Source text - English One of the most fundamental requirements of a capitalist economic system - and one of the most misunderstood concepts - is a strong system of property rights. For decades social critics in the United States and throughout the Western world have complained that property rights too often take precedence over human rights, with the result that people treated unequally and have unequal opportunities. Inequality exists in any society. But the purported conflict between property rights and human rights is a mirage. Property rights are human rights.
The definition, allocation, and protection of property rights and comprise one of the most complex and difficult sets of issues that any society has to resolve, but one that must not want to abolish those rights. Rather, they want to transfer them from private ownership to government ownership. Some transfers to public ownership (or control, which is similar) make an economy more effective. Others make it less effective. The worst outcome by far occurs when property rights really are abolished.
A property rights is the exclusive authority to determine how a resource is used, whether that resource is owned by government or by ondividuals. Society approves the uses selected by tha holder of the proprerty right with governmental administered force and with social ostracism. If the resource is owned by the government, the agent who determines its use has to operate under a set of rules determined, in the United States, by Congress or by executive agencies it has charged with that role.
Private property rights have two other attributes in addition to determining the use of a resource. One is the exclusive right to the services of the resource. Thus, for example, the owner of an apartment with complete property rights to the apartment has the right to determine whether to rent it out and, if so, which tenant to rent to; to live in it himself; or to use it in any other peaceful way. That is the right to determine the use. If the owner rents our the apartment, he also has the right to all the rental income from the property. That is the right to services of the resources (the rent).
Finally, a private property right includes the right to delegate, rent, or sell any portion of the rights by exchange or gift at whatever price the owner determines (provided someone is willing to pay that price). If I am not allowed to buy some rights from you and you therefore are not allowed to sell rights to me, private property rights are reduced. Thus , the three basic elements of private property are (1) exclusivity of rights to choose the use of a resource, (2) exclusivity of rights to the services of a resource, and (3) rights to exchange the resource at mutually agreeable terms.
The U.S. Supreme Court has vacillated about this third aspect of property rights. But no matter what words the justice use to rationalize such decisions, the fact is that suche limitations as price controls and restricions on the right to sell at mutually agreeable terms are reductions of private property rights. Many economists (myself included) believed that most such restrictions on property rights are detrimental to society. Here are some of the reasons why.
Under a privte property sistem the market values of property reflect the preferences and demands of the rest of society. No matter who the owner is, the use of the resource is influenced by what the rest of the public thinks is the most valuable use. The reason is that an owner who chooses some other use must forsake that higest valued use and the price others would pay him for the resource or for the use of it. This creates an interesting paradox: although property is called private, private decisions are based on public, or soial , evaluation.
The fundamental purpose of property rights, and their fundamental accomplishment, is that they eliminate destructive competition for control of economic resources. Well-defined and well-protected property rigths replace competition by violence with competition by peaceful means.
The extent and degree of private property rights fundamentally affect the ways people compete for control of resources. With more complete private property rights, market exchange values become more influential. The personal status and personal attributes of people competing for resource matter less because their influence can be offset by adjusting the price. In other words, more complete property rights make discrimination more costly. Consider the case of a black woman tho wants to rent an apartment from a white landlord. She is better able to do so when the landlord has the right to set the rent at whatever level he wants. Even if the landlord would prefer a white tenant, the black woman can offset her disadvantage by offering a higher rent. A landlord who takes the white tenant at a lower rent anyway pays for discriminating.
But if the government imposes rent controls that keep the rent below the free-market level, the price the landlord pays to discriminate falls, possibly to zero. The rent control dose not magically reduce the demand for apartments. Instead, it reduces every potential tenant's ability to compete by offering more money. The landlord, now unable to receive the full money price, will discriminate in favor of tenants whose personal characteristics - such as age, sex, ethnicity, and religion - he favors. Now the black woman seeking an apartment cannot offset the disadvantage of ther skin color by offering to pay a higer rent.
