Brasil possui mecanismos de participação inseridos
no sistema representativo que são maneiras de exercício
da soberania popular. Neste artigo foram abordadas
as Teorias da Constituição, da Separação dos
Poderes e do Poder Constituinte. Este último dito que
a única forma de modificar a Constituição brasileira
nos dias atuais é por meio de emenda constitucional.
A Teoria do Estado também foi alvo de estudos e
compreende os diversos tipos de democracia. Dentre os estudados neste trabalho a democracia direta, indireta e semidireta,
também conhecida como participativa, que pode ser exercida através da
iniciativa popular para propor leis ordinárias e complementares. O objetivo
deste estudo é analisar a possibilidade de utilização da iniciativa
popular para propor emendas constitucionais usando a interpretação sistemática
para integrar o texto constitucional, já que este silencia neste aspecto.
O método utilizado é o indutivo. A iniciativa popular de emendas
constitucionais pode potencializar os efeitos da democracia brasileira e
aumentar o interesse dos cidadãos no que concerne aos assuntos públicos.
Translation - English The Constitution of the Federative Republic of Brazil has participation
mechanisms inserted into the representative system, which are
ways to exercise popular sovereignty. In this article, the theories of Constituent
Power and Power Division were approached. The Constituent Power
dictates that the only way to modify the Brazilian Constitution today is
through a constitutional amendment. The State Theory was also the focus
of studies and comprehends the several types of democracy. Among them,
this research deals with the direct, indirect and semi-direct democracy,
also known as participative democracy, which can be exercised through
popular initiative to propose ordinary and complementary laws. The purpose
of this study is to analyse the possibility of using popular initiative
to propose constitutional amendments using systematic interpretation to
integrate the Constitution, since it is absent in this aspect. The method
used in this work is the inductive one. The popular initiative for constitutional
amendments can boost the effects of Brazilian democracy and raise
citizens’ awareness to public matters.
