Our objectives are to obtain reasonable assurance about whether the financial statements as a whole are free from material misstatement, whether due to fraud or error, and to issue an auditor’s report that includes our opinion. Reasonable assurance is a high level of assurance, but is not a guarantee that an audit conducted in accordance with above regulations will always detect a material misstatement when it exists. Facts
1. On *****, the applicant filed an application for a Community trade mark at the Office for Harmonisation in the Internal Market (Trade marks and Designs) (‘OHIM’) under Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark (OJ 1994 L 11, p. 1), as amended.
2. The mark for which registration was sought is the word mark *****.
3. The products in respect of which registration of the trade mark was sought are in classes 5, 29 and 32 of the Nice Agreement concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks of 15 June 1957, as revised and amended, and correspond, after subsequent amendments to the application for a trade mark by letters from the applicant of 30 July and 14 December 1998, for each class respectively to the following description:
— Class 5: ‘Medicaments, pharmaceutical and chemical preparations for hygiene; dietetic substances and nutritional replacement adapted for medical use; food for babies; preparations on the basis of vitamins, trace elements and/or minerals for dietetic purposes or as nutritional supplementation; nutritional concentrates or nutritional supplements on the basis of herbs, herbal teas, all for health care purposes’;
— Class 29: ‘Meat, fish, non-living mollusc and crustacean, poultry and game; meats and sausages, seafood, poultry and game, also preserved or deep-frozen; fruits and vegetable (including mushrooms and potatoes, especially french fries and other potato products) preserved, deep-frozen, dried, boiled or prepared for immediate consumption; soups or soup preserves; delicatessen salads; dishes of meat, fish, poultry, game and vegetable, also deep-frozen; eggs; meat- and bouillon extracts; vegetable extracts and preserved herbs for the kitchen; non¬medical nutritional concentrates or nutritional supplements on herbal basis, herbal food, also in form of snack bars’;
— Class 32: ‘Beers; mineral and aerated waters and other non-alcoholic drinks; fruit and vegetable drinks, fruit juices; syrups and other preparations for making beverages; herbal and vitamin beverages’.
4. The application was published in the Community Trade Marks Bulletin, No *****.
5 On *****, the other party to the proceedings before the Board of Appeal filed a notice of opposition under Article 42(1) of Regulation No 40/94 against registration of the trade mark in respect of all the products referred to in the trade¬mark application. The opposition was based on the fact that a trade mark had already been registered in Spain, the date of priority for which was 19 October 1960. That trade mark (‘the earlier trade mark’), which consists of the word mark *****, was registered in respect of products falling within classes 30 and 32 of the Nice Agreement and corresponding to the following description: ‘Non-alcoholic and non-therapeutic carbonic drinks, non-therapeutical cold beverages of all kind[s], gaseous, granulated effervescent; fruit and vegetable juices without fermentation (except must), lemonades, orangeades, cold beverages (except orgeat), soda water, Seidlitz water and artificial ice’

Фактическа обстановка
1. На ***** молителят е подал заявление за търговска марка на Общността в Службата за хармонизиране на вътрешния пазар (Търговски марки и дизайни) („СХВП“) по Регламент (ЕО) № 40/94 на Съвета от 20 декември 1993 г. относно търговската марка на Общността (ДВ 1994 L 11, стр. 1), изменен.
2. Марката, за която е поискана регистрация, е словната марка *****.
3. Продуктите, във връзка с които е поискана регистрацията на търговската марка, са от класове 5, 29 и 32 от Ницската спогодба относно международната класификация на стоките и услугите за регистрация на марки от 15 юни 1957 г., ревизирана и изменена, и след последващи изменения на заявлението за търговска марка с писма от молителя от 30 юли и 14 декември 1998 г., съответстват за всеки един съответен клас, на следното описание:
- Клас 5: „Медикаменти, фармацевтични и химични препарати за хигиенни цели; диетични вещества и заместители на хранене, адаптирани за медицински цели; бебешки храни; препарати на базата на витамини, разсеяни елементи и/или минерали за диетични цели или за хранителни добавки; хранителни концентрати или хранителни добавки, базирани на билки, билкови чайове, всички за здравословни цели“;
- Клас 29: „Месо, риба, неживи мекотели и ракообразни, птици и дивеч; меса и колбаси, морски дарове, птици и дивеч, също консервирани или дълбоко замразени; плодове и зеленчуци (включително гъби и картофи, особено пържени картофи и други продукти от картофи) консервирани, дълбоко замразени, сушени, варени и приготвени за бърза консумация; супи и консервирани супи; деликатесни салати; ястия от месо, риба, птици, дивеч и зеленчуци, също дълбоко замразени; яйца; екстракти от месо и бульон; зеленчукови екстракти и консервирани подправки за готвене; немедицински хранителни концентрати и хранителни добавки на билкова основа, билкови храни, също под формата на блокчета;
- Клас 32: „Бира; минерални и газирани води и други безалкохолни напитки; плодови и зеленчукови напитки, плодови сокове; сиропи и други суровини за приготвяне на напитки; билкови напитки и напитки с витамини.“
4. Заявлението е публикувано в Бюлетина на търговските марки на Общността, № *****.
5. На *****. другата страна по производството пред Апелативния състав е подала известие за възражение по чл. 42(1) от Регламент № 40/94 срещу регистрирането на търговската марка във връзка с всички продукти, посочени в заявлението за търговска марка. Възражението се базира на факта, че в Испания вече е регистрирана търговска марка с приоритетна дата 19 октомври 1960 г. Тази търговска марка („по-ранната търговска марка“), състояща се от словната марка *****, е регистрирана във връзка с продукти, попадащи към класове 30 и 32 от Ницското споразумение и съответстващи на следното описание: „Безалкохолни и нетерапевтични газирани напитки, нетерапевтични студени напитки от всякакъв(ви) вид(ове), газообразни, гранулирани ефервесцентни; плодови и зеленчукови сокове без ферментация (с изключение на мъст), лимонади, оранжади, студени напитки (с изключение на бадемов сироп), сода, минерална вода Seidlitz и изкуствен лед“.
