A) HABEAS CORPUS
Habeas Corpus is a Latin phrase, which means, “that you may have the body” or “have the body delivered.” It has become one of the basic devices to protect civil liberties. It can be defined as an application for immediate release based on grounds of illegality of arrest or detention or failure to observe the formalities as provided for by law. The habeas corpus is a writ by which the legal authority under which a person may be arrested or detained can be challenged.
i) The competent court
The Code states that it is the High Court that has the jurisdiction to hear and determine an application for immediate release based on the principle of Habeas Corpus. The President of the High Court of the place of arrest or detention of a person or any other Judge of the said Court has jurisdiction to hear and determine applications for immediate release based on the grounds of illegality of arrest or detention or failure to observe the formalities as provided by law.
He also has jurisdiction to deal with applications filed against administrative remand measures. The person who may file the application is either the person arrested or detained or on his behalf by any one else. It is an unstamped application. The application is supported by an affidavit which must state the identity of the applicant and where necessary, that of the person under arrest or detention. The place of arrest or detention should be stated including a precise summary of the facts constituting the alleged illegality.
ii) The Procedure of Habeas Corpus
The application in four (4) copies is filed at the registry of the said court but addressed to the President of that particular High Court. He orders the custodian of the person detained to produce him on the day and hour mentioned in the order alongside with the documents authorizing the arrest or detention.
He also forwards a copy of the application and the order to the Legal Department for its submissions. The President of the High Court decides and gives a judgment on the merits with or without the presence of the detainee. Any interlocutory ruling on a preliminary issue is not subject to appeal unlike judgment on the merits, which is subject to appeal.
The time limit within which to appeal is five (5) days, with effect from the date following the day on which the decision was given. The appeal must follow the ordinary requirements and procedure before the Court of Appeal.
Where an appeal is lodged, the case file is forwarded to the President of the Court of Appeal within five (5) days following the notice of appeal. Then, the President of the said court or any other judge appointed by him hears and determines the appeal within the time-limit of ten (10) days.
It is essential to note that the procedure of Habeas Corpus is also applicable to measures of deprivation of liberty taken against any person who has been acquitted, discharged or released by an ordinary court of law or by a special tribunal.
When all is said and done, Habeas corpus is the most famous product of the code for it ensures the basic liberty of freedom from unlawful arrest or detention if is procedural, a method whereby the high Court can inquire whether any person is detained lawfully and if the detention is not justified by law that person will be released. The machinery may be set in motion by the person who is detained or by anyone else on his behalf applying for his release. The conception is that if you get to know that someone is illegally detained, you can get the matter before the High Court, and question the official who orders his detention and ask for his immediate release.
B) EVIDENCE BY MEMBERS OF GOVERNMENT AND REPRESENTATIVES OF DIPLOMATIC MISSIONS
The Code provides that when such very important personalities are invited to give evidence in court as witnesses, the following rules are observed. They may, at their request or at the request of the Legal Department, be heard in camera.
Evidence given by Representatives of Diplomatic Missions is in conformity with the principles of International Conventions ratified by the Republic of Cameroon.
i) The procedure
The Code has also provided for the procedure to be followed. The letter inviting a Representative of a Diplomatic Mission to testify is addressed to him through the Minister in Charge of External Relations. A questionnaire is addressed to him where he is willing to give evidence but unable to appear, through the Minister in Charge of External Relations. He takes oath in writing and his reply is returned in a sealed envelope to the requesting Magistrate through the Minister in Charge of External Relations who does not have knowledge of its contents.
C) CHALLENGE AGAINST A MAGISTRATE OF THE BENCH OR A JUDGE
It is necessary to note that, it is a procedure that is intended to prevent a magistrate of the bench or a judge from hearing a matter as provided for by the Code. But a magistrate of the Legal Department cannot be challenged. Challenge can be based on any of the following reasons: Consanguinity or family relationship, marriage, inheritance, dowry, claim, debt, established interest, proceedings in which the judicial officer has previously been an arbitrator or counsel or witness, proceedings being heard by a spouse, friendship, hatred towards any of the parties, doubt on the judicial officer’s impartiality.
Again any judicial officer who thinks that he can be challenged for any of the above-mentioned reasons should abstain from hearing the matter, and inform his hierarchy.
i) The procedure
The Code provides that the application stating the challenge is in writing and is forwarded in two (2) copies:
- to the president of the Court of Appeal, if it is directed at a Judge of the Court of Appeal other than the President, or a judicial officer of a lower court.
- to the president of the Supreme Court if it is directed at the President of a Court of Appeal or a member of the Supreme Court other than its president.
- The applicant also forwards a copy of the application to the magistrate concerned.
It should be noted that the application, under pain of being inadmissible, must state the names of the Magistrate(s) concerned and the grounds thereof, together with supporting evidence.
The President of the Supreme Court or the President of the Court of Appeal, as the case may be, after receiving the explanation of the magistrate concerned and the submissions of the Legal Department, gives a ruling without costs.
As soon as the magistrate receives a copy of the application, the proceedings are stayed until a ruling is given on the application. Where the application is granted, the Magistrate no longer hears the case.
However, where the application is dismissed, the applicant may, without prejudice to the award of damages, where necessary, be ordered to pay a civil fine of from 100.000 to 500.000frs. Such a ruling is notified to the applicant and to the magistrate concerned.
D) SETTLEMENT OF CONFLICTS OF JURISDICTION
The Court of Appeal and the Supreme Court are competent to hear and determine conflicts of jurisdiction, depending on the courts concerned.
This occurs where two Examining Magistrates, two different courts of First Instance or two High Courts within the jurisdiction of the Same Court of Appeal or within the jurisdiction of two different Courts of Appeal are seized with the same offence and they assume or decline jurisdiction, the conflict thus created is resolved.
The Code states that where two Examining Magistrates within the jurisdiction of the same Court of Appeal are seized of the same offence and they assume or decline jurisdiction, the conflict thus created is resolved by the Court of Appeal.
Furthermore, where two different Courts of First Instance or two High Courts of the jurisdiction of the same Court of Appeal assume or decline jurisdiction, the conflict thus created is resolved by the Court of Appeal.
However, where two Examining Magistrates or two Courts of First Instance or two High Courts within the jurisdictions of two different Courts of Appeal are seised of the same offence and they assume or decline jurisdiction, the conflict thus created is resolved by the Supreme Court. The Supreme Court has jurisdiction to deal with conflicts of jurisdiction resulting from two final judgments delivered respectively by an ordinary court and a special court, the judgments which undermine the normal course of justice. It is the same where two ordinary or special courts deliver the final judgments.
The Supreme Court is seized of the matter by way of a reasoned application at the instance of the Legal Department or of any other party.
The decision setting the conflict is notified to all the parties and is not subject to appeal.
E) TRANSFER OF A CASE FROM ONE COURT TO ANOTHER
The Code provides that in this situation, the Supreme Court can, on the ground of suspicion or in the interest of public policy, withdraws a case from any court and transfer it for trial to another court of the same jurisdiction or appoint magistrates within the jurisdiction of a different Court of Appeal to hear and determine the matter.
