WHEREAS
(A) On 20 March, 2008, … and … entered into a components delivery agreement (”Agreement”) for supply of certain parts needed to manufacture in … the … Army wheeled armoured conveyor program …
(B) Article 4.2 of Law 10 September, 1999 on particular compensatory agreements in relation to supply agreements for purposes of defence and national security provides that a supply agreement for weapons and military equipment with a foreign supplier becomes valid upon concluding an offset agreement and that such offset agreement should be concluded no later than 60 days from the date of signature of the supply agreement;
(C) Such term is expired, and therefore the Parties wish to re-execute the Agreement by means of this Amendment
NOW THEREFORE, THE PARTIES HEREBY AGREE AS FOLLOWS:

PREMESSO CHE
(A) il 20 marzo 2006, la … e la … stipulavano un Contratto di Fornitura di parti componenti (in seguito denominato “il Contratto”) per la fornitura di taluni pezzi necessari alla fabbricazione in ... del … destinato al programma relativo al blindato su ruote dell’esercito …;
(B) l’articolo 4.2 della legge del 10 settembre 1999 sugli accordi speciali di compensazione relativi a contratti di fornitura a scopi di difesa e di sicurezza nazionale stabilisce che un contratto di fornitura d’armi e d’apparecchiature militari stipulato con un fornitore estero acquisti validità previa sottoscrizione, entro 60 giorni dalla data della firma dello stesso contratto, di un accordo di compensazione;
(C) scaduto pertanto il termine, le Parti intendono rendere il Contratto nuovamente esecutivo mediante il seguente Atto aggiuntivo;
TUTTO CIÒ CONSIDERATO, CON IL PRESENTE ATTO CONVENGONO QUANTO SEGUE:
