Source text - English 1. GROUNDS FOR THE EXCLUSION
On-the-spot audits carried out in the years 2000-2002 revealed that Italy was not in compliance with applicable legislation in respect of the following Key and Ancillary controls.
1.1. General Weaknesses
(1) The Identification and Registration database envisaged by R.820/97 (repealed and replaced by R.1760/2000) was not operational in Italy in 1999 (for animals born after 1.1.1998), 2000, 2001 or 2002.
The missions carried out at different times and places showed that the Identification and Registration (I&R) situation on the ground (completeness and correctness of the database, the passporting and tagging of animals) was deficient.
On several occasions animals of more than 4 months were found to be neither passported nor identified by ear-tags, whereas R.1760/2000 requires tagging and passporting after 21 days.
This clearly deficient situation is at least partly a result of the lack of proper and timely action by the local veterinary offices, which either accept / tolerate a clearly deficient situation during their controls or give incorrect advice to farmers, or do not take sufficient action to ensure that the information in the database is kept up-to-date.
In reply to the minutes of the bilateral meeting Italy supplied more information as regards on-the-spot checks at farms and slaughterhouses conducted by the Ministry of Health in the different Regions in the period July 2001 – November 2002.
These nationally instigated controls showed that the situation as regards bovine identification was not always to the required standard and recommendations were issued to the relevant responsible services.
The deficient I&R situation means that computerised cross controls do not always give the desired assurance as to the compliance of the premia paid.
(2) The national instructions for the on-the-spot controls 2000 and 2001 did not foresee a reconciliation between the total number of animals on farm with the number of animals figuring in the I&R database, required by article 6(6)d of R.3887/92.
This failing leads to the non-application of sanctions under art.10c of R.3887/92 and increases the risk that cross controls with the I&R database do not reveal all anomalies.
Translation - Italian 1. MOTIVAZIONI ALLA BASE DELL'ESCLUSIONE
Le ispezioni effettuate sul posto negli anni 2000-2002 hanno evidenziato che l'Italia non ha applicato correttamente la normativa vigente relativamente ai controlli essenziali e ausiliari sotto elencati.
1.1. Carenze generali
(1) La banca dati di identificazione e registrazione prevista dal Regolamento 820/97 (abrogato e sostituito dal Regolamento 1760/2000) non era operativa in Italia nel 1999 (per animali nati dopo il 1.1.1998), 2000, 2001 né nel 2002.
Le varie indagini condotte in tempi e luoghi diversi hanno evidenziato l'esistenza di carenze relativamente all'effettiva applicazione del sistema di identificazione e registrazione (completezza e correttezza della banca dati, passaporto e marcatura degli animali).
È stata riscontrata più volte la mancanza di passaporto e di marca auricolare per animali di oltre 4 mesi di età, contrariamente a quanto disposto dal Regolamento 1760/2000 che prevede l'apposizione di marche auricolari e la tenuta di un passaporto dopo 21 giorni.
Questa situazione chiaramente insoddisfacente deriva, in parte, dalla mancanza di un'adeguata azione tempestiva da parte dei servizi veterinari locali, che, durante le ispezioni, accettano o tollerano l'esistenza di queste carenze oppure consigliano in modo errato gli allevatori, o ancora non adottano le necessarie misure correttive per fare in modo che la banca dati venga tenuta aggiornata.
In risposta al verbale dell'incontro bilaterale, l'Italia ha fornito ulteriori informazioni sulle ispezioni condotte presso le aziende e nei macelli dal Ministero della Sanità nelle varie regioni nel periodo luglio 2001 – novembre 2002.
Dai controlli effettuati a livello nazionale è risultato che non sempre il sistema di identificazione dei bovini soddisfaceva lo standard richiesto e si è quindi proceduto all'invio di raccomandazioni ai servizi competenti responsabili.
Un sistema di identificazione e registrazione carente vuol dire controlli incrociati informatici che non permettono di sapere con certezza se i premi pagati sono legittimi.
(2) Le raccomandazioni nazionali per le ispezioni sul posto negli anni 2000 e 2001 non prevedevano la concordanza tra il numero complessivo di animali presenti nell'azienda e il numero di animali che figurava nella banca dati di identificazione e registrazione, a norma dell'articolo 6, paragrafo 6, lettera d del Regolamento 3887/92.
La carenza in questione si traduce nella mancata applicazione delle sanzioni altrimenti previste dall'articolo 10, lettera c del Regolamento 3887/92 e aumenta il rischio che i controlli incrociati tramite la banca dati di identificazione e registrazione non rendano conto di tutte le anomalie.