The application may be made by the Legal Department or by any other party. The filing of an application does not, on its own, stay the hearing of a case. However, the President of the Supreme Court may order the President of the court in which the matter is registered to stay the hearing of the matter.
The Registrar-in-Chief of the Supreme Court causes all rulings on an application for transfer to be notified to the court concerned and to the parties.
F) FIXED FINES
It is stated in the Code that a fixed fine is a pecuniary sentence applicable to simple offences, the quantum of which is determined in advance by law.
The Judicial Police officers are competent to collect fixed fines. However, agents of the Judicial Police and any persons empowered to collect fixed fines and who are in possession of a special counter foil receipt book numbered and initialled by the competent Legal Department, can carry out their duties.
The rate for fixed fines is fixed according to the class of the simple offence as follows: -
(a) 1.000frs for the first class
(b) 2.400frs for the second class
(c) 3.600frs for the third class
(d) 25.000frs for the fourth class.
The payment of fixed fines is optional and the person preferring the charge must inform the offender. The State Counsel is competent to declare a fixed fine as illegal and ordered its annulment.
The payment of a fixed fine puts an end to prosecution. One should note that Judicial Police officers have been empowered to collect and pay fixed fines into the public treasury. The State Counsel is empowered to annul fixed fines and the generalisation of the immediate recovery of fixed fines, under the Code.
G) TRIAL OF SIMPLE OFFENCES
The Code has provided for trial of offenders who have either refused to pay a fixed fine or where the readjustment results in an increase of the fixed fine and the offender refuses to pay the differences, or where any assessment of the fixed fine is lower than the amount prescribed. This constitutes a simple offence of the 4th class.
In the above situations, that is in the event of non-payment of the fixed fines, the State Counsel may, as soon as he receives the report, commence prosecution and the Court of First Instance is Competent to entertain such action as under classes of simple offence. According to the Cameroon Penal Code there are four (4) classes of simple offence punished with the following penalties: -
(a) First class: Fine of two hundred to twelve hundred francs (200-1200frs)
(b) Second class: Fine of from fourteen hundred to two thousand four hundred francs (1400 - 2400frs)
(c) Third class: Fine of from two thousand six hundred to three thousand six hundred francs (2600-3600frs)
(d) Fourth class: Fine of from four thousand to twenty-five thousand francs (4000-25.000frs) or imprisonment for from five to ten days or both such fine and imprisonment.
H) OFFENCES COMMITTED DURING A COURT SESSION (CONTEMPT OF COURT)
It is important to note that the Code provides that the Presiding Magistrate ensures the maintenance of order in court and directs the proceedings. Also he has, for this purpose, at his disposal the Forces of Law and Order for the duration of each court session. He can therefore punish any person who disturbs the courts session, which is known as contempt of court.
The essence of contempt of court is said to be action or inaction amounting to interference with or obstruction to, or having tendency to interfere with or obstruct, the due administration of justice. Therefore, contempt of court may be committed either in the face of the court “in facie curiae” i.e. in the presence of the court, or outside the court. This is because the Code states simply that offences committed during court sessions, are taken as content of court.
i) The procedure
In fact, offences committed during a Court session are tried following a special procedure. Where the offences committed are simple offences and misdemeanours, the Presiding Magistrate immediately prefers a charge based on the facts, hears the offender, the witnesses and the Legal Department, and then delivers judgment.
However, where the offence committed is a felony, the Presiding Magistrate records the statement of the offender, orders his arrest and orders that he be taken to the State Counsel, who proceeds as provided by law. Contempt of court is punishable because it may be an affront to the judge or disturbance of the proceedings.
Thus, a court of record has inherent power to punish the offender summarily in order to prevent abuse of its proceedings. This inherent jurisdiction is to punish for contempt and not to try for the purpose of finding the contemnor guilty.
I) RECONSTITUTION OF DOCUMENTS
The Code provides for occasions where the original of a judgment has been lost to be reconstituted. The certified copy of a lost or destroyed judgement becomes the original. On the orders of the President of the court that delivered the judgment, its custodian hands over the copy to the registry of the court.
From the original so reconstituted, the registrar delivers a copy of the judgment to the original holder without costs. However, where there is no certified copy of a lost or destroyed judgment, the original is reconstituted from the record book by the court that delivered it. Also where a document in a case file or the whole case file is missing, the President of the court seized of the matter or any party may cause the said document or case file to be reconstituted.
J) PRIVILEGED PROCEEDINGS
The law has provided for a precise procedure to be followed against the judicial police officers, judicial and legal officers as well as administrative authorities for offences committed in the discharge of their duties. They are tried according to a special procedure.
It is provided that where a judicial or legal officer is likely to be charged with committing an offence, the competent Procureur General requests the President of the Supreme Court to appoint an investigating magistrate as well as three other magistrates of a grade at least equal to that of the magistrate incriminated.
If it is necessary, they hear and determine the matter at first instance. Also the President of the Supreme Court should, in addition, indicate the town wherein the case should be heard.
The competent Procureur General and the aggrieved party can file a complaint before the President of the Supreme Court. The civil party may demand a civil claim.
The presiding magistrate in the matter should personally conduct the preliminary inquiry (PI) throughout the national territory. And in the event of an appeal, the matter is heard either by the Judges of the Supreme Court sitting as a collegiate bench or by a joint session of the benches of the Supreme Court depending on the grade of the magistrate prosecuted.
The administrative authorities like the Governor, the Senior Divisional Officer, the Divisional Officer or the District Head, are also tried for offences committed.
Where a Governor of a Province has committed a felony or a misdemeanour, within or outside the performance of his duties, the Procureur General at the competent Court of Appeal addresses a report to the President of the Supreme Court who transfers the matter to a competent court. Prosecution, investigation and trial of a Governor is assigned to a jurisdiction other than that of the province where the Governor performs his duties.
Furthermore, where a Senior Divisional Officer or any other Head of Administrative unit or a Judicial Police officer has committed a felony or misdemeanour even if unconnected with the exercise of his duties, the State Counsel transmits the case file to the competent Procureur General who seizes the President of the Competent Court of Appeal. He in turn designates both the Legal Department in charge of instituting prosecution and the competent trial court to hear and determine the matter. Note should be taken of the fact that prosecution, investigation, and trial are assigned to jurisdictions other than those of the division, Sub-Division, or District where the accused performs his duties.
The take home message as provided in the Code is that all judicial or legal officers and all administrative authorities must change their altitudes toward the public, because the state no more shoulders responsibility for individual human right abuses. This wide range of liberties for compensation for illegal detention or human right abuse are a challenge to administrators who previously believed in preventive or administrative detention in the name of public order or peace. Thus, persons whose liberties/rights stand to be deprived must be given a chance to defend themselves.
K) EXTRADITION OF ACCUSED PERSONS OR CONVICTS
In the investigation and court examination of any offence, there may arise a need to receive legal assistance from the judicial organs of foreign states. Cooperation on the question of providing legal assistance is determined by specific situations in which the criminals or the victims and witnesses, or else material evidence of the offence are located on the territory of other states. This calls for the development and improvement of legal forms of cooperation among states in the fight against offences, including the extradition of criminals.
