Source text - English ʿUt̲h̲mān was assassinated in Ḏh̲u ’l-Ḥid̲j̲d̲j̲a 35/June 656. About four months later ʿĀʾis̲h̲a left Mecca for Baṣra along with about 1,000 men of Ḳurays̲h̲, professing to be taking vengeance for ʿUt̲h̲mān. Shortly before this she had been joined by Ṭalḥa and al-Zubayr. The three were now leaders of a movement in opposition to ʿAlī. They obtained control of Baṣra, and with many of the Muslims of that city marched to the outskirts to meet ʿAlī who had meantime left Medina for Kūfa, and was advancing against them. | Translation - Arabic
وقد اغتيل عثمان في ذي الحجة من عام 35 هجرية، الموافق لشهر يونيو من عام 656 للميلاد، وبعد حوالي أربعة أشهر غادرت عائشة مكة إلى البصرة برفقة حوالي 1000 رجل من قريش أعلنوا عزمهم على القصاص لدم عثمان، وكان طلحة والزبير قد انضما إليها قبل ذلك بفترة وجيزة فأصبح الثلاثة قادة حركة المعارضة لعليّ وبسطوا سيطرتهم على البصرة وساروا إلى ضواحيها برفقة جمع من مسلميها لملاقاة عليّ الذي كان قد خرج في ذلك الحين من المدينة متوجهاً إلى الكوفة لملاقاتهم. |

Xenophanes left in the Persian conquest of Ionia in 545 (DSB, 1981: 14:536), Pythagoras perhaps 15 years later. The shift in philosophy that came with the move to Magna Graecia is not a matter of geographical determinism. The “Italian” or “Eleatic” schools were continuations of the Ionian networks; the “Italian” (actually Sicilian) Empedocles produced an eclectic combination fourelement scheme (earth, air, fire, water) by recombining the material elements of Ionian cultural capital. | Translation - Arabic لكن بعض العوامل السياسية الخارجية أدت إلى تفتيت هذا المنظومة المحليّة أواخر القرن الخامس قبل الميلاد حيث رحل كزينوفانس (Xenophanes) إلى بلاد فارس أثناء الغزو الفارسي لمنطقة أيونيا عام 545 ق. م. Source text - English أكثر الفقياء الحنفيّة وبعض الشّافعيّة عبّروا عنه بالكراهة إذا كان يضر بالناس. وتصريح الحنفية بالكراهة على سبيل الإطلاق ينصرف إلى الكراهة التحريمية. وفاعل المكروه تحريمًا عندهم يستحق العقاب، كفاعل الحرام. | Translation - Arabic Most Hanafi jurists and a group of Shafi‘is maintain that the ruling on ihtikar is karaha (disliked) if it causes public harm. It should be noted that whenever the Hanafis unrestrictedly give the ruling of makruh (disliked), they mean by it karaha tahrimiyyah (not precisely unlawful but closer to being so). For them, the person who performs an act that is makruh tahrimiyyan (disliked and close to being prohibited) deserves punishment much the same as he who performs a prohibited act. |

Source text - English 2. أن يكون الشّراء وقت الغلاء للتّجارة انتظاراً لزيادة الغلاء . وهذا ما ذهب إليه الشّافعيّة . فلو اشترى في وقت الرّخص ، وحبسه لوقت الغلاء ، فلا يكون احتكاراً عندهم .
3. اشترط الحنفيّة أن يكون الحبس لمدّة ، ولم نقف لفقهاء المالكيّة والشّافعيّة والحنابلة على كلام في هذا ، وإنّما الّذي تعرّض لذكر المدّة فقهاء الحنفيّة ، فيقول الحصكفيّ نقلاً عن الشرنبلالي عن الكافي : إنّ الاحتكار شرعاً اشتراء الطّعام ونحوه وحبسه إلى مدّة اختلفوا في تقديرها ، فمن قائل إنّها أربعون يوماً ، لقول النّبيّ صلى الله عليه وسلم فيما رواه أحمد والحاكم بسنده | Translation - Arabic 2. The hoarded stuff should have been bought when prices were high in anticipation of further rise in prices, according to the Shafi‘is. They are of the view that, if someone buys goods when prices are low and withholds them until prices get higher, this is not to be considered a case of ihtikar.
3. The Hanafis stipulated that the withholding of goods should be for a considerable period of time. The jurists of the Maliki, Shafi‘i and Hanbali schools, however, did not touch upon this issue. The Hanafis were the only ones to bring up the issue of the period of ihtikar. In relation to this, Al-Huskufi reported a statement by Al-Kafi from Al-Shronblali in which he said, “Juristically, ihtikar refers to buying and withholding food or similar stuff for a period of time, but jurists differed over how long it should be. Some said it should not be less than forty days based on the following prophetic hadith narrated by Ahmad and Al-Hakim according to the later’s chain of transmission |
