And that's the very important question of whether the contract must be in writing.
This sounds like a fairly simple question, but there are a lot of subtleties related to this question.
And fundamentally the question is, must the agreement be in writing.
And, there are two basic situations.
First of all there's a situation where it is in writing.
And second, there's a situation where it is not in writing and if it isn't in writing, there are two sub questions.
Is there writing required?
And then there's a practical approach I want to talk about to avoid legal complications.