The measures are carried out by both international and national legal means. However, the Sovereign right of states remain inviolable, since the basic problems involved in offence control relate to domestic competence of each state.
The Code has extensively treated this important subject matter. It provides for conditions, procedure and effects of extradition. All in all, extradition is an act whereby a requested state hands over a foreigner found in its territory to a requesting state in order that he be prosecuted for one or more specified offences of ordinary Law or subject him to a term of imprisonment passed against him after a criminal trial.
This particular procedure is usually based on the principles of reciprocity or on the respect of instruments signed and ratified by the member states.
It should be pointed out that legal relations associated with the effecting of legal assistance on criminal matters is governed by the norms of multilateral or bilateral international conventions related to control of offences. The extradition of criminals represents an act of legal assistance by one state (the requestee) to another (the requestor) with the aim of carrying out criminal prosecution, finding and arresting a suspected criminal in order to bring him to court or for executing the sentence.
The Code states that the President of the Republic may, by decree, order the extradition to a foreign government applying for it of any foreigner charged with or convicted of an offence in the requesting state.
i) Conditions of extradition
It is stated in the Code that except where otherwise provided by law, no Cameroonian citizen may be extradited. However, before extradition of any foreigner, the following conditions must be fulfilled. The following acts may serve as grounds for extradition: by laws of the requesting state and of Cameroon, either constitute an offence punishable with a minimum sentence of loss of liberty of not less than two (02) years, for which prosecution is not barred by prescription, amnesty or otherwise, or consist of a term of loss of liberty, which is still legally enforceable within six (06) months at least, notwithstanding imprisonment in default of payment.
Also, by Cameroon law, constitute an ordinary law offence, from the circumstances and facts show that extradition is not requested for political, religious or racial reasons, or based on the nationality of the person concerned.
Furthermore, felonies and misdemeanours, which are not directed against any kind of government, are considered as common law offences and may justify extradition. Again, offences of universal jurisdiction provided by international conventions and ratified by Cameroon are considered as ordinary law offences.
Thus, with regard to persons facing threats on their lives, extradition may not be granted, if the request is made by a country where torture, inhuman and degrading treatments are carried out.
ii) Procedure for extradition
The Code provides for the procedure to be followed under extradition. It is stated that, subject to international conventions, any request for extradition is made through diplomatic channels. To this application is attached, as the case may be, the following: a copy of the judgment, even if the person was convicted in absentia, a document ordering that the accused be brought before a court for preliminary inquiry or for trial, a warrant of arrest or any other document having the same effect and issuing from the competent foreign authority. However, the said document should specify the offence on which it is founded and its date. Other requirements include the judgment carrying a conviction and the original or a duly certified copy of a document ordering that the accused be brought before a court for preliminary inquiry or for trial.
The requesting Government, at the same time, attaches a copy of the law applicable to the offence charged, and an account of the facts of the case.
However, in the case of a judgment in default, the requesting Government, in addition, furnishes evidence that the person concerned had knowledge of the trial, and sufficient legal means for his defence.
The file containing the application for extradition, after the documents have been checked by the Minister in Charge of External Relations is forwarded to the Minister in Charge of Justice who, after ascertaining that the procedure is in order, further seizes the Legal Department of the foreigner’s place of residence for enforcement.
A magistrate of the Legal Department of the Court of First Instance proceeds with the case file. He identifies the foreigner and cautions him on his rights. He is then arrested and put in prison at the seat of the Court of Appeal within the jurisdiction of which he was arrested.
The Procureur General upon receipt of the case file and after further investigations, forwards it together with his submissions, to the President of the Court of Appeal who lists the case for hearing and notifies the foreigner and, where necessary his Counsel.
The Court of Appeal examines the application for extradition in chambers in the presence of the Legal Department and of the foreigner, and if need be, of his Counsel and of an interpreter.
It should be emphasised that, upon examination of the application for extradition, the court may, after hearing the Procureur General, grant bail to the foreigner if he fulfils one of the conditions of bail. Where the foreigner renounces the right to benefit from Cameroonian legislation on extradition and formally accepts to be handed over to the requesting state, the court rules accordingly.
The competent court in matters of extradition is the Court of Appeal of the place in which the foreigner was arrested. The Court of Appeal gives its reasoned ruling in chambers which is forwarded without delay by the Procureur General to the Minister in Charge of Justice who in turn submits same in the form of a draft decree ordering the extradition or rejecting the extradition, to the President of the Republic for signature.
The decree is notified without delay to the foreigner and the state requesting extradition, only the Procureur General May appeal against the decision granting extradition before the Supreme Court.
The case-file in all cases are transmitted by the Procureur General to the Minister in Charge of Justice without delay, in order to be returned to the requesting state.
iii) Effects of extradition
There are consequences of extradition from Cameroon of a foreigner. It is provided in the Code that the decree granting extradition is subject to the condition that the person extradited may not, without the special consent of the Government of Cameroon, be prosecuted or punished in the requesting country for any offence committed before his being handed over, other than that for which he was extradited.
Moreover, where an extradition has been declared null and void and the person extradited is not claimed back by the Government from which extradition was requested, he is released and may not be prosecuted or punished either for the offence in respect of which extradition was obtained or for any earlier offence, unless he was arrested in Cameroon more than thirty (30) days after the date on which it was lawfully possible for him to leave the national territory.
It should be pointed out that any nationality extradited by any foreign state to another may transit through Cameroonian territory. The costs of the proceedings, custody and of extraditing the person are borne by the Cameroon public treasury and reimbursed by the requesting state.
However, extradition requested by the Government of Cameroon follows similar conditions as extradition requested by another state. It is stated that, no foreigner extradited to Cameroon on request may be extradited by Cameroon to a third state without the consent of the first state. Provided that such consent required only if the request by the third state is based on acts committed before the extradition to Cameroon.
L) REHABILITATION OF OFFENDERS
Rehabilitation is a measure that, unless otherwise provided by law, expunges a conviction for felony or misdemeanour. It puts an end to any accessory penalty or to any preventive measure except confinement in a health institution and closure of an establishment.
The Code states that any convict may apply to the court for rehabilitation and in the case of death of the convict; the application may be followed up or even filed by his spouse, his ascendants or his descendants. In the case of the death of the applicant, any application for rehabilitation already filed may be continued by the Legal Department.
It is necessary to note that rehabilitation is either as of right or by the judgment of a court. The time limit is five (05) years for a conviction for felony and three (3) years for a conviction for misdemeanour. The applicant may only apply for rehabilitation after these time limits must have run from the date following the day of his release in the case of a sentence to loss of liberty, or payment in the case of a fine.
i) Conditions of rehabilitation
In order to be rehabilitated, a convict should show proof that he has paid all costs and damages or of any reduction thereof granted to him. In the absence of such proof, he should prove that he served imprisonment in default of payment.