Translation - Italian Uno dei requisiti fondamentali di un sistema economico capitalista (e anche uno dei più fraintesi) è l’esistenza di un valido ordinamento di diritti di proprietà. Per decenni, critici statunitensi, e in generale di tutto il mondo occidentale, hanno lamentato una troppo frequente priorità dei diritti di proprietà a scapito dei diritti umani, con il risultato che le persone venivano trattate diversamente e con diverse opportunità. La disuguaglianza esiste in ogni società. Ed il conflitto tra diritti di proprietà e diritti umani è una chimera, i diritti di proprietà sono diritti umani.
La definizione, allocazione e protezione dei diritti di proprietà rientrano in quell’insieme di questioni complesse e difficili che ciascuna società deve affrontare e che , in qualche modo, devono essere risolte. I critici, per la maggior parte, non mirano ad abolire i diritti di proprietà. Vorrebbero piuttosto effettuare un trasferimento dalla sfera privata a quella pubblico-statale. Tra tali trasferimenti alla proprietà pubblica (o al controllo pubblico)alcuni rendono l’economia più efficace, altri meno. Il peggior risultato in assoluto si verifica quando i diritti di proprietà vengono svuotati del loro contenuti.
La Proprietà è la facoltà esclusiva di determinare il godimento e la disposizione di una risorsa, nel caso in cui questa sia proprietà dello Stato o di un soggetto Privato. La società garantisce l’uso esclusivo del titolare di una proprietà mediante l’amministrazione statale e l’ostracismo sociale. Se il bene è proprietà dello Stato il titolare, nell’esercizio del potere di godimento e disposizione, è condizionato dalle regole che, negli Stati Uniti, sono stabilite dal Congresso e dalle Agenzie esecutive con tale incarico.
La proprietà privata ha altri due attributi per determinare godimento e disposizione di una risorsa. Ad esempio, il proprietario di un appartamento con il pieno diritto di proprietà su quell’appartamento, avrà il diritto di decidere se dare in affitto il bene o meno, e in tal caso, di scegliere l’affittuario; avrà inoltre il diritto di risiedere lui stesso nello stabile, o di goderne in altro modo. Ciò è quanto si intende per determinazione di godimento e disposizione. In caso di locazione, il proprietario acquisisce inoltre i diritti su tutto il reddito proveniente dalla locazione della proprietà. Ciò è quanto si intende con diritto alla fruizione dei beni.
Infine, la proprietà privata prevede il diritto a cedere, locare o vendere alcuni diritti mediante scambio, donazione o pagamento di un qualunque prezzo stabilito dal proprietario (purché qualcuno sia disposto a pagare tale prezzo). Il diritto di proprietà si riduce nel caso in cui ad un soggetto non è permesso di comprare alcuni diritti e, di contro, ad un altro non è permesso di venderli. I tre elementi alla base della proprietà privata sono (1) il diritto di disporre e godere in maniera esclusiva di un bene, (2) il diritto esclusivo di fruizione di un bene, (3) il diritto di scambio di un bene dietro consenso reciproco delle parti.
La Corte Suprema degli Stati Uniti si è dimostrata titubante riguardo il terzo elemento. Tuttavia non è rilevante con quali termini la Corte motivi le sue decisioni, quanto piuttosto le limitazioni, ad esempio il controllo del prezzo e le restrizioni sul diritto di vendita dietro consenso reciproco delle parti. Molti economisti ( me compreso) ritengono che la maggior parte di tali restrizioni sui diritti di proprietà siano dannose per la società. Di seguito sono riportate alcune motivazioni in merito a quanto detto.
