bedanken wir uns für den gewährten Schriftsatznachlass und nehmen zum Schriftsatz des Klägers vom 20. Juni 2014 wie folgt Stellung:
Auch mit seinem jüngsten Schriftsatz scheitert der Kläger daran, die Schlüssigkeit seiner Klage darzulegen. Stattdessen versucht er einen Bezug zu den von der XY GmbH begebenen Mittelstandsanleihen zu konstruieren und verliert sich dabei in Polemik; es ist absurd, wenn der Kläger behauptet, die Beklagte habe ihn „über den Tisch gezogen“.
Auf gleicher Linie liegt die unsubstantiiert behauptete Insolvenz der XY GmbH im Sommer 2009. Vor dem Hintergrund, dass seitens der Analysten noch im Sommer 2009 positive Research Reports über die XY GmbH veröffentlich wurden und ein Antrag auf Eröffnung des Insolvenzverfahrens erst Ende des Jahres 2011 gestellt wurde, erweist sich dieser Vortrag - freundlich ausgedrückt - ebenfalls nur als Stimmungsmache.
Es gelingt dem Kläger dabei jedoch nicht, über den entscheidenden Punkt des Rechtsstreits hinwegtäuschen: Es fehlt an einem Schuldverhältnis zwischen Kläger und Beklagter.
Ansprech- und Verhandlungspartner des Klägers während seiner Vertragsverhandlungen mit der XY GmbH war deren Geschäftsführer [--]. Zehn Mitarbeiter der Beklagten waren parallel für einen kurzen Zeitraum an Randepisoden beteiligt. An den Vertragsverhandlungen mit dem Kläger war keiner der zehn Mitarbeiter der Beklagten zu irgendeinem Zeitpunkt beteiligt. Es ist lebensfremd, aus dem gelegentlichen Austausch von Meinungen am Rande von Vertragsverhandlungen einerseits bzw. dem einmaligen Übersenden einer Excel-Tabelle auf Bitten eines Kunden andererseits ein auskunftsvertragliches Schuldverhältnis mit dem Kläger konstruieren zu wollen.

We are grateful for the extension granted for submitting our statement of case and take the following view of the Claimant's statement of case of 20th June 2014:
In his most recent statement the Claimant has again failed to demonstrate the coherence of his claim. Instead, he attempts to make a connection with the bonds issued by XY GmbH and gets lost in polemics in the attempt. For the Claimant to assert the Defendant “pulled a fast one on him” is simply absurd.
The unsubstantiated claim that XY GmbH became insolvent in the summer of 2009 runs along the same lines. Analysts were still publishing positive research reports about XY GmbH in the summer of 2009 and an application to open insolvency proceedings was only made at the end of 2011. Against this backdrop, this kind of talk also turns out to be nothing more than cheap propaganda, to put it kindly.
The Claimant, however, still does not manage to conceal the crucial point of the case: no obligation actually exists between the Claimant and the Defendant.
During their negotiations with XY GmbH, [--], the Claimant’s managing director, was the contact person and negotiating partner. Ten of the Defendant’s employees were involved in brief conversations on the fringes at the same time. Not one of the Defendant’s ten employees was involved in the contractual negotiations with the Claimant at any point in time. It is a flight of fancy to try to construe either incidentally exchanging opinions on the fringes of contractual negotiations, or sending an Excel spreadsheet on a single occasion at a client’s request, as an obligation arising from a contract to provide information to the Claimant.