Where he is convicted of fraudulent bankruptcy, he should prove the discharge of his liabilities relating to capital, interest and expenses or prove that a reduction was granted.
ii) The competent jurisdiction
The Court of Appeal of the place of residence of the convict has jurisdiction in matters of rehabilitation. The convict addresses his application for rehabilitation to the State Counsel of his place of residence and indicates where he has lived since his release. He annexes to the application, a copy of the judgment convicting him, an extract of his criminal record, and any other necessary documents, showing that he has paid fines, costs and damages.
The State Counsel makes sure that he is given a copy of the judgment convicting the accused, an extract from the punishment register of the prison where the sentence was served, attesting to the conduct of the convict, and an extract of bulletin no 1 of the criminal record of the convict. He forwards the case file with his opinion to the Procureur General of the Court of Appeal.
The Procureur General seizes the Court of Appeal of the application for rehabilitation. The court in a public session, gives a ruling within two (02) months from the date it was seized of the matter, after duly hearing the Procureur General, the convict and/ or his Counsel.
iii) The effects of rehabilitation
Where an application is dismissed, a new one may not be filed before the expiry of three (3) years unless the reason for dismissing the first one is that it was made in disregard of the time limit. However, where it is granted, a note thereof is made on the various index cards of the criminal record. In this case, the extract of the criminal record no longer mentions the expunged conviction.
Rehabilitation does not as of right restore any decoration nor does it automatically reintegrate the person rehabilitated in any orders forfeited. Police supervisory and security measures against the convict remain enforceable. Neither rehabilitation, as of right, reinstates anyone in the public service or employment, rank, public or ministerial offices nor gives rise to any reconstitution of his career.
Nevertheless, the person rehabilitated can recover the rights which were forfeited such as parental authority, guardianship, electoral rights and the right to appear as a witness in court. Rehabilitation does not bar an application for judicial review of judgment with a view to establishing innocence.
Finally, the judgment of the court of Appeal may be appealed against to the Supreme Court in the prescribed manner and within the prescribed time limit.
M) RELEASE ON LICENCE OF OFFENDERS
This is the premature release of a person sentenced to loss of liberty or subjected to a security measure of the same nature . Release on license not revoked becomes final on expiry of the term of imprisonment.
The decree granting release on license may also suspend all other measures ordered by the court that delivered the judgment. Again, release on license from a principal penalty may not be granted before the service of half of the sentence. Release on license from preventive confinement may not be granted before the service of five (5) years of the sentence .
Furthermore, release on license may be revoked on conviction for a felony or misdemeanour later committed or for breach of any of the general or special conditions of the license.
N) FELONIES AND MISDEMEANOURS COMMITTED ABROAD
The Code has treated felonies and misdemeanours committed abroad, making it possible for Cameroonian courts to have jurisdiction to try any Cameroonian national or any resident who committed offences abroad.
For a Cameroonian court to have jurisdiction to try any Cameroonian national or any resident who committed a felony or misdemeanour abroad the offence must be punishable as such both by the Cameroonian law and the law of place of commission.
The criminal proceedings as such may only be instituted by the Legal Department and only after a complaint by the victim or an official request to the Government of the Republic of Cameroon by the Government of the place of commission of the offence .
Action may be taken before the competent court in the place where the accused resides, or before the competent court in his last known place of abode in Cameroon. Notwithstanding, the foregoing, the Supreme Court acting on the request of the Procureur General, may order the case to be transferred to another jurisdiction in the interest of justice.

DE LA PROCEDURE SPECIALE
A) DE L’HABEAS CORPUS
L'Habeas Corpus est une expression latine qui signifie ''que tu aies ton corps'' ou ''sois maître de ton corps''. Il est devenu l’un des instruments de base pour la protection des libertés civiles. Il peut se définir comme une demande de relaxe sans délais justifiée par le caractère illégal d'une arrestation ou d'une détention ou le défaut de conformité avec les formalités prévues par la loi. L’Habeas Corpus est un acte de récusation de l'autorité judiciaire chargée d’arrêter ou de mettre une personne en détention.
i) Du tribunal compétent
Le code stipule que c'est le Tribunal de Grande Instance qui est compétent pour entendre et examiner la réquête de relaxe sans délais fondée sur le principe d’Habeas Corpus. Le Président duTribunal de Grande Instance du lieu d’arrestation ou de détention de la personne ou tout autre juge dudit tribunal est compétent pour entendre et examiner des demandes de relaxe sans délais justifiées par le caractère illégal d'une arrestation ou d'une détention ou le défaut de conformité avec les formalités prévues par la loi.
Il est également compétent pour examiner les requêtes en récusation des mesures administratives relatives à la détention préventive. Cette demande peut être déposée par la personne arrêtée ou détenue elle-même ou par toute autre personne en son nom. Il s’agit d’une demande non timbrée. La demande doit être accompagnée d’un affidavit fournissant l’identité du requérant et, si nécessaire, celle de la personne en état d’arrestation ou de détention. Le lieu d’arrestation ou de détention doit être clairement indiquée avec un résumé précis des faits qui constituent l’illégalité en question.
ii) De la procédure d’Habeas Corpus
La demande en quatre (5) exemplaires est déposée au greffe du Tribunal de Grande Instance, mais adressée au Président dudit tribunal. Il ordonne au garde de la personne détenue de se présenter devant lui le jour et à l’heure mentionnée sur l’ordonnance munie des documents qui autorisent l’arrestation ou la détention.
Il envoie également un exemplaire de la demande et de l’ordonnance au Ministère Public pour ses réquisitions. Le Président du Tribunal de Grande Instance prononce un jugement objectif en présence ou en l’absence du détenu. Un arrêt interlocutoire relatif à une question préliminaire ne peut faire l'objet d'appel à la différence d'un jugement objectif.
Le délai de recevabilité de l’appel est de cinq (5) jours à compter de la date qui suit le prononcé de la décision. L’appel doit se plier aux conditions ordinaires et à la procédure à suivre devant la Cour d’Appel.
Si un appel est formulé, le dossier de l’affaire est envoyé au Président de la Cour d’Appel dans un délai de cinq (5) jours à compter de la note d’appel. Ensuite, le Président de ladite cour ou tout autre juge par lui désigné entend et examine l’appel dans un délai de dix (10) jours.
Il est nécessaire de préciser que la procédure d’Habeas Corpus s’applique également aux mesures privatives de liberté prises à l’encontre de toute personne qui a été acquittée, relaxée ou libérée par un tribunal ordinaire ou par un tribunal spécial.
En définitive, l’Habeas Corpus est l’élément le plus déterminant du code dans la mesure où il garantie la liberté fondamentale et protège contre les arrestations et les détentions arbitraires, une méthode qui consiste pour le Tribunal de Grande Instance à vérifier si la détention d'une personne est légale; et si la détention n’est pas justifiée par la loi, la personne doit être libérée. L’action peut être engagée par la personne détenue ou en son nom par toute autre personne requérant sa libération. Il est stipulé que si vous venez à apprendre qu’une personne est illégalement détenue, vous pouvez porter l’affaire auprès du Tribunal de Grande Instance, interroger l’autorité qui a ordonné sa détention et demander qu’elle soit relachée immédiatement.