Nell’ambito dell’ordinamento della proprietà privata i valori del mercato dei beni riflette le preferenze e le esigenze del resto della società. Non è rilevante chi sia il proprietario, lo sfruttamento della risorsa è influenzato dall’uso che l’opinione pubblica ritiene più appropriato. La ragione di ciò è che un proprietario che sceglie di impiegare la risorsa in altro modo deve rinunciare all’impiego di maggior valore, e così gli altri pagano per quella risorsa e per il suo uso. Ciò innesca un interessante paradosso: nonostante la società viene detta “privata” , le decisioni private sono vincolate alla valutazione pubblica o sociale. Lo scopo fondamentale dei diritti di proprietà, ed il loro adempimento, è l’eliminazione della COMPETIZIONE dannosa per il controllo delle risorse economiche. Ben definiti e controllati i diritti di proprietà contribuiscono a sostituire la concorrenza brutale con una più pacifica.
L’estensione e il grado della Proprietà influenza fondamentalmente il modo in cui le persone competono per il controllo delle risorse. Più completo sarà l’apparato dei diritti di proprietà, maggiormente sarà influente il valore di scambio sul mercato.
Lo status e le caratteristiche personali delle persone in competizione conta meno perché tali attributi possono essere compensati dal prezzo. In altre parole, un apparato di diritti di proprietà più completo rende la DISCRIMINAZIONE più ricca. Si prenda in considerazione il caso di una donna nera che intende fittare un appartamento da un padrone di casa bianco. La donna sarà maggiormente in grado di raggiungere il suo intento quando il proprietario avrà il diritto di fissare il canone di locazione a qualsiasi livello voglia. Anche se il padrone di casa preferisse un’inquilina bianca, la donna potrà compensare il suo svantaggio offrendo un affitto più alto. Un proprietario che accetterà un affittuario bianco ad un affitto più basso pagherà comunque la discriminazione.
Ma se lo Stato imponesse dei controlli sugli affitti tali da mantenere il valore di questi ultimi al di sotto del livello libero di mercato, il prezzo che il proprietario pagherebbe per le discriminazioni sarebbe pari a zero. Il CONTROLLO DEGLI AFFITTI non ridurrebbe magicamente la richiesta di appartamenti. Al contrario, esso ridurrebbe la capacità potenziale di ogni inquilino di competere offrendo un prezzo più elevato. Il padrone di casa, non essendo ora in grado di ricevere l’intero prezzo del denaro, effettuerà la sua scelta (discriminazione) in base alle caratteristiche personali degli inquilini (ad esempio l’età, il sesso, l’etnia, la religione ) che preferisce. Ora infatti la donna nera che cerca un appartamento non potrà compensare lo svantaggio, rappresentato dal colore della pelle, offrendo di pagare un affitto più alto.
La concorrenza per la scelta di un appartamento non si attenua con il controllo degli affitti. Quest’ultimo cambia semplicemente gli strumenti per competere. Le restrizioni sulla proprietà privata riducono il valore degli scambi monetari per beni e servizi e aumentano il valore delle caratteristiche personali. Più in generale, l’indebolimento dei diritti di proprietà privata aumenta l’influenza delle caratteristiche personali nell’indurre i venditori a discriminare tra gli acquirenti e gli acquirenti a discriminare tra i venditori.
I due estremi all’interno di un sistema in cui i diritti di proprietà privata risultano indeboliti, sono il socialismo e la proprietà comunitaria. Durante il socialismo, gli agenti statali ( quelli cui è stato assegnato il compito dal governo) esercitano il controllo sulle risorse. I poteri di tali agenti di decidere in merito alla proprietà affidatagli sono altamente limitati. Chi pensa di poter utilizzare le risorse con impieghi più redditizi non può farlo con il semplice acquisto di del potere su quella risorsa in quanto quest’ultimo non è in vendita.

Source text - English It was Friday morning. I took my rifle to school. The students all wanted to hold it. I have noticed that all boys, grown-up boys too, like dangerous things. To teach them the rules of movement, I tbrought my gun to class. Other teachers didn't always like the way I taught, but I knew that boys learned more when they enjoyed their lessons.
