבה הוא מציג את צעדי בנק ישראל ואת מניעיו. לדידם של ממן ורוזנהק, הבנק, בדומה לשחקנים אחרים בזירה הציבורית, מודרך על ידי השאיפה לצבור כוח, ומשום כך פעל ללא ליאות לביסוס מעמדו העצמאי. אבל אם רק באינטרסים אנוכיים עסקינן – ולא ברצון לפעול לטובת הציבור, רחמנא ליצלן – אפשר היה לצפות שנגידי הבנק יבקשו לרצות את אלה שבידיהם נתונה הסמכות להאריך את משך שירותם בתפקיד או להחליפם בתום כהונתם. בתנאים כאלה, סביר היה שיימנעו מעימותים חזיתיים עם הממשלה ולא יפגינו נחישות יתרה במלחמתם לעצמאות מוסדית. בעניין זה היו יכולים לנהוג, למשל, על פי הדוגמה של ה'בנק אוף אינגלנד', שהקפיד על שיתוף פעולה מלא עם ממשלת בריטניה, עד שגורדון בראון, שר האוצר דאז ולימים ראש הממשלה, החליט ביזמתו להעניק לבנק המרכזי מעמד עצמאי. אלא שנגידי בנק ישראל בעשורים האחרונים לא היססו להתייצב מול פקידי האוצר, מול השר הממונה עליהם ואפילו, בעת הצורך, מול ראש הממשלה עצמו. הם עשו זאת משום שלנגד עיניהם עמדו שיקולים ענייניים-מקצועיים, לא מפני שרצו להרקיד את המשק לצלילי חלילם.
כדי להיווכח עד כמה מופרכת היא גרסת הספר בנוגע לחתירתו של בנק ישראל לעוצמה מוסדית די לקרוא בדו"ח שפרסם הבנק ב-1986, זמן קצר לאחר הפעלת תכנית הייצוב. "חידוש הצמיחה כרוך, ללא ספק, בנטילת סיכונים מסוימים, הן בתחום מאזן התשלומים והן בתחום יציבות המחירים (שאחת מהצדקותיה המרכזיות היא תרומתה הפוטנציאלית לצמיחה)", כך כותבים מחברי הדו"ח. "אחד הביטויים המרכזיים של סיכונים אלה מצוי בתחום הליברליזציה בפיקוח על מטבע חוץ, ובפרט על תנועות ההון. ליברליזציה כזו מצמצמת את שליטתו של בנק ישראל על מערך שיעורי הריבית במשק, מגבירה את חשיפתו לתנועות הון ספקולטיביות ובכך מקשה על ייצוב שער החליפין הנומינלי, הממלא תפקיד מרכזי במדיניות האנטי-אינפלציונית" (ההדגשות שלי).
הציטוט הזה לבדו מוציא את האוויר מן התזה שמנפח הספר. בנק ישראל מכריז כאן ברבים כי הוא מעוניין בצמיחה כלכלית – ולשם כך מקדם מדיניות המחלישה את כוחו שלו, בניגוד מוחלט לתמונה שמציירים ממן ורוזנהק. אולם אין צורך להתבסס רק על הצהרות הבנק. פעולותיו מדברות בעד עצמן – ונגד טענות המחברים. החלטתו של נגיד הבנק הנוכחי, סטנלי פישר, לרכוש מטבע חוץ בהיקף אדיר כדי למנוע את התחזקותו של השקל ממחישה היטב את הנקודה. הרי בלימת התחזקות השקל אינה מהלך אנטי-אינפלציוני; ההפך הוא הנכון. וברי לכל שהבנק עושה זאת כמי שכפאו השד, שכן הדבר מפריע לו מאוד בניהול מדיניות מוניטרית עצמאית.
