Source text - English Extrajudicial responses to suspected drug-related offences
1. Under the international drug control treaties, States are required to be proportionate and to apply the rule of law in their responses to drug-related offences and their treatment of suspected offenders. In the outcome document of the special session of the General Assembly on the world drug problem held in 2016, the international community reiterated its commitment to respecting, protecting and promoting all human rights, fundamental freedoms and the inherent dignity of all individuals and the rule of law in the development and implementation of drug policies.
2. The drug control conventions require criminal justice responses to drug-related criminality, which include internationally recognized due process standards and which reject extrajudicial sanctions of any nature. With respect to drug abuse, the conventions commit to a humane and balanced approach, requiring the parties to give special attention to and take all practicable measures for the prevention of drug abuse and the early identification, treatment, education, aftercare, rehabilitation and social reintegration of the persons affected.
3. Extrajudicial responses to drug-related criminality can never be justified under the international drug control conventions, which require that drug-related crime be addressed through formal criminal justice responses, an approach consistent with the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which require adherence to internationally recognized due process standards.
Translation - Arabic التعامل خارج نطاق القانون مع الأشخاص المشتبه في ارتكابهم جرائم متصلة بالمخدِّرات
١- يشترط على الدول، بموجب المعاهدات الدولية لمراقبة المخدِّرات، مراعاة التناسب واحترام سيادة القانون في إجراءاتها المتخذة للتصدي للجرائم المتصلة بالمخدِّرات ومعاملتها للجناة المشتبهين. وفي الوثيقة الختامية الصادرة عن الدورة الاستثنائية للجمعية العامة المنعقدة في عام 2016 بشأن مشكلة المخدِّرات العالمية، أعاد المجتمع الدولي تأكيد التزامه باحترام وحماية وتعزيز جميع حقوق الإنسان والحريات الأساسية والكرامة المتأصلة للأفراد كافة وسيادة القانون لدى صوغ السياسات الخاصة بالمخدِّرات وتنفيذها.
٢- وتتطلب الاتفاقيات الدولية لمراقبة المخدِّرات اتِّخاذ تدابير في إطار العدالة الجنائية للتصدي للجرائم المتصلة بالمخدِّرات، مما يشمل التقيُّد بمعايير الإجراءات القانونية الواجبة المعترف بها دوليا، ورفض العقوبات المفروضة خارج إطار القانون أيًّا كانت طبيعتها. وفيما يخص تعاطي المخدِّرات، تُلزم الاتفاقيات الدول باتباع نهج إنساني ومتوازن يتطلب من الأطراف أن تولي اهتماماً خاصًّا لمنع تعاطي المخدِّرات وأن تتَّخذ جميع التدابير الممكنة عمليًّا لدرئه والاستبانة المبكِّرة للأشخاص المتضررين، وعلاجهم وتثقيفهم ومتابعة رعايتهم وإعادة تأهيلهم وإعادة إدماجهم في المجتمع.
٣- ولا يمكن تبرير إجراءات التصدي خارج نطاق القضاء للجرائم المرتبطة بالمخدِّرات بالاتفاقيات الدولية لمراقبة المخدِّرات، فهذه الاتفاقيات تشترط أن يكون التصدي للجرائم المرتبطة بالمخدِّرات من خلال تدابير العدالة الجنائية الرسمية، وهو نهج يتماشى مع الإعلان العالمي لحقوق الإنسان والعهد الدولي للحقوق السياسية والمدنية، اللذين يشترطان الالتزام بالمعايير المعترف بها دوليًّا للمحاكمة القانونية الواجبة.

Fin janvier 2011, nous marchions avec les jeunes égyptiens dans les rues du Caire. Nous les avons photographié affronter les bombes lacrymogènes et les matraques des policiers anti-émeutes. Ils criaient à leurs compatriotes qui les observaient, médusés, depuis leurs balcons :
«Descends ! Descends !».
J'étais fasciné par votre courage démesuré pour « prendre » la place Tahrir.
Vous avez entraîné tout le pays dans la révolte, déboulonnant Hosni Moubarak, président indétrônable depuis près de trente ans, en seulement 18 jours de soulèvement.
Sans le savoir, nous nous sommes sûrement croisés à l’époque.
Moubarak parti, nous avons, chacun à notre manière, continué à photographier les transformations sociales, les soubresauts politiques, la vie quotidienne. Avec cette envie partagée d’être au plus près de ce que les Égyptiens vivaient. Mais à l’été 2013, ta carrière prometteuse s’est brutalement arrêtée.
L’armée a repris fermement le pouvoir. La situation pour les journalistes et photographes était très hostile. Enceinte, j’ai dû quitter le pays. Arrachée à l’endroit où je me sentais chez moi.
En mai 2014, j’ai repris mon travail en Égypte. Mais la plupart de mes photos depuis n’évoque plus cet incroyable mouvement mais plutôt une répression sanguinaire.
Shawkan, tes images nous manquent aujourd'hui. Elles nous manquent pour raconter les suites de la révolution égyptienne
Shawkan est en prison depuis plus de 4 ans. Aujourd’hui, il risque d’être condamné à mort parce qu’il portait un appareil photo.
Translation - Arabic عزيزي شوكان،
كنا، أنا وأنت، نتظاهر في أواخر شهر يناير من عام 2011 مع الشباب المصري في شوارع القاهرة. كنا نلتقط صوراً لهم وهم يواجهون القنابل المُسيلة للدموع وعصي شرطة مكافحة الشغب. كان الشباب يصرخون في أبناء بلدهم الذين يتفرجون من شرفات منازلهم مصعوقين:
"انزل! انزل!".
كنت مبهورةً برباطة جأشك المتناهية في عزمك "احتلال" ميدان التحرير.
لقد ألقيت البلد برمتها في براثن الثورة التي أطاحت بحسني مبارك، الرئيس الذي لم يهزمه أحد طوال ثلاثين عاماً، في 18 يوماً فقط.
أكيدٌ أننا التقينا آنذاك دون أن نعلم.
وبعد رحيل مبارك، واصلنا، كل منا بطريقته، تصوير التحولات الاجتماعية والاضطرابات السياسية وأحداث الحياة اليومية. كان القاسم المشترك بيننا هو تلك الرغبة في أن نكون قريبين ما أمكن مما يعيشه المصريون. غير أن مشوارك الواعد توقف فجأة في صيف عام 2013.
فالجيش استولى على السلطة بقبضة من حديد. وبات الوضع عدائياً للغاية بالنسبة للصحفيين والمصورين. ولكوني حاملاً اضطُررت إلى ترك البلد. اجتُثت جذوري من المكان الذي كنت أشعر فيه بالانتماء.
ثم عُدت إلى عملي في مصر في أيار 2014. غير أن معظم صوري التي التقطتها مُذ ذاك الحين لم تعد تعكس ذاك الحراك المُذهل، بل قمعاً دموياً متناهياً.
شوكان، اشتقنا لصورك اليوم. فنحن نحتاجها لنقُص ما تبقى من حكاية الثورة المصرية.
شوكان مسجونٌ منذ أكثر من 4 سنوات. واليوم، قد يُحكم عليه بالإعدام لأنه كان يحمل آلة تصوير.
