Source text - Chinese 十、将第三十八条改为第四十二条，第一款修改为："辩护人或者其他任何人，不得帮助犯罪嫌疑人、被告人隐匿、毁灭、伪造证据或者串供，不得威胁、引诱证人作伪证以及进行其他干扰司法机关诉讼活动的行为。" 十一、增加一条，作为第四十六条："律师对在执业活动中知悉的委托人的有关情况和信息，有权予以保密。但是，律师在执业活动中知悉委托人或者其他人，准备或者正在实施危害国家安全、公共安全以及严重危害他人人身安全的犯罪的，应当及时向司法机关通报。"	Translation - English (10) Article 38 shall be changed to article 42 and paragraph 1 thereof be amended to read: “A defender or any other person shall not assist a suspect or a defendant in concealing, destroying and falsifying evidence or in giving a colluded statement; nor shall a defender or any other person threaten or coerce a witness to commit perjury and perform other acts that interfere with the procedures of the judicial authorities.” (11) A new article shall be inserted as article 46 to read: “An attorney shall have the right to maintain confidentiality about information that he or she obtains about a client while performing his or her professional duty. Nevertheless, where an attorney comes to know, while performing his or her professional duty, that a client or any other person is preparing or performing a criminal act that threatens national security or public safety or gravely threatens the personal safety of other persons, he or she shall promptly notify the judicial authorities of such act.”

Source text - Chinese 虽然“不正当竞争”（concurrence déloyale）的概念由法国首创，世界上第一部反不正当竞争法却诞生于同属大陆法系的德国而非法国。德国反不正当竞争法的立法模式曾为部分欧洲国家、日本、韩国乃至我国反不正当竞争法立法所效仿，该法于1909年设立的关于为经济竞争目的违背善良风俗始构成不正当竞争的“一般条款”（Generalklausel）（第1条），更是备受各国学者和司法界推崇，然而，2004年，为与欧盟法同步发展，德国立法者借鉴《瑞士联邦反不正当竞争法》的结构体系，对实施了百余年的反不正当竞争法进行大刀阔斧的改革。在新法第1条中首设保护竞争者、消费者和其他市场参与者的“保护目的”（Zweck des Gesetzes）条款，旧法中被誉为 “皇冠”的“一般条款”由第3条取代，在其核心判断标准上用“不公平性”（Unlauterkeit）置换“善良风俗”（gute Sitten）。	Translation - German Das Konzept des unlauteren Wettbewerbs hat zwar seinen Ursprung in Frankreich (concurrence déloyale), jedoch entstand das weltweit erste Gesetz gegen den unlauteren Wettbewerb in Deutschland, welches wie Frankreich zum kontinental europäischen Rechtskreis gehört. Das deutsche Gesetz gegen den unlauteren Wettbewerb wurde von einigen europäischen Staaten, Japan, Korea und China übernommen, und die Generalklausel (§ 1), welche besagt, dass der Verstoß gegen gute Sitten für wirtschaftliche Wettbewerbszwecke als unlauterer Wettbewerb anzusehen ist, wurde von Akademikern und Justizfachleuten hoch anerkannt. Um eine gemeinsame Entwicklung mit der Europäischen Union anzustreben, führte Deutschland 2004 jedoch auf der Basis des Schweizer Bundesgesetzes gegen den unlauteren Wettbewerb eine drastische Reform des Gesetzes durch, das bis dahin seit über hundert Jahren angewandt wurde. Im § 1 befindet sich nunmehr eine Klausel zum Zweck des Gesetzes, die den Schutz von Mitbewerbern, Verbrauchern und sonstigen Marktteilnehmern vorsieht. Die alte als „Krone“ angesehene Generalklausel wurde durch § 3 ersetzt, und Entscheidungskriterien beruhen nun auf dem Konzept der „Unlauterkeit“ an Stelle von „guten Sitten“.