B) DÉPOSITIONS DES MEMBRES DU GOUVERNEMENT ET DES REPRÉSENTANTS DE MISSIONS DIPLOMATIQUES
Le code stipule que les règles suivantes soient observées si une telle grande personnalité est appelée à fournir des preuves en qualité de témoin: Ils peuvent être entendus à huis clos à leur demande ou à la demande du Ministère Public.
Le témoignage des représentants de missions diplomatiques est conforme aux principes des Conventions internationales ratifiées par la République du Cameroun.
i) De la procédure
Le code prévoit également la procédure à suivre. La lettre invitant un représentant d’une mission diplomatique à témoigner lui est adressée par le Ministre des Relations Extérieures. Un questionnaire lui est adressé par le Ministre des Relations Extérieures, s’il accepte de témoigner mais qu'il ne peut pas comparaître. Il prête serment par écrit et sa réponse est envoyée sous pli fermé au Juge demandeur par l’intermédiaire du Ministre des Relations Extérieures qui n’a pas connaissance de son contenu.
C) DE LA RÉCUSATION D’UN MAGISTRAT DE LA CHAMBRE OU D'UN JUGE
Il convient de préciser qu’il s’agit d’une procédure prévue par le code et destinée à empêcher à un magistrat de la Chambre ou un juge d’entendre une affaire. Mais aucun magistrat du Ministère Public ne peut être récusé. La récusation peut être justifiée par l’une des raisons suivantes: Consanguinité ou liens familiaux, mariage, héritage, dot, action en réparation des dommages, dette, intérêt établi, procès passé dans lequel l’offier de justice a été magistrat, arbitre, conseil ou témoin, procès dans lequel le conjoint est juge, amitié, haine nourrie envers l’une des parties, doutes quant à l’impartialité de l’officier de justice.
En outre, tout officier de justice qui estime qu’il peut être récusé en raison de l’une quelconque des raisons sus-évoquées peut s’abstenir d’entendre l’affaire et informer sa hiérarchie.
i) De la procédure
Le code prévoit qe la demande en récusation soit adressée par écrit et en deux (2) exemplaires :
- au Président de la Cour d’Appel, s’il est dirigé contre un juge de la Cour d’Appel autre que le Président, ou un officier de justice d’un tribunal inférieur.
- au Président de la Cour Suprême, s’il est dirigé contre le Président de la Cour d’Appel ou un membre de la Cour Suprême autre que son Président.
- Le demandeur envoie également un exemplaire de la demande au magistrat concerné.
Il convient de préciser que la demande, sous peine de rejet, doit mentionner les noms du magistrat concerné et les raisons étayées par des pièces à conviction.
Le Président de la Cour Suprême ou le Président de la Cour d’Appel, selon le cas, prononce un arrêt sans frais de justice après avoir reçu l’explication du magistrat concerné et les réquisitions du Ministère Public.
Dès que le magistrat reçoit un exemplaire de la demande, le procès est ajourné jusqu’à ce qu’un arrêt soit prononcé sur la demande. Si la demande est accordée, le magistrat ne doit plus entendre l’affaire.
Toutefois, si la demnde est rejetée, le requérant peut, sans préjudice de dommages-intérêts, être tenu de payer une amende civile variant entre 100 000 et 500 000 Fcfa. Le requérant et le magistrat concerné sont notifiés de cet arrêt.
D) DU RÈGLEMENT DES CONFLITS DE COMPÉTENCE
La Cour d’Appel et la Cour Suprême sont compétentes pour entendre et régler les conflits de compétence, en fonction des tribunaux concernés.
Lorsque deux Juges d’Instruction, deux Tribunaux de Première Instance ou deux Tribunaux de Grande Instance appartenant au même ressort de Cour d’Appel se trouvent simultanément saisis de la même infraction, l'un des juges ou des tribunaux se dessaisit au profit de l’autre et le conflit crée est ainsi résolu.
Le code stipule que lorsque deux Juges d’instruction appartenant au même ressort de Cour d’Appel sont saisis simultanément de la même infraction dont ils assument ou déclinent la compétence, le conflit crée est réglé par la Cour d’Appel.
Par ailleurs, lorsque deux Juges d’Instruction appartenant au même ressort de Cour d’Appel sont saisis simultanément de la même infraction dont ils assument ou déclinent la compétence, le conflit crée est réglé par la Cour d’Appel.
Toutefois, lorsque deux Juges d’Instruction, deux Tribunaux de Première Instance ou deux Tribunaux de Grande Instance n’appartenant pas au même ressort de Cour d’Appel se trouvent simultanément saisis de la même infraction dont ils assument ou déclinent la compétence, le conflit ainsi crée est réglé par la Cour Suprême. La Cour Suprême est compétente pour régler des conflits de compétence résultant de deux jugements définitifs rendus respectivement par un tribunal ordinaire et un tribunal spécial, les jugements qui entravent le cours normal de la justice. Il en va de même lorsque deux tribunaux ordinaires ou spéciaux rendent des jugements définitifs.
La Cour Suprême est saisie de l’affaire par voie de requête à l’instance du Ministère Public ou de toute autre partie.
L’ordonnance réglant le conflit est notifiée à toutes les parties et ne fait pas l’objet d’appel.
E) DES RENVOIS D’UN TRIBUNAL A L’AUTRE
Le code stipule que la Cour Suprême peut dessaisir toute juridiction d'instruction ou de jugement et renvoyer la connaissance de l'affaire à une autre juridiction du même ordre ou désigner des juges d’un autre ressort de Cour d’Appel pour cause de suspicion légitime ou dans l’intérêt de l’ordre public.
La demande peut être formulée par le Ministère Public ou par toute autre partie. L’introduction d’une demande en elle-même ne met pas l’affaire en instance. Toutefois, le Président de la Cour Suprême peut ordonner au Président du tribunal auprès duquel l’affaire est enregistrée d’ajourner l’audience.
Le Greffier en Chef de la Cour Suprême fait en sorte que toutes les ordonnances relatives aux demandes de renvoi soient notifiées au tribunal concerné et aux parties.
F) AMENDES FIXES
Selon la loi, une amende fixe est une peine pécuniaire applicable aux contraventions dont le quantum est d’avance fixé par la loi.
L’officier de police judiciaire est compétent pour collecter les amendes fixes. Toutefois, les agents de police judiciaire et toutes les personnes chargées de collecter des amendes fixes et qui sont en possession d’un carnet de reçus numéroté avec les initiales du Ministère Public compétent, peuvent exercer leurs fonctions.
Les taux d’amendes fixés varient en fonction de la classe des contraventions -
(a) 1.000francs pour la première classe
(b) 2.400francs pour la deuxième classe
(c) 3.600francs pour la toisième classe
(d) 25.000francs pour la quatrième classe
Le paiement des amendes fixes est facultatif et la personne qui accepte de les assumer doit informer le contrevenant. Le Procureur de la République est compétent pour déclarer l’illégalité d’une amende fixe et ordonne sa nullité.
Le paiement d’une amende fixe met un terme aux poursuites judiciaires. Il faut signaler que les officiers de police judiciaire sont chargés de collecter et de verser les amendes fixes au Trésor public. Le Procureur de la République est a le pouvoir d’annuler les amendes fixes et la généralisation du recouvrement immédiat des amendes fixes prévue par la loi.
