Novas regras prevêem que empresas terão de ceder horários para rivais que estão de fora

A Agência Nacional de Aviação Civil (Anac) divulgou ontem as novas regras para redistribuição de slots (vagas para pouso
e decolagem) em aeroportos concorridos. As mudanças, colocadas em consulta pública, prevêem que as empresas que
hoje operam em aeroportos saturados - como Congonhas, em São Paulo - cedam, a cada dois anos, slots para empresas
que estão fora do aeroporto.
A regra também prevê a transferência de slots entre companhias que operam no aeroporto saturado a partir de um critério
de eficiência operacional: os menos eficientes perdem e os mais eficientes são premiados com mais slots. A nova regra
será válida para qualquer aeroporto saturado, mas o grande foco é Congonhas, o único que hoje opera acima do limite de
90% de sua capacidade de infra-estrutura aeroportuária.
Para a diretora-presidente da Anac, Solange Vieira, a regra trará mais concorrência e eficiência ao setor. "Uma companhia,
para ser grande e concorrer em nível nacional, tem de passar por Congonhas. É lá onde estão as maiores rentabilidades",
disse.
Se aprovada, a regra vai permitir a entrada de WebJet, Trip e Azul em Congonhas. Para se habilitar, porém, a Azul precisa
acelerar a sua entrada no mercado e contar com a morosidade da burocracia. Pelas regras apresentadas, só poderá se
habilitar quem estiver no mercado há pelo menos seis meses. E, pelo cronograma da agência, a convocação para as
empresas se habilitarem se dará três meses depois da publicação da regra no Diário Oficial da União, o que está previsto
para acontecer entre dezembro e fevereiro. Quanto mais contestação houver durante os dois meses de consulta pública,
mais tempo vai levar para a diretoria da agência aprovar a redação final da nova regra. Para que as empresas tenham
tempo de se adaptar, as mudanças serão implementadas doze meses após a publicação no Diário Oficial.
"Temos todo o interesse em entrar em Congonhas e vamos fazer o que estiver ao nosso alcance para participar dessa
redistribuição", afirmou o diretor de relações institucionais da Azul, Adalberto Febeliano. A Azul corre contra o tempo para
estrear no mercado em dezembro e, se possível, até mesmo antes. O executivo aplaudiu a iniciativa das novas regras, mas
observa que elas não garantem o crescimento das empresas novatas. "Preciso analisar com mais calma mas, ao que
parece, quem entra, entra com muito poucos slots, e a perspectiva de crescimento para os entrantes é muito limitada."
A medida provocou revolta nas empresas que já atuam em Congonhas. Segundo fonte do setor, a Gol/Varig e a TAM, que
detêm, respectivamente, 46,6% e 42,6% dos slots disponíveis em Congonhas, já têm em mãos pareceres jurídicos
contrários à medida e pretendem recorrer à Justiça. Procuradas, as duas empresas não quiseram se pronunciar.
"Preferimos aguardar para avaliar com mais profundidade antes de fazer qualquer manifestação", afirmou a Gol. Caso haja
a abertura de Congonhas para três novas empresas, TAM e Gol perderão 10% de seus slots. Isso representa 12 vôos
diários para o grupo Gol e 11 para a TAM.
A OceanAir, que detém 4,4% dos slots e há muito vem reclamando de falta de oportunidade de crescimento em Congonhas,
também sairá perdendo. "Vai ser uma briga feia. Eu não tenho disponibilidade para ceder slots", disse o vice-presidente da
OceanAir, Jorge Alberto Vianna. "Tenho 22 slots e precisaria de pelo menos 36 para que a operação seja rentável."
Para um alto executivo do setor, que preferiu não se identificar, a retirada de slots de quem já opera em um aeroporto não
acontece em lugar nenhum do mundo. "Isso é ridículo. É quebra de contrato."
Entre os argumentos que as empresas pretendem apresentar está a decisão do juiz Luiz Roberto Ayoub, responsável pelo
caso Varig, que considerou os slots como um ativo da companhia no edital do leilão judicial. Para Solange, a chiadeira era
esperada. "É natural que as empresas atuantes não achem a melhor medida do mundo. Nenhum empresário gosta de mais
concorrência."
Para o professor de transporte aéreo da UFRJ, Respício do Espírito Santo Junior, as novas regras são uma "evidência da
falta de planejamento do poder público sobre a capacidade dos aeroportos". Na opinião dele, ao invés de redistribuir e tirar
slots de quem já tem, as autoridades deveriam aumentar a capacidade de pousos e decolagens em Congonhas.