I like teaching. I like my job. But at home things weren't si giigìd, When I left school that day, I felt tired and sad. "Eight years married to Sarah", I thought , "and we're really not happy with each other any more".
The doctors said Sarah couldn't have children. Without babies, I was not enough for her. She wanted more than anything to be a mother. We did not fight about this, though. We did not talk much anything. That evening was no different. She said hello and I said hello, and that was it.
I was sitting at my desk, reading a letter from my brother, when the telephone rang. She answered it. Sarah answered it. She talked quietly at first but then she began to shout. I heard her say, "oh no!" and, "Yes, we'll come at once". When she had put down the telephone, she came to talk to me.
"We have to go and see Donna and Peter. Now", she told me. Donna was her best friend. Perhaps this was because Donna, too, could not have children. I liked Peter Keithly but I did not know him very well.
"Not tonight," I said. "I am too tired".
"I don't care. We must go. We must go now!" She was crying. "
"What is it?" I asked her. "Has there been an accident?"
"No.. no, not that. She .. she is in terrible trouble, with the police."
"What ", I asked slowly, "has Donna done?"
Sarah was still crying but her voice was now stronger. "She stole something."
That's no reason to cry", I said.
"You don't listen", Sarah shouted. "You are not listening now. She stole a baby."
................
We went to see them. Peter met us at the door. He looked terrible. Donna was sitting in the corner of the sitting-room and said nothing when we arrived.
"She won't talk," Peter explained. "Or eat".
"What happened?"I asked him. He took me to the kitchen and told me. He seid that she took a baby from the park and drove off with it in the car. The polilce found the baby in the car by the beach. Donna was sitting near the sea in the rain.
"What will we do?" Peter said. He looked lost. "I've got enough problems already, and now this.."
"Problems? " I said, I was thinking about Donna.
"I did something stupid", Peter said. There was this man I met in a pub. He asked me if I could help someone make computer programs for horse races. I thought, why not? He gave me pages and pages of reports in horses; I wrote the programs, and he paid me."
"So what's wrong?" I asked.
"Well, after I gave him the programs, these two other men came one evening. They told me to give them the programs. They said they weren't working with the other man but they wanted the programs."
"And you gave them to them?" I was surprised.
"Yes, in a way. They were really frightening. They said they 'd hurt Donna. But I only gave them the first programs I tried to make. They won't work." He explained it all in computer language, which I did not understand. ut I understood what he did: he gave something useless to two dangerous men.
"You're in trouble," I said slowly. "You 'll have to go away for a while,as soon as you can. It will be good for you both."
Peter agreed. "Donna loves our boat" he said. "I'll take her away on that, as soon as I can."

We stayed with them for that weekend, but on Sunday I decided to go backhome to get ready for school on Monday. Sarah wanted to stay with Donna. That was right with me.
I said goodbye to them. At the last minute Peter gave me three cassettes. He told me to listen to them on my way home. I looked at the names on the cassette boxes quickly, and thanked him. Not really my kind of music, I thought.
I was almost home when I remembered them again. I decided to listen to one, but instead of music I heard strange sounds. I knew that sort of noise. I tried another cassette. It was the same. Now I knew what it was: these cassettes were his computer programs.
I enjoyed my classes on Monday. It was easier to wark than to think about Peter and Donna's problems. Then I came home, and the problems caught up with me again. Peter telephoned. "Jonhatan, did you listen to those cassettes? You know what they are, don't you? "
"Your horce-race programs?"
"Yes. Will you keep them for me for a few days? I do want to take short holiday with Donna, but I don't want to leave the cassettes here at home."
"Have you heard from those two me again?" I asked.
"No I haven't".
"Why didn't you tell me that they were your programs?"
"I didn't want Donna to know about them, or about the two men, " he said. He told me I could try to see if they worked, if I wanted. I said I wasn't very interested in horses. Then I remembered my brother William. He like horses very much. I never talked to Peter again. Two evenings later he went down to the river to get his boat ready for the holilday, pushed a switch on it somewhere, and something happened. Sarah telephoned to tell me. She said, "The boat caught fire. No one knows why. Peter is dead."