בסופו של דבר, אין בספר שמץ של ראיה התומכת בטענת המחברים שבנק ישראל הוא הכוח המניע מאחורי אימוץ הפרדיגמה הניאו-ליברלית. כל שביכולתם להציע הוא קביעה כללית – ומופרכת מכל וכל – שבנק מרכזי עצמאי הוא מסימני ההיכר של כלכלה ניאו-ליברלית. לו רצו להעמיד את מחקרם על רגליים מוצקות, היו צריכים להראות שלולא נרתם בנק ישראל לקידום הרפורמה, ספק רב אם הייתה קורמת עור וגידים, או לפחות יוצאת אל הפועל בזריזות רבה כל כך. כדי להוכיח זאת נדרש תיעוד מקיף (למשל, פרוטוקולים של דיוני הממשלה) וניתוח מפורט של המהלכים שהובילו לרפורמה. אין מזה בספר ולא כלום. רק כתב אישום שכולו הכללות קלושות והשערות פורחות באוויר. כך לא כותבים היסטוריה כלכלית רצינית.
Translation - English The following text is a review of an book called The Bank of Israel: Political Economy in the Neo-Liberal Era, written by Daniel Maman and Zeev Rosenhek of the
Van-Leer Institute of Jerusalem and HaKibbutz HaMeuhad, 2009
Toward the middle of 1985 the Israeli economy stood on the brink. Dizzying hyperinflation, which in April of that year reached a record level of 737 percent annually, along with a negative balance of payment, threatened to wreak havoc on the national economy. The acute crisis left the country’s leaders with no alternative: anyone with eyes to see realized the only option was to take emergency measures. Only a national unity government, with a prime minister from the Labor Party (Shimon Peres) and a finance minister from the Likud (Yitzhak Moda’i), was eventually able to enlist the political resolve needed to lead a plan to stabilize the economy; the implementation began in the summer of that same year. But the correct understanding of the inflationary process and its causes, which formed the foundation of the dramatic policy change, should be attributed primarily to the Bank of Israel’s research department.
Though the immediate aim of the plan to stabilize the economy was to halt the vertiginous price increases, it reflected a growing recognition among policymakers that Israel’s pseudo-socialist economic system had gone bankrupt. This system entrusted the government with enormous economic power, granting it ownership of the mining, energy, communications and defense manufacturing industries, as well as full or partial control over the capital, foreign currency and credit markets. As a result, during the first 37 years since its founding, Israel’s monetary policy took shape as a byproduct of government activity in other fields. The exchange rate served as a tool to support exports and the interest rate, in its common sense, was but a dream; the government introduced a range of interest rates to achieve goals in the area of industrial policy, and compelled the Bank of Israel to print money in order to finance its deficits.
The 1985 reform changed the rules of the game. It dismantled the broad, complex system of centralized economics and removed the government from the capital, credit and foreign currency markets; it reduced the weight of the government’s manufacturing budget, both in terms of taxes and expenses; it privatized numerous assets under state ownership; and it initiated a monetary policy that entailed granting the Bank of Israel phased independence—eventually leading to the autonomy it enjoys today—in order to administer the policy.
The substantial changes the Israeli economy has undergone during the past quarter century, particularly in its monetary practices, are the subject of the book, The Bank of Israel: Political Economy in the Neo-Liberal Era, published in 2009. The authors, Daniel Maman of Ben-Gurion University and Zeev Rosenhek of the Open University, focus their research on the State of Israel’s central bank—what they call the leading agent of “the paradigm of neo-liberal policy” currently holding sway in the economy—and try to track the processes that led it to secure “a key position in the political-economic field and the state system.” This is definitely an important issue worthy of earnest discussion, but their problematic—if not slipshod—handling of the matter does an injustice to the issue, and to the inquisitive reader as well.

Maman and Rosenhek open their book with a quote in which Yaakov Frankel, who served as governor of the Bank of Israel from 1991 to 2000, claims that the modern history of Israeli economics starts in 1985. The authors, however, hold that “the plan for economic stability put into practice that year…marks the opening of a gradual, but very profound and comprehensive process of altering political economics in Israel, especially concerning the state’s involvement in the economic arena.”
Maman and Rosenhek claim that the implementation of the stabilization plan in 1985 was notable for its outcome: exchanging the “developing nation model,” on which the Israeli economy was based during the initial decades, for the neo-liberal paradigm. The original model assigned the state heavy involvement in the economic system through oversight and resource allocation, in order to drive growth and provide full employment for the population. To accomplish this the government used the central bank as a tool to control the capital market and to finance its budget deficits. The neo-liberal approach, on the other hand, seeks to minimize supervision and regulation “from above” and, as the authors explain, “in the field of economics the proper task of the state, and of politics in general, is only to create the fundamental conditions to allow the efficient operation of markets and the players within them.”