G) DU JUGEMENT DES CONTRAVENTIONS
Le code prévoit qu’un contrevenant soit jugé s’il refuse de payer une amende fixe, si le réajustement est le résultat d’une augmentation de l’amende fixe et qu'il refuse de payer le surplus ou si une évaluation de l’amende fixe est plus basse que la somme prescrite. Il s’agit d’une contravention de la 4e classe.
Dans les cas sus-évoqués, à savoir le non paiement des amendes fixes, le Procureur de la République peut, dès réception du rapport engager les poursuites judiciaires, et le Tribunal de Première Instance est compétent en la matière comme sous le regime des contraventions. Selon le code pénal camerounais , il y a quatre (4) classes de contraventions passibles des peines suivantes:
(a) première classe: Amendes de deux cents à mille deux cents (200-1200) francs
(b) Deuxième classe: Amendes de mille quatre cents à deux mille quatre cents (1400-2400) francs
(c) Troisième classe: Amendes de deux mille six cents à trois mille six cents (2600 à 3600) francs
(d) Quatrième classe: Amendes de quatre mille à vingt-cinq mille (4000 à 25000) francs
H) DES INFRACTIONS COMMISES AU COURS DE L’AUDIENCE (MÉPRIS DE LA COUR)
Il importe de savoir que, selon le code, il incombe au Président du tribunal d’assurer le maintien de l’ordre et de diriger les débats. A cet effet, il a à sa disposition des forces de l’ordre au cours de chaque audience. Il peut par conséquent punir toute personne qui perturbe l’audience, ce qu’on appelle le mépris de la cour.
La notion de mépris de la cour est définie comme une action ou une inaction qui constitue une ingérence ou un blocage, ou qui tend à s’immiscer à la bonne administration de la justice ou à la bloquer. Par conséquent, le mépris de la cour peut être commis « in facie curiae », c’est-à-dire en présence de la cour, ou à l’extérieur de la cour. Il en est ainsi parce que la loi stipule que les infractions commises au cours des audiences sont considérées comme du mépris à l’égard de la cour.
i) De la procédure
En effet, les infractions commises au cours d’une audience sont jugées suivant une procédure spéciale. Lorsque les infractions commises sont des contraventions et des délits, le juge d’instruction préfère une accusation fondée sur les faits, entend l’auteur, les témoins et le Ministère Public avant de prononcer le jugement.
Toutefois, lorsque l’infraction commise est un crime, le Président du tribunal relève les propos de l’auteur, ordonne son arrestation et son escorte auprès du Procureur de la République qui procède conformément à la loi. Le mépris de la cour est puni parce qu’il peut constituer une humiliation du juge ou une perturbation du procès.
La cour a ainsi en elle-même le pouvoir de punir sommairement l’auteur afin d’éviter la pertubation des procès. Ce pouvoir inhérent est destiné à punir pour mépris et non à juger dans le but de déclarer l’auteur coupable.
I) DE LA RECONSTITUTION DES PIÈCES
Lorsque l’original d’un jugement est perdu, le code prévoit qu’il soit reconstitué. La copie certifiée d’un jugement perdu ou détruit devient l’original. Sous les ordres du Président du tribunal qui a rendu jugement, son détenteur remet la copie au greffe du tribunal.
A partir de l’original ainsi reconstitué, le greffier délivre gratuitement une copie du jugement au détenteur original Toutefois, lorsqu’il n’y a aucune copie certifiée de la pièce perdue ou détruite, l’original est reconstitué à partir des registres auprès du tribunal qui l’a prononcé. Par ailleurs, lorsqu'une pièce du dossier d’une affaire ou tout le dossier d’une affaire manque, le Président du tribunal saisi de l’affaire ou toute autre partie peut faire reconstituer ladite pièce ou ledit dossier.
J) DES PROCES SPECIAUX
La loi prévoit une procédure précise à suivre à l’encontre des officiers de police judiciaire, des officiers judiciaires ainsi que des autorités administratives pour des infractions commises dans l'exercice de leurs fonctions. Ils sont jugés suivant une procédure spéciale.
La loi prévoit que lorsqu'un officier de justice ou de police judiciaire peut faire l’objet d’une accusation pour une infraction commise, le Procureur Général compétent demande au Président de la Cour Suprême de désigner un juge d’instruction et deux autres magistrats de grade au moins égal à celui du magistrat mis en cause.
Si nécessaire, ils entendent et règlent l’affaire en première instance. Le Président de la Cour Suprême doit également préciser la ville dans laquelle l’affaire doit être entendue.
Le Procureur Général compétent et la partie lésée peuvent déposer une plainte auprès du Président de la Cour Suprême. La partie civile peut peut exiger une action civile.
Le Président de la Chambre d’instruction de l’affaire doit personnellemnt conduire l’enquête préliminaire (EP) à travers le territoire national. Et en cas d’appel, l’affaire est entendue soit par les juges de la Cour Suprême siégeant en chambre collégiale, soit par une commission conjointe des chambres de la Cour Suprême, en fonction du grade du magistrat accusé.
Les autorités administratives comme les gouverneurs, les préfets, les sous-préfets ou les chefs de districts sont eux aussi jugés pour les infractions commises.
Lorsque le gouverneur d’une province commet un crime ou un délit, dans l'exercice ou non de ses fonctions, le Procureur Général de la Cour d’Appel compétente adresse un rapport au Président de la Cour Suprême qui envoie l’affaire au tribunal compétent. Les poursuites judiciaires, les recherches et le procès sont confiés à une juridiction autre que celle de la province dans laquelle le gouverneur exerce ses fonctions.
En outre, lorsqu'un préfet ou tout autre chef d'une circonscription administrative ou un officier de police judiciaire commet un crime ou un délit, même sans rapport avec l'exercice de ses fonctions, le Procureur de la République transmet le dossier de l'affaire au Procureur Général qui saisit le Président de la Cour d’Appel compétente. A son tour, le Président de la Cour d’Appel désigne le Ministère Public chargé d’engager les poursuites judiciaires et la cour d’assise compétente pour entendre et régler l’affaire. Il convient de préciser que les poursuites judiciaires, les recherches et le procès sont confiés à une juridiction autre que celle du département, de l’arrondissement ou du district dans lequel l’accusé exerce ses fonctions.
Il convient de retenir que, conformément au code, tous les officiers de justice et de police judiciaire ainsi que toutes les autorités doivent changer de comportement à l’égard du public, parce que l’Etat n’endosse plus la responsabilité en raison des violations des droits de l'homme. Cette large gamme de libertés destinées à compenser pour la détention illégale ou la violation des droits de l’homme constitue une ménace pour les administrateurs qui avaient autrefois confiance à la détention préventive ou administrative au nom de l’ordre public et de la paix. Par conséquent, la possibilité est donnée aux personnes qui se trouvent dépoillées de leurs libertés et de leurs droits de se défendre.
