INFORMATION SUR LA PROCÉDURE ET VOS DROITS
INTERPRÉTARIAT ET TRADUCTION
Si vous ne comprenez pas la langue française, vous avez le droit de bénéficier d'un interprète et d'une traduction des informations indispensables à l'exercice de vos droits, notamment des mentions essentielles du présent récépissé de dépôt de plainte, les décisions de classement sans suite, les ordonnances de non-lieu et les décisions de condamnation, de relaxe ou d'acquittement
DECLARATION DU DOMICILE
Vous pouvez déclarer comme domicile l'adresse d'un tiers sous réserve de l'accord exprès de celui-ci. Il vous incombe donc d'obtenir cet accord par écrit.
Sur autorisation du procureur de la République, vous pouvez également déclarer comme domicile l'adresse de la Gendarmerie. Si le magistrat l'autorise, vous serez alors tenu(e) de signaler tout changement de domicile à la gendarmerie qui a reçu votre déclaration pour une durée d'un an.
MESURES DE PROTECTION
Vous pouvez bénéficier, au cours de la procédure pénale, de mesures de protection vous permettant d'être entendu (e) ou examiné (e)audition selon ce qui est strictement nécessaire à la procédure et dans des conditions les plus adaptées à votre situation. Si l'autorité judiciaire l'estime nécessaire, ces mesures pourront être renforcées, après une évaluation approfondie de vos besoins.
Si vous êtes victime de violences exercées par votre conjoint ou par un ancien conjoint, un ancien partenaire lié par un pacte civil de solidarité ou un ancien concubin et que ces violences vous exposent ou exposent vos enfants à un danger, vous pouvez notamment bénéficier d'une ordonnance de protection prévue au titre XIV du livre 1er du code civil. Vous pouvez également être informées des peines encourues par les auteurs de ces violences et des conditions d'exécution des éventuelles condamnations qui pourraient être prononcées.
ACCOMPAGNEMENT AU COURS DE LA PROCÉDURE
Vous bénéficiez du droit d'être accompagné(e), à votre demande, à tous les stades de procédure, par votre représentant légal, si vous êtes mineur(e) ou majeur(e) protégé(e) et par la personne majeure de votre choix, sauf décision contraire motivée prise par l'autorité judiciaire compétente.
POURSUITES ET ALTERNATIVE AUX POURSUITES
Le procureur de la République peut, si l'auteur est identifié, décider d'exercer des poursuites en saisissant directement une juridiction de jugement ou en ouvrant une information judiciaire devant le juge d'instruction.
S'il décide de classer sans suite la procédure, le procureur de la République vous avisera de sa décision en indiquant les raisons juridiques ou d'opportunité qui la justifient.
Vous pourrez alors former un recours auprès du procureur général près la Cour d'appel contre la décision de classement sans suite. Le procureur général pourra enjoindre au procureur de la République d'engager des poursuites. S'il estime le recours infondé, il vous en informera.
Le procureur de la République peut également proposer à l'auteur des faits une mesure de médiation pénale ou de composition pénale qui débouchera sur un classement sans suite de l'affaire, si la mesure proposée est correctement exécutée.
La réparation de votre préjudice sera prise en compte dans les obligations imposées à l'auteur des faits. Si une telle mesure est décidée, vous en serez avisé(e) et vous pourrez demander à un avocat de vous assister.
RÉPARATION DU PRÉJUDICE
Vous avez le droit d'obtenir la réparation de votre préjudice, par l'indemnisation de celui-ci ou par tout autre moyen adapté, y compris, s'il y a lieu, une mesure de justice restauratrice. Ces moyens d'obtenir réparation de votre préjudice peuvent vous être expliqués par le bureau d'aide aux victimes du tribunal de grande instance ou toute association compétente dans l'assistance aux victimes.
Pour obtenir réparation de votre préjudice, vous êtes en droit de vous constituer partie civile
1°) soit dans le cadre de la mise en mouvement de l'action publique par le procureur de la République :
-> Si une information est ouverte par le procureur de la République, la constitution de partie civile sera possible à tout moment devant le juge d'instruction, lequel vous en informera personnellement.
-> Si l'affaire est audiencée devant le tribunal correctionnel, le tribunal pour enfants ou le tribunal de police, vous serez avisé(e) de la date d'audience et vous pourrez vous constituer partie civile(1) :
* soit en personne, en vous rendant au greffe du tribunal avant l'audience pour faire une déclaration ou en vous présentant au début de l'audience avec les pièces justificatives de votre préjudice
* soit par lettre recommandée avec accusé de réception ou par télécopie qui doit parvenir, accompagnée des pièces justificatives de votre préjudice, au tribunal, vingt-quatre heures au moins avant la date d’audience
* soit par l’intermédiaire d’un avocat ;