According to the prevailing view, the rise of the neo-liberal paradigm over the past 30 years is a result of aggressive globalization, which forced many countries to adopt the “free market” model; these countries assumed that if they did not do so, they would be left behind, and might even be penalized by the international community’s financial institutions. However, Maman and Rosenhek hold that even if some truth lies in this assessment, it does not accurately reflect the reality, because it creates the impression of an inevitable, almost automatic process. They hold that to a large extent the transition to a market economy blocks entry to the local arena. “The neo-liberal revolution is not a result of deterministic processes,” they write, “but the fruits of activity by political players…in accordance with institutional, class and other interests.”
That, the writers assert, was precisely what the Bank of Israel did. They claim central banks tend to believe that the free market is the best mechanism for resource allocation and reject state involvement in the economy. The Bank of Israel is not out of the ordinary. Maman and Rosenhek describe it as the primary institutional body fighting at the front lines against the developing nation paradigm; loyal to the neo-liberal approach, the bank holds that financial stability is the paramount aim of the economic policy and sees inflation—more than unemployment—as the main threat.
Maman and Rosenhek trace the Bank of Israel’s gradual disengagement from the fetters the Finance Ministry imposed on it and its entrenchment as an autonomous, influential force in the Israeli economy. The Bank of Israel’s dramatic expansion was made possible, they argue, thanks to its position on “the borderline between the local field and the global field.” The bank successfully enlisted academia and international economic institutions (particularly the International Monetary Fund) to create the impression that exchanging the developing-nation model for the neo-liberal approach is a certified, scientific move and an exigency in the age of globalization. By fostering this change the bank won its longed-for independence, which it had been deprived of under the institutional structure of the developing nation.
The Bank of Israel’s deeds, as described in the book’s pages, point toward a strategy of phased emancipation—or takeover. The 1985 reform froze the exchange rate at a level of 1,500 shekels (in the old currency) to the dollar and brought a far-reaching reduction in the national budget deficit. At this stage the government was still involved in setting the exchange rate, giving the Bank of Israel freedom to shape monetary policy as it saw fit. The first devaluation in the shekel rate following the reform took place in January 1987—at the government’s behest. Since even after the stabilization plan went into effect inflation stood at a sizable rate of 15%-20% annually, additional devaluations were needed, eventually leading to the creation of a “currency band” around the main exchange rate in February 1990.
The currency band delineated a range within which the exchange rate could move freely, similar to arrangements introduced in the European Union before the euro was instituted. The Bank of Israel’s intervention in the foreign currency market was only needed in the event the exchange rate threatened to drop below the minimum level set (revaluation) or the ceiling level (devaluation) of the currency band. The limited mobility in the exchange rate afforded the central bank a certain measure of freedom to adjust the interest rate, a change considered to be a significant advance toward achieving full institutional independence. Over the subsequent years the importance of the currency band diminished until in 1998 it became irrelevant; the exchange rate became completely fluid and the Bank of Israel started run the monetary policy through the interest rate, without allowing the government—which by that stage had withdrawn from the capital market—to influence its decisions in any way.
The victory of the neo-liberal paradigm over the developing nation model was not achieved overnight, the book explains. It was the result of a prolonged battle between the Bank of Israel and the government—or the Finance Ministry. Each side was guided by political and institutional interests, which were often disguised as policy considerations alone. Today the Bank of Israel has the upper hand, although the extensive changes in its status have yet to be enshrined by law. Maman and Rosenhek, the book reveals, are not content with this trend, which subordinates the economic system to “market logic.” The neo-liberal project the bank is leading, they hold, is hampered by structural and political instability. They warn that “the changes in distribution processes and redistribution of resources in society, as well as the grave ramifications they hold in terms of structural inequality, were particularly rapid and profound in Israel, more than in any other advanced capitalist nation, which could exacerbate dissatisfaction with the neo-liberal regime in broad sections of the population.”
In order to prevent a catastrophic scenario of total social disintegration, they suggest “a move to reconnect between economics and politics,” which would “reopen the political sphere to participation by representatives of broader and more varied social interests,” and would restore to the repressed masses the power stolen from them by “certified experts with technical knowledge and skills, such as personnel from the central banks.” The authors note that this would not spell the end of capitalist economics in Israel; the remedy they are proposing merely exposes the political foundations it seeks to blur and would allow it to be “rewoven” in society, whatever that may mean.

Maman and Rosenhek are clearly not big fans of free market economics. In fact, they make a point of putting the word “free” in quotation marks in this context to suggest an underlying distortion. Their ideological agenda is apparent throughout the book; unfortunately it also seems to bring them to spot ideological fingerprints everywhere—oftentimes unnecessarily. It could be that the reason lies in the fact that the two are not economists, but sociologists. One way or another, a deeper understanding of the discipline they presume to analyze and critique would have spared them a number of mistakes.
From one standpoint, at least, the book is on the mark: since 1985 the Bank of Israel has indeed undergone extensive change that lent it total autonomy after decades of submitting to the government like an indentured servant. The subordination to the Finance Ministry that dominated patterns of conduct until that pivotal year was unusual compared to accepted norms in developed countries. Though the central banks of France and Britain, for instance, were likewise not entirely independent in past years, they did not depart completely from government authority. But the freedom the Bank of Israel currently enjoys is not unusual. The European Central Bank, which is responsible for managing the euro bloc’s monetary policy, also operates independently, and similar situation can be found in the US, Australia, New Zealand and other countries.
Maman and Rosenhek portray the Bank of Israel’s release from government dictates as a transformation of the “paradigm,” but their frequent use of this term is fundamentally flawed. One salient example is their position on the “Keynesian paradigm,” which “generally dominated the political-economic field in centralist countries until the end of the 70s,” before it was forced to step aside—to the authors’ dismay—to make room for the neo-liberal approach.
Keynesian theory and the policy based on it cannot be considered a “paradigm,” and cannot readily be described as an example of government control of the capital market. First, John Maynard Keynes, the celebrated economist behind the theory, did not propose an institutional structure that differed from the one that existed in the West before the Great Depression. Second, he never intended to prescribe a comprehensive economic policy of aggressive government intervention in the market, certainly not the capital market. And finally, most important of all, Keynes never rejected free market economics, neither on an ideological basis nor a practical basis.
This matter should be set forth clearly. Keynes’ basic teachings can be summarized as follows: Under certain circumstances economic crises are liable to occur, such as the Great Depression of the 1930s, and making adjustments in the free markets, including aggressive monetary policies, are not enough to extract countries from the ill effects. In such situations, suggests Keynes, the country must take massive physical measures, i.e. it must create a budget deficit to foster economic activity and boost the market. The country can issue bonds and use credit to provide it with the means to carry out public projects, such as paving roads. The new employment opportunities that will be created through such initiatives will funnel income into the workers’ pockets, and that money will then be used to purchase consumer goods. Increased consumption will also lead to increased activity within the sectors that manufacture these products, and gradually the economy will recover. This route is not—and never claimed to be—a “paradigm.” Instead it is an emergency plan based on a certain view of the behavior of the economic system.
Keynesian theory and the proposal it lays forth took the political and economic world by storm. (Among the few who dared to oppose it, the most notable figure, perhaps, was Milton Friedman.) Thirty years passed before the reality on the ground forced the economic world to reevaluate the validity of this approach. Efforts by Western nations to combat unemployment during the 1960s and 70s through Keynesian methods—which had been formulated to deal with much more severe crises—failed to achieve their goals, yet drove up inflation.
The authors, however, credit Keynes for a “paradigm” he never presumed to set forth; furthermore, their neo-liberal discussion leaves the reader more confused than ever. The book’s thesis rests to a large degree on the assertion that important indicators of the neo-liberal system are the existence of an independent central bank and a perspective that sees inflation as a leading economic threat which must be continually guarded against. In light of this assertion we can only wonder how we should categorize various economies. Can the neo-liberal paradigm be applied, for instance, to developed nations in the pre-World War I period, which was notable for far-reaching globalization? And if so, how can this be reconciled with the fact that the US did not have a central bank at the time (the Federal Reserve was founded only in 1914)?