Desde o acidente da TAM, em junho de 2007, a capacidade de Congonhas foi reduzida de 46 pousos ou decolagens para
34. "O acidente da TAM não é razão para a redução dos slots. Não houve justificativa operacional, foi só uma decisão
política."

The National Aviation Agency (Anac) released the new rules about slot assignments (take-off and landing airport spaces) disposing that companies currently operating in saturated airports –such as Congonhas in São Paulo - give up slots for airlines shut out of these airports every two years.
The rule also provides the transfer of slots among companies operating in the saturated airport following an operational efficiency criterion: less efficient airlines lose and more efficient airports gain slots.
The new rule will apply to all saturated airports, but the main focus is Congonhas, the only airport operating above 90% of its airport infrastructure. For Solange Vieira, Anac´s vice-president, the rule will bring about more competition and efficiency. “In order for an airline to be big and compete in a country-wide level, it will have to stop in Congonhas. That´s where the biggest profit margin is located”, she said.
If approved, the new rule will allow WebJet, Trip and Azul airlines to operate in Congonhas. In order to qualify, however, Azul will have to accelerate its entry in the market and deal with the bureaucracy´s slow pace. According to the rules in the release, only companies which have been operating for at least 6 months will qualify. In addition, according to the agency´s timechart, the draft release for the qualification of new companies will be issued three months after the new rule´s publication in the Federal Official Gazette (Diario Oficial da União) expected to happen between December and February.
The more squabbling occurring during the two months of public consultation, the longer it is going to take for the agency´s board of directors to approve the new rule´s final draft. In order to allow time for the companies to adapt, the changes will be implemented twelve months after publication in the Official Gazette.
”We are very interested in operating in Congonhas and we will do everything possible to take part in this redistribution”, said Adalberto Febeliano, Azul´s director of institutional relations. Azul is running against time to make its debut in the market in December, even earlier, if possible. The executive praised the initiative of new rules, but remarked that they dont assure the growth of new companies.
”I have to analyze in more detail, but, apparently, the companies coming in will have very few slots, and the growth perspectives for the new companies is very limited”. The measure upset companies already operating in Congonhas. According to industry sources, Gol/Varig and TAM which respectively have 46.6% and 42.6% of available slots in Congonhas, already have legal opinions contrary to this measure and intend to file suit.
After they were contacted, the two companies did not want to voice an opinion. “We prefer to wait and evaluate in more depth before we give any position”, stated Gol. If Congonhas is opened to three new companies, TAM and Gol will lose 10% of its slots. This represents 12 daily flights for the group and 11 for TAM. OceanAir which holds 4.4% of the slots, has been complaining for a long time about the lack of opportunity to grow in Congonhas, will also lose. “It is going to be an ugly fight. I am not able to give up slots”, said Ocenair´s vice-president, Jorge Alberto Vianna. “I have 22 slots and I would need at least 36 for the operation to be profitable”.
For a top industry executive, who preferred not to give his name, the withdrawal of slots for a company already operating in an airport does not happen anywhere in the world. “This is ridiculous. It´s a breach of contract”. Among the arguments the companies intend to present, is the decision by Judge Luiz Roberto Ayoub, responsible for the Varig case, considering slots as a company asset in the bidding notice. For Solange, the outcry was to be expected. “It is natural that operating companies dont think this is the best measure in the world. No entrepeneur likes more competition”.
For Respício do Espírito Santo Junior, air transportation professor at UFRJ (Federal University Rio de Janeiro), the new rules are “evidence of lack of planning on airport capacity by the government”. In his opinion, instead of redistributing and take slots away from who has them, the authorities should increase the take-off and landings capacity in Congonhas. Since the TAM accident in June 2007, the capacity of Congonhas was reduced to 46 take-off/landings to 34. “The TAM accident is no reason for slot reduction. There was no operational justification, it was just a political decision”.
NEW RULES
Who has, loses: Companies operating in saturated airports will have to give up slots to the new entrants every two years. The quantity depend on the number of operators and new entrants, within a 20% limit: 6.
Performance criterion: Every two years there will be a redistribution of slots among companies operating in a saturated airport. The companies more efficient in terms of punctuality and regularity with the best operational safety indices (incident and accident frequency) will gain slots. Who is operating below the average, loses.
How it is today: By the current rules, companies only lose slots if they voluntarily give them up, if they stop operating, if they are idle for more than 30 days, or if they cancel more than 20% of flights in the use of a slot during 90 days.

