English to Spanish: Review of a UK Court Ruling General field: Law/Patents Detailed field: Law (general)
Source text - English KV, a national of Sri Lanka and of Tamil ethnicity, comes to the UK and claims asylum.
He alleges that he was tortured by government forces there in the course of detention on suspicion of association with the LTTE (“the Tamil Tigers”).
He has five long scars on his back and two shorter scars on his right
arm, all of which were on any view the product of branding with a hot
metal rod.
He contends that they are evidence of the torture.
But the tribunal in effect concludes that the scars represent wounding
which was Self-Inflicted By Proxy (“wounding SIBP”), in other words
which was inflicted by another person at KV’s own invitation in an
attempt on his part to manufacture evidence in support of a false asylum claim.
It dismisses his appeal against the refusal of asylum.
By a majority the Court of Appeal, [2017] EWCA Civ 119, [2017] 4 WLR 88, dismisses his further appeal and, in doing so, makes controversial observations about the limit of the role of a medical expert in contributing to the evidence referable to a claim of torture.
Now KV brings a third appeal to this court.
This court must address the Court of Appeal’s controversial observations.
They raise the point of general public importance which precipitated the grant to him of permission to appeal.
But the disposal of his appeal will instead depend on whether he
persuades us of an error of law, in particular an error of reasoning, in the dismissal of his appeal on the part of the tribunal.
Translation - Spanish KV, ciudadano ceilandés de origen tamil, llegó al Reino Unido solicitando asilo.
Él alega que allá fue torturado por fuerzas gubernamentales en el curso de una detención bajo cargos por asociación con LTTE (los Tigres Tamiles).
Él presenta cinco largas cicatrices en su espalda y dos más cortas en su brazo derecho, todas cuales y a toda vista fueron causadas por
demarcación con hierro caliente.
Él contesta que son evidencia de la tortura.
No obstante el tribunal de la causa concluye que las cicatrices presentan heridas auto infligidas por tercera persona, en otras palabras, infligidas por otra persona a petición del propio KV en un intento de fabricar evidencia para sustentar una solicitud falsa de asilo.
El tribunal no accede a su apelación contra la negación de asilo.
Por mayoría de la Corte de Apelaciones, [2017] Corte de Apelaciones de Inglaterra y Gales, de lo civil 119, [2017] 4 Revista Legal Semanal 88, niega la apelación y, en consecuencia, realiza observaciones

Ahora KV apela por tercera ocasión a esta Corte.

The Parties expressly agree to abide by the standards, terms and conditions of the International Chamber of Commerce non- circumvention and non- disclosure guidelines. This Agreement i5 a confidential document and may nat be distributed orreused by any persons pertaining to this Agreement. All Parties hereby agree not to circumvent each other, nor attempt to circumvent any of the clients that each Party may introduce to each other from time to time in order to facilitate any proposed transaction in any manner whatsoever, directly or indirectly through the use of any third party, for a period of five (5) years, or the maximum period of time as allowed under applicable law, from the effective date of this Agreement.
Section II
Further Actions. The Parties shall execute any documents and take all appropriate actionsas
maybe necessary to give effect to the Joint Venture. The Parties shall, withreasonable due- diligence, do all such things and provide all such reasonable assurances as may be required to consummate this Agreement. Each Party shall execute and deliver such further documents or instruments required by theother Parties as may be reasonably necessaryor desirable to affect the purpose of this Agreement and carry out its provisions. Los objetos principales de la sociedad son, ya sea en la República de Panamá o en cualquier parte del mundo a) Importación y Exportación de artículos electrónicos b) Distribución de artículos electrónicos c) Adquirir o emprender la totalidad del negocio o parte de los bienes y pasivos aceptables para los propósitos de la sociedad llevados por cualquier persona o compañía, así como contribuir o disolver o liquidar el mismo así adquiridos. d) Tener una o más oficinas y llevar a cabo o conducir sus operaciones y hacer todo cuando fuere conducente al logro de los objetivos sociales en la República de Panamá, y en todos o cualquiera territorio y países extranjeros, colonias, dependencias, dominios, y estados; así como llevar los libros y cuentas de la sociedad en cualesquiera lugar o lugares, ya sea dentro o fuera de la República de Panamá, y procurar la inscripción ohabilitación o reconocimiento de la misma manera con arreglo a las leyes de tales lugares o cualquier lugar del mundo;

Cualquier incumplimiento de la Condición 1 (a), (b) o (c) señaladas arriba, por parte del Asegurado, dará derecho a la Aseguradora y a su discreción de rescindir esta Póliza desde su fecha de inicio y todos los reclamos se tendrán por extinguidos.
Condiciones de Reclamos Precedentes a la Responsabilidad
Las siguientes Condiciones son las Condiciones Precedentes a la Responsabilidad de la Aseguradora. No se realizará el pago de ningún reclamo salvo que haya entero y completo cumplimiento con estas Condiciones por parte del Asegurado.
(a) Notificación
El Asegurado dará notificación a la Aseguradora, tan pronto sea posible, de:

Any breach of Condition 1 (a), (b) or (c) above by the Insured will entitle the Insurer at their discretion to terminate this Policy from the date of inception and
ail claims shall be forfeited.
Claims Conditions Precedent to Liability
The following Conditions are Conditions precedent to the Insurer's liability. No claim will be paid unless full and complete adherence to these Conditions is maintained by the insured.
(a)Notification
The Insured shall give notice to the Insurer, as soon as is practicable, of:
(i)any claim made against the Insured or
(ii)any Circumstance or
(iii)the discovery of or any reasonable cause for suspicion of any dishonest or fraudulent act or omission on the part of any Employee or any Appointed Representative.

Born in Panama City, Panama, in the early 80's, I had the opportunity to grow and attend school in the US for a few years. Upon my return to my birthplace, I attended bilingual schools where I continued to learn English (and Spanish) natively. I have worked in Technology, Human Talent, Security and Legal fields within international and domestic companies with proper use of English and Spanish. Additionally, I have worked with languages since 2001, and became a licensed translator/interpreter in 2010. As a multifaceted individual I completed various studies and courses such as accounting, sound edition, and flight school, and obtained a bachelor degree in Law on 2018 getting admitted as an attorney on 2019.
