Source text - English La Declaración Maestra estipula que la Junta Examinadora adoptará reglas, normas y pautas arquitectónicas para las estructuras, zonas ajardinadas y otras mejoras, las que estarán sujetas a posibles modificaciones a discreción de la Junta. Se prevé que las normas podrán sufrir diversas modificaciones respeto al diseño de distintas propiedades inmobiliarias o propiedades adyacentes. Las normas podrán imponer diferentes condiciones a algunos lotes en función de factores topográficos, de visibilidad u otros. Estas normas entrarán en vigor en el momento en que sean adoptadas por la Junta, la que interpretará e implementará las disposiciones de la Declaración Maestra mediante el establecimiento de normas y procedimientos para el diseño arquitectónico y la ubicación de los edificios, la armonía de los colores, acabados y materiales exteriores y la jardinería y elementos similares que pudrieran emplearse en la propiedad. También podrán prohibir o restringir el uso de ciertos diseños, colores y materiales, el uso y ubicación de vallas, y el uso de ciertos tipos de árboles o plantas.
Las normas podrán establecer una tarifa razonable para el trámite de las solicitudes presentadas, así como estipular el momento y la manera en que se deberán para dichos cargos. Por otra parte, las normas podrán exigir que, en el momento de presentar una solicitud, se deposite una suma en efectivo a determinarse; a fin de garantizar la buena conclusión de las obras, de acuerdo con los dibujos, planos y especificaciones. Una vez que se determine que la obra terminada se ajusta a los dibujos, planos y especificaciones, la Junta Examinadora reintegrará la suma depositada, menos el monto que se haya gastado para hacer valer sus derechos bajo la presente.
Translation - Spanish The Property Owners Agreement provides that the Review Board shall adopt rules, regulations and architectural guidelines covering structures, landscaped areas and other improvements, all of which are subject to possible modification at the Board´s discretion. It is anticipated that the regulations may undergo varied changes with respect to the layout of different plots of real estate or adjacent properties. The regulations can impose different conditions on some lots based on topographical factors, visibility, etc. These regulations shall take effect whenever they are adopted by the Board, which shall interpret and put into effect the provisions of the Property Owners Agreement. The Board shall establish the regulations and procedures for architectural designs and building placement, color harmony, exterior furnishings and materials as well as landscaping and similar elements which might be used on the property. The Board can also forbid or restrict the use of certain designs, the use and placement of fences and the planting of certain trees and plants.
The regulations can establish a reasonable fee for processing filed applications and indicate the time and manner for payment of said fees. Moreover, the regulations can require the payment of a cash deposit at the time the application is filed to assure the satisfactory completion of the work in keeping with the drawings, plans and specifications. Once it is determined that the finished work complies with the drawings, plans and specifications, the Review Board will refund the money deposited less any amounts that may have been spent to validate its rights therein.