Similar questions can be raised regarding the markets of Western Europe and the US during the decades preceding the abandonment of the Bretton Woods Agreements in the early 1970s. This agreement, signed in 1944, arranged for the financial system and international trade among industrialized nations to be based on set exchange rates; yet if the Bretton Woods system of monetary management—which Keynes designed—contradicts the spirit of neo-liberalism as outlined by the authors, how can we explain the complete independence of the Germany’s central bank during the period in question, or West Germany’s resolve to battle inflation, even at the cost of increased unemployment?
In general, it seems Maman and Rosenhek are wrong in their understanding of the arrangement. Their theory leads to the erroneous conclusion that it was intended to allow its partners to function as developing countries, which are also engaged in redistribution of income. However, the motivation to sign on the Bretton Woods Agreements stemmed from a desire to avoid the situation prevailing during the Great Depression, when various countries waged an all-out trade war against one another and were consigned, time after time, to deflate the local currency in order to promote exports and limit imports. This campaign did not bear fruit and merely aggravated the situation. Fixing the exchange rates was intended to prevent such developments—not to create a new order in which the state was obligated “to introduce practices of intensive involvement in order to shape and direct the economic activity,” as the writers claim.
Maman and Rosenhek are wrong and misguide others when they link the neo-liberal paradigm to the viewpoint that inflation is “a fundamental threat to be avoided at all costs.” First and foremost, nothing should be “at all costs”; only someone who is not an economist is capable of using such a blanket statement. Furthermore, economists consider inflation a major problem regardless of any paradigms. Even the claim that the neo-liberals see it as a greater threat than unemployment is surprising. Inflation endangers growth, therefore it can harm employment. At its root, concern over inflation is based on fears of unemployment—yes, even among neo-liberal loyalists.

Just as Maman and Rosenhek tend to be negligent in presenting the “paradigms” they wrote about, they also tend to be imprecise (to put it mildly) in describing the circumstances that led them to be replaced. They claim, for instance, that the developing state suffered a loss in standing because of the expansion of “the financial and industrial corporations of the big economy, both privately and publicly owned, and that to a certain extent the powerful workers organizations” also challenged its ability to manage the economy efficiently. “Their claims to economic resources under state control continued to grow,” they add, “until [the state] was unable to meet their demands without causing inflationary processes and difficulties with the balance of payments.”
If this presentation of the matter is correct, it contradicts the authors’ assumption that the switch from one paradigm to another stemmed from ideological reasons; for the difficulties they note are objective. One way or another, this depiction is flawed. The battle over slices of the Israeli economy (i.e. over distribution of the added value between wages and profits) was not fought between the corporations/professional organization and the government, but between employers and employees. Yet the employers knew they could count on state intervention, therefore they did not engage the employees in the kind of tooth-and-nail battle typical of free economies. As proof, in the Israeli private sector there have been almost no strikes since then. The state agreed with the employers, primarily due to concerns over unemployment and balance of payment problems, and made use of deflation as a means of deliberately creating inflation (and even coined a term for it—“functional inflation”) and eroding the wages’ real buying power.
What really brought about the demise of the developing nation model in Israel was the decline in investments, after which the main reason for government intervention in the capital market faded out. This workhorse was set out to pasture as early as 1965, which was largely responsible for the recession of 1966-67. The French embargo on arms sales to Israel after the Six-Day War paved the way for new investment opportunities, this time in the development of security products (especially the Kfir fighter plane and the Merkava tank), but these opportunities were quickly exhausted as well. Only the government’s fear of a return of the 1966-67 recession drove it to continue wasted investments, which yielded a large capacity surplus in manufacturing and tens of thousands of vacant apartment units. The developing nation paradigm simply didn’t work—which is what made the reform a vital necessity.
