Relations between the account holder(s) and/or safe-deposit holder(s) and/or attorney(s) (hereinafter the “Account holder(s)” or the “Attorney(s)” or the “Client”) and the Bank (hereinafter the “Bank”) shall be governed by these general terms and conditions (hereinafter the “General Terms and Conditions”), as from time to time amended, and by any special agreements, including the account opening documents, powers of attorneys and authorisations and agreements on distance transactions and consultations between the Bank and the Client. The General Terms and Conditions and the special agreements determine the terms governing the provision of services by the Bank as well as the rights and duties of the parties.
1. Rules of conduct
In accordance with the law of 13th July 2007 on markets in financial instruments (“MiFID law”), the Bank shall comply, in its relationship with the Client, with the various rules of conduct depending on the category into which the Client will be classified (Private Client, Professional Client or Eligible Counterparty). By default, the Client will be treated by the Bank as a Private Client and as such will benefit from the highest level of legal protection with regard to investment services provision and related activities performed by the Bank. Any new or existing Client will be informed if he is to be classified in a category other than that of a Private Client, in accordance with the MiFID law.
The Client may, under certain conditions, in compliance with the procedure defined by the MiFID law and, subject to a written declaration and the Bank’s approval, request a change of category at any time, which shall involve giving up a certain degree of protection offered by the Bank’s rules of conduct. The Bank will specify the scope of the reduction of the Client’s protection and will inform him in writing at the time of the change in category.

Отношения между держателем(-ями) счета и/или держателем(-ями) депозитных сейфов и/или уполномоченным(-и) лицом(-ами) (далее - «Держатель(-и) счета» или «Уполномоченное(-ые) лицо(-а)» и Банк (далее – «Банк») регулируются настоящими условиями работы (далее – «Условия работы»), с периодически вносимыми изменениями, а также любыми специальными соглашениями, включая документы на открытие счетов, доверенностями или документами, наделяющими полномочиями, или условиями долгосрочных сделок или договоренностями между Банком и Клиентом. Условия работы и любые специальные соглашения определяют условия предоставления услуг Банком, а также права и обязанности сторон.
1. Правила поведения
В соответствии с Законом от 13 июля 2007 года «О рынках финансовых инструментов» («Директива о рынках финансовых инструментов»), Банк обязуется в своих отношениях с Клиентом солюдать ряд правил поведения, соответственно категории, к которой относится Клиент по классификации (Частный Клиент, Профессиональный Клиент или Полноправный Контрагент). По умолчанию Клиент рассматривается Банком как Частный Клиент и, в качестве такового, наделяется преимуществами самой высокой степени юридической защиты в отношении предоставления инвестиционных услуг и относящихся к ним действий, осуществляемых Банком. Любой новый или существующий Клиент будет проинформирован об отнесении его к категории, отличной от Частного Клиента, соответственно Директивы о рынках финансовых инструментов.
Клиент, при определенных условиях, соответственно процедуре, установленной Директивой о рынках финансовых инструментов, на основании письменного заявления и согласования Банка, может в любое время потребовать изменения категории, что включает отказ от определенной степени защиты, предлагаемой правилами поведения Банка. Банк может определить степень снижения защиты Клиента, о чем проинформирует Клиента во время изменения категории.