K) DE L’EXTRADITION DES PERSONNES ACCUSÉES OU DES DÉTENUES
Au cours des recherches et d’un examen judiciaire relatifs à une infraction, il peut arriver qu’on ait besoin de l’assistance juridique des organes des Etats étrangers. La coopération en matière d’assistance juridique est déterminée par les situations précises dans lesquelles le criminel ou les victimes et les témoins, ou encore les preuves matérielles de l’infraction se trouvent dans le territoire d’autres Etats. Cette situation exige le développement et l’amélioration des formes juridiques de coopération entre Etats dans la lutte contre les infractions, y compris l’extradition des criminels.
Ces mesures sont prises à l’aide d’instruments juridiques nationaux et internationaux. Toutefois, le droit souverain des Etats reste inviolable, étant donné que les problèmes essentiels liés à la lutte contre les infractions ont trait à la compétence de chaque Etat.
Le code s’étend largement sur ce sujet important. Il définit les conditions, la procédure et les effets de l’extradition. Bref, l’extradition est un acte par lequel un Etat sollicité remet un étranger qui se trouve dans son territoire à un Etat requérant pour qu’il soit poursuivi pour un ou plusieurs infractions de droit commun commises ou pour qu’il soit soumis à une peine d’emprisonnement prononcée contre lui à la fin d’un jugement en matière pénale.
Cette procédure particulière est souvent fondée sur le principe de réciprocité ou dans le respect des instruments signés et ratifiés par les Etats membres.
Il convient de relever que les relations juridiques liées à l'apport de l'assistance juridique en matière pénale sont regies par les normes des conventions internationales multilatérales et bilatérales en matière de lutte contre la criminalité. L’extradition des criminels constitue un acte d’assistance juridique posée par un Etat (l’Etat sollicité) en faveur d’un autre (Etat requérant) dans le but de poursuivre en justice, de trouver ou d’arrêter une personne suspectée de crime afin de le conduire devant le tribunal ou pour appliquer la peine.
Le code stipule que le Président de la République peut, par décret ordonner l’extradition vers un Etat étranger requérant l’extradition de toute personne de nationalité étrangère accusée ou condamnée pour une infraction commise dans cet Etat.
i) Des conditions de l’extradition
Il est stipulé par le code qu’aucun citoyen camerunais ne peut être extradé, sauf si la loi prévoit autrement. Toutefois, avant l’extradition de tout étranger, les conditions suivantes doivent être remplies. Les actes suivants peuvent constituer des motifs d’extradition: Au nom de la loi de l’Etat requérant et de celle du Cameroun, les actes constituant une infraction passible d’une peine minimale privative de liberté d’au moins deux (2) ans, pour lesquels des poursuites judiciaires ne sont pas exclues par prescription, amnistie ou autrement, ou une peine privative de liberté qui est encore juridiquement applicable dans un délai de six (6) mois au moins, nonobstant la contrainte judiciaire.
En outre, au nom de la loi camerounaise, les actes constituant une infraction ordinaire de droit commun, dans les circonstances qui montrent que l’extradition n’est pas demandée pour des raisons politiques, religieuses ou raciales, ou sur la base de la nationalité de la personne concernée.
Par ailleurs, les crimes et les délits, qui ne sont pas dirigés contre un gouvernement, sont considérés comme des infractions de droit commun et peuvent justifier une extradition. Sont également considérées comme des infractions de droit commun les infractions de compétence universelle définies par les conventions ratifiées par le Cameroun.
Par conséquent, l’extradition peut ne pas être accordée, par égard pour les personnes dont la vie est menacée, si la requête est formulée par un pays où il y a la torture, des traitements inhumains et dégradants.
ii) De la procédure d’extradition
Le code prévoit la procédure à suivre pour l’extradition. Il est stipulé que toutes les requêtes d’extradition soient adressées par voie diplomatique conformément aux conventions internationales. Les pièces suivantes sont jointes selon les cas: une copie du jugement, même si la personne a été condamnée in absentia, un document ordonnant que l’accusé soit conduit devant un tribunal pour enquête priliminaire ou pour un procès, un mandat d’arrêt ou tout autre document produisant le même effet et délivré par l’autorité étrangère compétente. Toutefois, le document en question doit préciser l’infraction sur laquelle il se fonde et sa date. D’autres conditions sont: un jugement portant une condamnation et l’original ou la copie dûment certifiée ordonnant que l’accusé soit conduit devant un tribunal pour enquête préliminaire ou pour un procès.
Le gouvernement requérant joint en même temps une copie de la loi qui s’applique à l’infraction commise et un rapport des faits de l’affaire.
Toutefois, dans le cas d’un jugement par défaut, le gouvernement requérant fournit également des preuves que la personne concernée était au courant de l’affaire et qu’il disposait de moyens juridiques suffisants pour sa défense.
Le dossier contenant la demande d’extradition est, après vérification des documents par le Ministre des Relations Extérieures, envoyé au Ministre de la Justice qui, après s’être assuré que la procédure est en ordre, saisit le Ministère Public du lieu de résidence de l’étranger pour application.
Un magistrat du Ministère Public du Tribunal de Première Instance traite le dossier de l’affaire. Il identifie l’étranger et l’informe de ses droits. Il est alors arrêté et mis en prison au siège de la Cour d’Appel dans le ressort duquel il a été arrêté.
Dès réception du dossier de l’affaire et après d’autres investigations, le Procureur Général l’envoie avec ses réquisitions, au Président de la Cour d’Appel qui programme l’audience et informe l’étranger et, si nécessaire son avocat.
La chambre de la Cour d’Appel examine la demande d’extradition en présence du Ministère Public et de l’étranger et, au besoin, de son avocat et d’un interprète.
Il convient de relever qu’après examen de la demande d’extradition, le tribunal peut, après avoir entendu le Procureur Général, accorder la liberté provisoire à l’étranger, s’il remplit l’une des conditions de la mise en liberté provisoire. Lorsque l’étranger renonce à son droit de bénéficier de la législation camerounaise en matière d’extradition et accepte formellemnt qu’il soit remis à l’Etat requérant, la cour rend une décision dans ce sens.
Le tribunal compétent en matière d’extradition est la Cour d’Appel du lieu d’arrestation de l’étranger. La chambre de la Cour d’Appel rend un jugement objectif qui est envoyé sans délais par le Procureur Général au Ministre de la Justice qui à son tour soumet le même jugement sous la forme d’un pojet de décret ordonnant l’extradition ou le rejet d’extradition au Président de a République pour signature.
Immédiatement, l’étranger et l’Etat qui demande l’extradition sont informés du décret, et seul le Procureur Général de la République peut interjeter appel d’une décision accordant l’extradition devant la Cour Suprême.
Le dossier de l’affaire est dans tous les cas transmis sans délais par le Procureur Général au Ministre de la Justice pour qu’il le retourne à l’Etat requérant.
iii) Des effets de l’extradition
L’extradition du Cameroun d’un étranger a des conséquences. Le code prévoit que le décret d’extradition est soumis à la condition que la personne extradée ne peut pas être poursuivie ou punie, sans le consentement spécial du gouvernement du Cameroun, pour toute infraction commise avant qu'elle soit remise ou autre que celle pour laquelle elle a été extradée.