Maman and Rosenhek insist that the destructive ramifications of government intervention in the economy is “an ideological principle.” Perhaps they should be reminded of the destructiveness of the British government’s centralist economic policy in the 1970s and how close the United Kingdom came to turning into a third-world country. Was it ideology alone that led the British public to despise the Labour Party and led to the election of Margaret Thatcher as prime minister, or might a simpler explanation suffice: the freefall of the national economy allowed voters to realize what was taking place? Can we also attribute India’s withdrawal from the developing nation model to a conceptual sea change that fell out of a clear blue sky? And how would the book’s authors, who are so caught up in ideological obsessions, explain the case of China, which began to flourish economically only after the Chinese government released its hold on the economy and then backtracked before the central bank had achieved independence?
The writers’ claim that the transition to neo-liberalism is what led to increased inequality in income distribution and a buildup of capital in the hands of a limited oligarchy also rests on shaky ground. Since addressing this assertion would entail a lengthy discussion, I will suffice with two remarks. First, almost certainly the reason for the increase in income gaps in Israel is not related to the 1985 reform, but to the flourishing of the high-tech industry, which turned human capital into a much more central factor in the economy. Second, capital accumulation is not a direct result of the reform itself, but of the manner in which it was carried out. The Thatcherist reform, for instance, did not lead to similar results; in contrast to the popular image created by opponents, it did not give rise to a thin, new layer of capital-holders who lived it up at the expense of the working masses. It merely saved Britain from total economic ruin.

The problems I pointed to pale in comparison with the book’s main weakness—the way it presents the Bank of Israel’s moves and motivations. Maman and Rosenhek write that the bank, like other players in the public arena, were guided by a desire to gain power, therefore they worked indefatigably to buttress its standing. But if we address only self-interest—and not the desire to work for the public good, Heaven help us—we would expect to see the governors of the bank trying to please those who hold the authority to extend their time in office or replace them at the end of their term. Under such conditions, they would invariably avoid direct confrontation with the government, showing little resolve in their war for institutional independence. In this regard, they could have followed the example of the Bank of England, which always maintained full cooperation with the British government, to the point that Gordon Brown, then finance minister and later prime minister, decided to grant the central bank independence. Yet the governors of the Bank of Israel, during the past decades, have not hesitated to stand up to Finance Ministry officials, the finance minister and even, when necessary, the prime minister himself. They did so because of policy considerations, not because they wanted the economy to dance to their beat.
The report the Bank of Israel published in 1986 shortly after the stabilization plan went into effect clearly demonstrate how tenuous are the book’s claim that the Bank of Israel was striving for power. “Renewed growth, without a doubt, entails taking certain risks, both in the area of balance of payments and price stability (for which one of the main justifications is its potential contribution to growth),” reads the report. “One of the primary forms these risks take lies in liberalizing oversight of foreign currency, particularly capital transfers. Such liberalization reduces the Bank of Israel’s control over interest rates, increases its exposure to speculative capital movements and that in turn tends to destabilize the nominal exchange rate, which plays a central role in the anti-inflation policy” (emphasis added.)
This quote alone is enough to deflate the book’s overblown thesis. Here the Bank of Israel publicly declares that it would like to see economic growth—and to accomplish that goal it promotes a policy that weakens its own power, in stark contrast to the impression Maman and Rosenhek impart. But there is no need to rely solely on the bank’s declarations. Its actions speak for themselves—and against the authors’ claims. The decision by the current governor, Stanley Fischer, to purchase foreign currency in enormous quantity in order to prevent the shekel from gaining illustrates this point well. Halting the rise in the shekel’s value is not an anti-inflationary move; in fact, it is just the opposite. And it is abundantly clear that the bank does so as an entity that has lost its senses, since this greatly inhibits its ability to pursue a policy of monetary independence.
The book does not offer a shred of evidence supporting the writers’ claim that the Bank of Israel is the driving force behind the adoption of the neo-liberal paradigm. All they have to put forth is a general, groundless assertion that a central, independent bank is one of the distinguishing features of neo-liberal economics. Had they wanted to place their research on a sturdy foundation they would have had to demonstrate that had the Bank of Israel not agreed to advance the reform, it would probably never have taken shape, or at least would have been carried out at a much slower pace. To prove this would require extensive documentation (e.g., protocols of government meetings) and detailed analysis of the moves that led to the reform. But the book offers none of this. It is merely an indictment filled with strained generalizations and free-floating conjecture. That is no way to write economic history.