All that night I thought about Peter, about how he died , and in the morning , when I went to school, I took his cassettes with me. I wanted to see if they worked. I went to see Ted Pitts, who knew everything about computers. I gave him the cassettes and told him about the programs on them.
"I'll try it for you, Jonathan, but I haven't time right now".
"There's no hurry, Ted. Do it when you can."
Donna didn't go ti prison. Perhaps that was because of Peter. Sarah told me all the news when she telephoned. She said, too, that she was not coming home immediately. We ended our conversation with the polite goodbyes. What will happen, I thought, when the politeness stops?
On Saturday I took my rifle to a field outside town and practised my shooting all morning. I was usually very good with a rifle, but I didn't shoot very well that day. Driving home, I promised myself to spend more time practising.
I came home to a quiet , empty house, and because Sarah was not there to tell me to put the gun away, I left it in its special box on the talbe in the sitting-room. A minute later there was a knock at the door and I went to answer it. I had two visitores. They were both dark-haired and dark-skinned, but only one of them was holding a gun.
"What do you want?" I asked. I was surprised but not frightened.
"Those three computer casettes".
"What computer cassettes". I said , but of course I knew.
Translation - Italian Era venerdì mattina. Avevo portato il mio fucile a scuola. Tutti gli studenti volevano tenerlo. Essendo stato anche io un ragazzo, avevo notato che i ragazzi sono attratti dalle cose pericolose. Avevo portato il fucile per insegnargli le leggi di moto. Gli altri insegnanti non condividevano il mio modo di pensare, ma io sapevo che i ragazzi imparavano molto quando si divertivano durante le lezioni.
Io amavo insegnare. Io amavo il mio lavoro. Tuttavia a casa le cose non andavano così bene. Quando sono uscito da scuola quel giorno, mi sentivo stanco e triste. “Otto anni di matrimonio con Sarah”, pensavo, “ e non siamo più felici l'uno con l'altro come un tempo”.
I medici avevano comunicato a Sarah che non avrebbe avuto figli. Senza bambini, io non ero abbastanza per lei. Le desiderava essere madre più di ogni altra cosa al mondo. Ma non ne parlavamo. Non avevamo parlato molto di questo. Quella sera non era diversa. Lei mi salutò e io la salutai, tutto qui.
Io ero seduto alla mia scrivania, stavo leggendo una lettera di mio fratello, quando il telefono squillò. Sarah rispose. All'inizio parlava al telefono con toni pacati ma dopo iniziò ad urlare. La sentii dire : “Oh no!” e “si veniamo immediatamente”. Una volta riagganciato il telefono, venne da me.
“Dobbiamo andare da Donna e Peter. Ora.” Mi disse. Donna era la sua migliore amica. Forse perchè anche Donna non poteva avere figli. Peter Keithly mi piaceva, ma non lo conoscevo molto bene.
“Non stanotte” dissi. “Sono troppo stanco”.
“Non mi importa. Dobbiamo andare. Dobbiamo andare ora!” Rispose piangendo.
“Cosa è successo?” Le chiesi. “C'è stato un incidente?”
“No.. no. Non è per questo. Lei... lei si è cacciata in un guaio, con la polizia.”
“Cosa ha fatto?” le chiesi.
Sarah stava ancora piangendo ma la sua voce ora era più forte. “Lei ha rubato qualcosa”.
“Non è un motivo per piangere”. Le risposi.
“Tu non capisci”, gridò Sarah, “ Non mi stai ascoltando, “lei ha rubato un bambino”.

Andammo da loro. Peter ci aprì la porta. Aveva uno sguardo spaventato. Donna era seduta in un angolo del soggiorno e non disse niente al nostro arrivo.
“Non parla, e non mangia”. Spiegò Peter.