O “Módulo de Carga da SOLUÇÃO” deverá ser capaz de carregar todos os tipos de dados listados no item 4.1, incluindo seus respectivos metadados. Como metadados entende-se toda a informação adicional relativa aos parâmetros de aquisição do dado, processos de certificação aos quais foi submetido, diferentes status, como também as feições geográficas às quais está associado, e que deverão ser carregadas nas bases espaciais da SOLUÇÃO. Hoje, ato de “carregar” para alguns dados significa gravá-los em disco, outros gravá-los nas fitas gerenciadas pelo TSM e para outros gerenciar seu armazenamento na fitoteca. A proponente terá liberdade de na sua proposta usar ou não o TSM ou outra solução de gerenciamento, desde que resguarde a capacidade e flexibilidade de gerenciar o armazenamento em fita ou em disco.
A empresa deverá incluir no Capítulo IV, Item Requisitos de Negócio, a descrição detalhada dos procedimentos de preparação e de carga para cada tipo de dado listado no item 4 deste documento. Provando capacidade de atender aos requerimentos solicitados neste item.
Os procedimentos de carga devem se comunicar com os “Módulos de Gestão”, responsável pelo registro e pela priorização do que será carregado. Está previsto para a SOLUÇÃO, o acesso remoto feito por usuários lotados no Escritório Central da ANP com poderes para determinar prioridades.
O “Módulo de Carga” deverá se comunicar com o “Módulo de Controle de Qualidade”, responsável por certificar previamente o dado destinado à carga, e por garantir a qualidade do resultado final. Considera-se que o resultado final esperado para o processo de carga seja um dado armazenado no meio físico adequado, associado aos objetos espaciais devidamente posicionados e com seus direitos de acesso corretamente atribuídos.
No Sistema atual, os dados estão assim distribuídos, quanto aos meios físicos de destino:
- Na base de dados Oracle ou equivalente são armazenados os metadados e os dados de produção;
- No geodatabase, as coordenadas de tiro, de receptores, e de CMPs e os dados culturais;
- Nos discos rígidos encontram-se as curvas de perfis convencionais, os perfis LWD e MWD, os arquivos de posicionamento e navegação em formato UKOOA, os dados sísmicos pós-empilhamento, os arquivos de velocidade, os dados de levantamentos gravimétricos, magnetométricos e eletromagnéticos, os dados ambientais e qualquer tipo de dado que venha a ser tratado como objeto de arquivamento.
- Na fitoteca são armazenadas as fitas de levantamentos sísmicos pré- empilhamento e as mídias originais entregues pelos concessionários e pelas EADs, mas a parte de software da SOLUÇÃO deve estar preparada para armazenar este tipo de dado tanto em fita, quanto em disco.
Translation - English 6.3.3. Uploading the data
The “SOLUTION’S Upload Module” should be able to upload all the data types listed in item 4.1, including their respective metadata. Metadata are understood as all additional information related to the data acquisition parameters, certification processes to which it was submitted, different status, as well as the geographical features to which it is associated and that should be uploaded in the spatial bases of the SOLUTION. Currently, to some people, the “upload” operation means to write these data on disk, to other people it means to write it on tapes managed by the GSM, while to others it means managing its storage in the tape library. The applicant will be free to use or not to use the TSM, or to specify another management solution in its proposal, as long as it assures the ability and flexibility of managing the storage on tape or on disk.
The company should include in Chapter IV, Business Requirements Item, the detailed description of the setup and load procedures for each data type listed in item 4 herein, proving that it is able to meet the requirements specified in this item.
The upload procedure will communicate with the “Management Modules”, responsible for the recording and priority of the data to be uploaded. The SOLUTION provides users allocated in the ANP’s Central Office with the capacity to determine priorities when accessing it remotely.
The “Upload Module” should be able to communicate with the “Quality Control Module”, responsible for the pre-certification of the data to be uploaded, and to guarantee the quality of the final result. It is assumed that the final result expected of the upload process will be data stored in the proper physical media, associated to the spatial objects correctly positioned with their properly configured access rights.
In the current System, with respect to the physical destination media, the data are distributed in the following ways:
- The metadata and the production data are stored in Oracle or an equivalent data base;
- The shot, receptors and CMP coordinates and the cultural data are stored in the geodatabase;
- The hard disks contain the conventional profile curves, the LWD and MWD profiles, the positioning and navigation files in IKOOA format, the pre-stacking seismic data, the speed files, the gravimetric, magnetometric and electromagnetic survey data, the environmental data and any type of data that may be handled as a storage candidate.
- The tape library contains the tapes of seismic pre-stack surveys and the original media by the concessionaires and by the EADs but the SOLUTION’s software should be able to store this type of data on tape as well as on disk.

Eventually I went to work for an international organization where I set up computer systems in German and English.
I had the opportunity to do simultaneous translations at an international investment seminar, mostly German into English and vice-versa.
After moving to the US, I continued in the IT activity, but my language abilities led me to random assignments in Brazil.
