A new law passed by the Colombian government to make reparation to victims of the armed conflict has implications for the approximately 455,000 Colombians who live as refugees, asylum-seekers, or in a refugee-like situation outside the country.1
Although these vulnerable individuals may be entitled to reparation for human rights violations suffered in Colombia, the ongoing armed conflict impedes their access to this offer. This paper investigates the legal and practical implications of offering such
‘transnational’ reparations to externally-displaced victims (EDVs) in circumstances of protracted armed conflict.2
The new Victims’ Law in Colombia provides for wide-ranging reparation measures to persons who have suffered damages directly as a result of human rights violations or infractions of international humanitarian law (IHL).3 Although refugees and other
EDVs do not figure prominently in its provisions, this new legal framework generates a range of wider questions about the positioning of such persons vis-à-vis the offer of reparation from their home country, including:
To what extent does international law require the home state to address the specific needs of EDVs when designing reparation measures and procedures?
What are the international law implications of home country reparation to EDVs for third states?
What is the role of the United Nations High Commissioner for Refugees (UNHCR) – as the international agency mandated with refugee protection - in such processes?
What does ‘reparation’ mean for refugees and other EDVs, and what are their needs in this regard?
What are the political consequences of the often tense border dynamics that accompany refugee outflows for the implementation of any reparation measures for EDVs?
By addressing these questions through a Colombian case study, this paper constitutes a first step towards understanding what the provision of reparation may mean for refugees and other displaced persons where the circumstances giving rise to their displacement remain.

Una nueva ley promulgada por el gobierno de Colombia con el fin de efectuar reparación para las víctimas del conflicto armado, tiene implicaciones para las aproximadamente 455,000 personas colombianas que viven fuera del país como refugiados, solicitantes de asilo o en situación parecida a la de los refugiados. Si bien estas personas vulnerables pueden tener derecho a alguna reparación debido a las violaciones a los derechos humanos que sufrieron en Colombia, el conflicto armado continuo impide su acceso a dicho ofrecimiento. El presente trabajo investiga las implicaciones jurídicas y prácticas de ofrecer dicha reparación ‘transnacional’ a víctimas desplazadas externamente (VDE) en circunstancias de conflicto armado prolongado.
La nueva Ley de Víctimas de Colombia dispone medidas amplias de reparación para las personas que han sufrido daños como resultado directo de las violaciones a los derechos humanos o bien, de las contravenciones del derecho internacional humanitario (DIH). Aunque las personas refugiadas y otras VDE no figuran prominentemente en sus disposiciones, este nuevo marco jurídico genera una gama de cuestiones más amplias acerca del posicionamiento de dichas personas de cara al ofrecimiento de reparación de parte de su país de origen, entre ellas las siguientes:
• ¿Hasta qué punto requiere el derecho internacional que el Estado de origen aborde las necesidades específicas de las VDE, al designar medidas y procedimientos de reparación?
• Dentro del derecho internacional, ¿cuáles son las implicaciones para terceros, de que el país de origen ofrezca reparación a las VDE?
• ¿Cuál es el papel de la Oficina del Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR) en dichos procesos, teniendo este organismo internacional el mandato de brindar protección a las personas refugiadas?
• ¿Qué significa ‘reparación’ para las personas refugiadas y VDE, y cuáles son sus necesidades en este sentido?
• ¿Cuáles son las consecuencias políticas de las dinámicas fronterizas frecuentemente tensas que acompañan a los flujos de refugiados, para la ejecución de cualquier medida de reparación dirigida a las VDE?
Al abordar estas cuestiones mediante un estudio de caso colombiano, el presente documento da un primer paso hacia la comprensión de lo que podría significar para las personas refugiadas y desplazadas, proveer de reparación donde aún perduran las circunstancias que dieron lugar a su desplazamiento.

Source text - Spanish Durante más de 30 años, la alianza entre el feminismo y el desarrollo se ha reflejado en la práctica del desarrollo. En los años recientes, no obstante los obstáculos burocráticos y la resistencia a su incorporación, el discurso de la transversalidad de género ha sido un instrumento para incorporar las demandas de las mujeres en las políticas públicas como un logro del discurso de género y desarrollo, conocido como GAD approach.
Nos preguntamos si el contenido transformador del género se ha diluido al incorporarse en las agendas políticas de las instituciones de desarrollo. Mientras que algunas vertientes del feminismo buscan la incorporación del discurso del género y empoderamiento en el diseño de políticas, para los feminismos identificados en la propuesta del post desarrollo (feminismo posmoderno, postcolonial y postestructualista) (Marchand and Parpart, 1995) y aún para practicantes del GAD, (Cornwall, Harrison and Whitehead, 2007) se requiere una repolitización del feminismo y repensar su influencia en los procesos de desarrollo.
El objetivo del presente documento es realizar un análisis crítico en los enfoques de políticas para mujeres, respecto a avances, obstáculos y retos. Esto podría ser importante para generar estrategias que involucren a las mujeres cuyo desarrollo es aún una deuda pendiente.
En la primera parte analizamos el tránsito del enfoque de WID a GAD. En la segunda parte damos un contexto sobre la transveralidad y el empoderamiento y las críticas principales y en el tercer apartado hacemos una breve conclusión y las recomendaciones para repensar el género en el desarrollo.
Translation - English For more than 30 years, the link between feminism and development has been reflected in development practice. In recent years, despite bureaucratic obstacles and resistance, gender mainstreaming has become a tool for incorporating women’s demands in public policy, thus representing an important achievement for the gender and development approach (GAD).
Has the transformative content of a gender focus become diluted as it has been incorporated in the policy agenda of development institutions? While some currents within feminism seek to incorporate a gender and empowerment approach in policy design, for others associated with post-development (postmodern, postcolonial, and poststructuralist feminism) (Marchand and Parpart, 1995) and even for GAD practitioners (Cornwall, Harrison and Whitehead, 2007) , feminism needs to be re-politicized and its influence on development processes rethought.
The purpose of this document is to conduct a critical analysis of the approaches taken by policies aimed at women, with regard to progress, obstacles and challenges. This may contribute to developing strategies that actually engage women, whose development is still pending.
The first part of this paper analyses the shift from Women in Development (WID) to Gender and Development (GAD). In the second part we provide a context for gender mainstreaming and empowerment, as well as the criticism against them. The third section presents a brief conclusion and recommendations for rethinking gender and development.