“Cosa è successo?” Gli chiesi. Mi portò in cucina e parlammo. Mi raccontò che Donna aveva preso un bambino nel parco e lo aveva portato con sé in macchina. La polizia aveva trovato il bambino nella macchina vicino la spiaggia. Donna era seduta vicino al mare sotto la pioggia.
“Cosa faremo?”Mi chiese Peter. Aveva lo sguardo perso. “Come se non avessi già abbastanza problemi, e ora anche questo...”
“Problemi?”Dissi. Stavo pensando a Donna.
“Ho fatto una scemenza.”Disse Peter. “C'entra un uomo che ho incontrato in un pub. Mi aveva chiesto se potevo fare dei programmi per le corse dei cavalli. Ho pensato, perchè no? Mi aveva dato pagine e pagine di libri sui cavalli, e una volta fatti i programmi, lui mi pagò.”
“Quindi cosa è andato male?” gli chiesi.
“Bè, una sera , dopo che avevo già consegnato i programmi, vennero da me altri due uomini. Mi dissero che dovevo consegnargli i programmi. Mi dissero che non lavoravano per l'uomo per cui li avevo fatti ma che li volevano.”
“E tu glieli hai dati” Ero meravigliato.
“Si, in un certo senso. Dissero che avrebbero fatto del male a Donna. Ma gli ho dato solo il primo dei programmi che ero riuscito a fare. Loro non erano del settore.” Lui spiegava tutto con linguaggio informatico, ma io non lo comprendevo. Però avevo capito cosa era successo: aveva dato a due uomini pericolosi qualcosa di inutile.
“Sei nei guai.” Dissi piano. “Devi andare via per un po', appena possibile. Farebbe bene ad entrambi”.
Peter annuì. “Donna ama la nostra barca.” disse. “Quanto prima la porterò via per un pò”.
…...............................
Avevamo trascorso il fine settimana da loro, ma domenica avevo deciso di tornare a casa per essere pronto per la scuola lunedì. Sara invece era rimasta con Donna. Mi sembrava giusto. Li ho salutati e all'ultimo minuto Peter mi aveva dato tre cassette. Mi aveva chiesto di ascoltarle a casa. Avevo letto le etichette sulle cassette velocemente e lo avevo ringraziato. Non era proprio il mio genere di musica.
Ero ormai a casa quando mi sono ricordata delle cassette. Avevo deciso di ascoltarne una, ma invece della musica si sentivano strani suoni. Conoscevo quel tipo di rumore. Provai un altra cassetta. Era la stessa. Sapevo cos'era: quelle cassette erano i programmi.
Lunedì a scuola mi sono divertito. Era più semplice lavorare che pensare ai problemi di Peter e Donna. Quando sono tornato a casa, i problemi mi raggiunsero nuovamente.
Peter mi telefonò.
“Jonathan, hai ascoltato le cassette? Sai cosa sono , vero?
“I tuoi programmi?”
“Si. Puoi tenerli al posto mio per qualche giorno? Voglio fare una breve vacanza con Donna, ma non voglio lasciare i programmi a casa.”
“Hai più sentito i due uomini?” chiesi.
“No”.
“Perché non mi hai detto che erano i tuoi programmi?”
“Non volevo che Donna sapesse nulla.” Disse. Mi disse di provarli per vedere se funzionavano, se volevo. Risposi che non ero interessato alle corse dei cavalli. Poi mi ricordai che mio fratello William amava molto i cavalli.
Non parlai mai più a Peter. Due giorni dopo andò a preparare la barca per la vacanza, schiacciò un interruttore e qualcosa avvenne. Sarah mi telefonò. Disse: “La barca ha preso fuoco. Nessuno sa perché. Peter è morto”.
Quella notte pensai a Peter, alla sua morte, e la mattina dopo, quando andai a scuola, portai le cassette con me. Volevo vedere se funzionavano. Andai a trovare Ted Pitts, che conosceva bene i computer. Gli diedi le cassette e gli spiegai dei programmi.