En outre, lorsqu’une extradition a été déclarée nulle et de nul effet et que la personne extradée n’est pas reclamée par le Gouvernement qui a demandé son extradition, elle est relâchée et peut ne pas être poursuivie ou punie en raison de l’infraction pour laquelle l’extradition a été obtenue ou pour toute infraction antérieure, à moins qu’elle ait été arrêtée au Cameroun plus de trente (30) jours après la date à laquelle il lui était permis de quitter le territoire national.
Il convient de savoir que les ressortissants de toutes nationalités extradés par un Etat étranger peuvent transiter par le biais du territoire Camerounais. Les frais de justices, de détention et d’extradition d’une personne sont supportés par le trésor public camerounais et remboursés par l’Etat requérant.
Toutefois, l’extradition demandée par le Gouvernement camerounais se fait dans les conditions semblables. Il est stipulé qu’aucun étranger extradé au Cameroun par voie de demande ne peut être extradé par le Cameroun vers un troisième pays sans le consentement du premier pays. A condition q’un tel consentement soit demandée si la requête du troisième pays est fondée sur les actes commis avant l’extradition au Cameroun.
L) DE LA REHABILITATION DES CRIMNELS
La réhabilitation est une mesure qui, sauf dispositions contraires de la loi, efface une condamnation pour un crime ou un délit. Elle met un terme à toute peine accessoire ou à toute mesure préventive à l’exception de la détention dans un établissement sanitaire et de la fermeture d'une entreprise.
Le code stipule que tout condamné peut demander une réhabilitation, et en cas de décès du condamné, la demande peut être suivie ou même introduite par son conjoint, ses ascendants ou ses descendants. En cas de décès du requérant, la demande de réhabilitation déjà déposée peut être suivie par le Ministère Public.
Il convient de signaler que la réhabilitatation est soit de plein droit, soit soit judiciaire. Le délai est de cinq (5) ans s’agissant d’une condamnation pour crime et de trois (3) ans pour un délit. Le requérant ne peut formuler sa demande qu’après ces délais à compter de la date qui suit sa libération dans le cas d’une peine privative de liberté, ou le paiement dans le cas d’une amende.
i) Des conditions de la réhabilitation
Pour être réhabilité, un condamné doit fournir la preuve qu’il a versé tous les frais de justice et les dommages-intérêts ou toute réduction à lui accordée. A défaut de telles preuves, il doit prouver qu'il a purgé une contrainte judiciaire. S’il est condamné pour banqueroute frauduleuse, il doit justifier du paiement du passif de la faillite en capital, intérêts et frais ou de la remise qui lui en est faite .
ii) De la juridiction compétente
La Cour d’Appel du lieu de résidence du condamné a compétence en matière de réhabilitation. Le condamné adresse sa demande de réhabilitation au Parquet de son lieu de résidence et précise ou il vit dépuis sa détention. Il joint à sa demande une copie du jugement le condamnant, un extrait de son casier judiciaire et toutes les autres pièces nécessaires montrant qu’il s’est acquitté des amendes, frais de justices et dommages-intérêts.
Le Procureur de la République s’assure qu’il a reçu une copie du jugement condamnant l’accusé, un extrait du registre des peines de la prison dans laquelle la peine a été purgée, témoignant de la conduite du condamné, et un extrait du casier judiciaire n°1 du condamné. Il envoie le dossier de l’affaire et son avis au Procureur Général de la Cour d’Appel.
Le Procureur Général saisit la Cour d’Appel à propos de la demande de réhabilitation. Au cours d’une audience publique, la Cour prononce un arrêt dans un délai de deux (2) mois à compter de la date de la saisine de l’affaire, après avoir dûment entendu le Procureur Général, le condamné et/ou son avocat.
iii) Des effets de la réhabilitation
Lorsque la demande est rejetée, une nouvelle ne peut être déposée avant l’expiration de trois (3) années, à moins que la raison du rejet de la première demande ait portée sur le non respect de la forclusion. Toutefois, si elle est accordée, il en est fait mention sur les différentes fiches du casier judiciaire. Dans ce cas, l’extrait du casier judiciaire ne mentionne plus la condamnation effacée.
La réhabilitation ne fait pas retrouver de plein droit les décorations, tout comme elle ne réintègre pas la personne réhabilitée dans tous les ordres qu’il a perdus. Les mesures de contrôle et de sécurité de la police restent en vigueur à l’égard de la personne condamnée. La réhabilitation ne donne pas non plus le droit d’être réintégré à la fonction publique ou de retrouver son emploi, son grade, ses fonctions administratives ou ministérielles.
Neamoins le réhabilité peut retrouver certains droits qu’il a perdu, notamment l’autorité parentale, l'administration des biens, les droits électoraux et le droit de comparaître en justice en qualité de témoin. La réhabilitation n’exclut pas une demande en révision judiciaire dans le but d’établir son innocence.
En définitive, le jugement rendu par la Cour d’Appel peut faire l’objet d’un appel auprès de la Cour Suprême dans les conditions et les délais prévus.
M) DE LA LIBERATION CONDITIONNELLE DES ACCUSES
Il s’agit d’une libération précoce d’une personne condamnée à une peine privative de liberté ou soumise à une mesure sécuritaire de la même nature . Si la révocation n'intervient pas avant l'expiration de la durée de la peine d’emprisonnement, la libération devient définitive.
Le décret de libération conditionnelle peut également suspendre toutes les autres mesures arrêtées par le tribunal qui a prononcé la sentence. En outre, la libération conditionnelle d’une peine principale ne peut être accordée avant que le condamné ait purgé la moitié de la durée de cette peine. La libération conditionnelle d’une détention préventive ne peut être accordée avant que le condamné ait passé cinq (5) ans de détention .
Par ailleurs, la libération conditionnelle peut être révoquée en raison d’une condamnation pour un crime ou un délit commis plus tard ou en raison du non respect des conditions générales ou spéciales de cette libération.
N) DES CRIMES ET DES DELITS COMMIS A L’ETRANGER
En traitant des crimes et délits commis à l’étranger, le code s’est entouré des dispositions qui confèrent aux tribunaux camerounais la compétence de juger toute personne de nationalité camerounaise ou tout résident étranger ayant commis un délit à l’étranger.
Pour qu’un tribunal camerounais soit compétent de juger une personne de nationalité camerounaise ou un résident étranger ayant commis un délit à l’étranger, ledit délit doit être puni aussi bien par la loi camerounaise que par celle du lieu où il a été commis.
Les poursuites judiciaires en elles-même ne peuvent être engagées que par le Ministère Public et ce, après une plainte déposée par la victime ou une requête officielle formulée au Gouvernement de la République du Cameroun par le Gouvernement du lieu où le délit a été commis .
L’action peut être engagée devant le tribunal compétent du lieu de résidence de l’accusé ou devant le tribunal compétent de son dernier lieu de résidence aux Cameroun. Nonobstant les dispositions ci-dessus, la Cour Suprême peut à la demande du Procureur Général, ordonner que l’affaire soit tnansférée à une autre juridiction dans l’intérêt de la justice.