“Li proverò per te, Jonathan, ma non ho molto tempo ora.”
“Non c'è fretta. Ted. Fallo quando puoi.”
Donna non andò in prigione. Forse a causa di Peter. Sarah mi disse tutto quando telefonò. Disse anche che non sarebbe tornata subito. Concludemmo la conversazione con un saluto educato. Qualcosa succederà, pensai, quando la cortesia finirà?

Source text - Italian Le unità da diporto, ad eccezioned ei natanti, debbono essere iscritte nei registri tenuti dalle Capitanerie di Porto o dalle autoristà competenti ed essere in possesso dei prescritti documenti di navigazione (licenza di navigazione e certificato di sicurezza).
La patente nautica è obbligatoria per il comando di unitò da diporto di lunghezza non superiore a ventiquattro metri nei seguenti casi:
-per la navigazione oltre sei miglia dalla costa;
- per la navigazione nelle acque interne e nelle acque marittime entro sei miglia dalla costa qualora si superino i limiti di cilindrata o potenza dei motori fissati per legge (art 39, comme 1, lett. b) del Codice della Nautica da Diporto.
è sempre obbligatoria per il comando di unitò da diporto di lunghezza superiore ai ventiquattro metri.
Ai soggetti portatori di particolari patologie (Vedi all.1, par 2 del D.M. n 146/2008) può essere rilasciata la patente che abilita alla direzione nautica di unitòà da diporto di lunghezza pari o inferiore ai ventiquattro metri nei casi in cui la patente è obbligatoria. Per il comando di unità da diporto battenti bandiera italiana da parte di stranieri nelle acque territoriali italiane vedi l'art.34 del D.M. 146/2008.
Le unità da diporto, con eccezione delle unità a remi e a vela non dotate di motore ausiliario, debbono essere munite della prescritta assicurazione.
La locazione di unità da diporto è il contratto con il quale una delle parti si obbliga verso corrispettivo a cedere il godimento dell'unità stessa, per un periodo di tempo determinato, al conduttore che esercita la navigazione e ne assumenla responsabilità e i rischi. Il locatore deve cosegnare l'unità da diporto con le relative pertinenze in perfetta efficienza, completa di tutte le dotazioni di sicurezza, munita dei documenti necessari per la navigazione e coperta dalla prevista assicurazione.
Il noleggio di unità da diporto è il contratto con cui una delle parti, dietro corrispettivo, si obbliga a mettere a disposizionedell'altra l'unitò stessa per un determinatro periodo di tempo a scopo ricreativo in zone marine o acque interne di sua scelta.
L'unità noleggiata rimande nella disponibilità del noleggiante alle cui dipendenze resta anche l'equipaggio. Il noleggiante è obbligato a mettere a disposizione l'unità da diporto in pefetta efficienza, munita dei prescritti documenti e della prevista assicurazione.

Boat driving license is required for the control of pleasure craft with a length not exceeding 24 m in the following cases:
for navigation over six miles from the coast or for navigation with a personal watercraft;

Pleasure crafts , with the exception of rowing and sailing units without an auxiliary motor, must be equipped by the required insurance.
Pleasure crafts, is a contract under which one of the two parties binds itself, against payment of a charge and for a certain period of time, to transfer the enjoyment of the yachting vessel to the hirer, who is in charge of the navigation and assumes the responsibility and risks of it. The proprietor must supply the pleasure craft and the relevant appurtenances in perfect efficiency, complete with all safety equipment, provided with the necessary documents for the navigation and insured.
Renting of pleasure crafts is the contract under which one of the two parties binds itself, for a money consideration, to place the pleasure craft at the other's disposal for entertaining purposes in marine areas or inland waters of its choice for a certain period of time. The rented vessel remains at the disposal of the hirer, who also employs the crew. The rented vessel remains at the disposal of the hirer, who also employs the crew.