INFORMATION ON THE PROCEEDINGS AND YOUR RIGHTS
INTERPRETING AND TRANSLATION
If you do not understand the French language, you have the right to an interpreter and to a translation of the information required to exercise your rights, notably the essential information in this record of complaint, rulings for nonsuit, writs of nolle prosequi, and for sentencing, release and acquittal.
DECLARATION OF DOMICILE
You may declare the address of a third party as your domicile on condition that you have their express agreement. Therefore, it is incumbent upon you to obtain this agreement in writing.
With the authorisation of the Public Prosecutor, you may also declare the Gendarmerie as your domicile. If the magistrate so authorises, you will then be responsible for informing the gendarmerie where your statement was recorded of any change in domicile over a period of one year.
PROTECTIVE MEASURES
During the criminal proceedings, you can benefit from protective measures that enable you to be heard or examined, according to the strict necessity of the proceedings and under the conditions that are most adapted to your situation. If the legal authority considers it necessary, these measures could be reinforced after an in-depth assessment of your needs.
If you are the victim of violence inflicted by your spouse, a former spouse, a former spouse with whom you have a civil solidarity pact, or a former partner, and these acts of violence expose you or your children to danger, you can benefit notably from a restraining order as stipulated in Title XIV of Book 1 of the French Civil Code. You can also be informed of the sentences for the persons responsible for the violence and the conditions of any sentencing that might be passed.
SUPPORT DURING THE PROCEEDINGS
At your request, you have the right to receive support from your legal representative at all stages of the proceedings, if you are a minor or a protected adult, and by the adult person of your choice, unless a reasoned decision to the contrary was made by the competent legal authority.
PROSECUTION AND ALTERNATIVE TO PROSECUTION
If the responsible person is identified, the Public Prosecutor can decide to prosecute by directly referring the case to a trial court or by opening a preparatory inquiry before the investigating judge.
If there is a nonsuit ruling, the Public Prosecutor will inform you of the decision and indicate the legal reasons or circumstance that justifies it.
You can then file an appeal against the nonsuit ruling through the General Prosecutor at the Court of Appeal. The General Prosecutor can enjoin the Public Prosecutor to prosecute. If he considers the appeal to be groundless, he will inform you.
The Public Prosecutor can also offer the responsible person the possibility to take measures for mediation or a settlement which will result in a nonsuit ruling if the measure is correctly executed.
Redress for the harm you were subjected to will be taken into account in the obligations imposed on the person responsible. If a decision is made to take such measures, you will be notified and can ask a lawyer to assist you.
REDRESS FOR HARM
You have the right to obtain redress for the harm you were subjected to by compensation or any other appropriate means, including, if applicable, restorative justice. These means of obtaining redress can be explained to you by the victims' assistance office at the regional court or any competent victims' assistance association.
To obtain redress, you have the right to sue for damages.
1°) either in the framework of prosecution by the Public Prosecutor:
-> If the Public Prosecutor commences an investigation, suing for damages will be possible at any moment through the investigating judge, who will inform you personally.
-> If the case is brought before the criminal court, the youth court or the district court, you will be notified of the hearing date and you can sue for damages (1):
* either in person, by appearing before the hearing at the court registry to make a statement or at the beginning of the hearing with the supporting documents of the harm you suffered.
* or by registered letter with acknowledgement of receipt or by fax which should be accompanied by supporting documents of the harm you suffered, to the court at least twenty-four hours before the date of the hearing

PONCTION BIOPSIE HEPATIQUE
Renseignements cliniques :
Localisation hépatique d'un carcinome neuro-endocrine peu différencié. Complément d'études pour la mise en évidence d'un éventuel phénotype MSI.
Examen microscopique :
Il a été communiqué un prélèvement formé d'une carotte biopsique mesurant environ 20 mm de longueur. A l'une de ses extrémités, on retrouve un fragment de parenchyme hépatique bien identifiable. Le reste du prélèvement est massivement infiltré par une prolifération tumorale organisée en massifs et en cordons séparés par un stroma abondant d'aspect desmoplasique, relativement riche en vaisseaux. La prolifération tumorale est constituée par des cellules de taille moyenne à grande, à cytoplasme peu abondant et basophile et à noyaux allongés. L'aspect est bien celui d'un carcinome neuro-endocrine peu différencié. Le type histologique est difficile à affirmer avec certitude : les cellules sont de taille relativement importante mais leurs noyaux présentent les caractéristiques morphologiques plutôt en faveur d'un type à petites cellules. Il n'a pas été observé de foyer de nécrose.
A noter la présence d'emboles vasculaires dans les espaces-portes voisins adjacents à la prolifération tumorale.
Nous avons réalisé l'étude immunohistochimique des 4 protéines MMR.

Il existe une expression intense de MSH2 et de MSH6 dans 100% des cellules tumorales. Il existe une expression modérée de MLH1 dans 80% des cellules tumorales. On observe une expression faible de PMS2 dans environ 50% des cellules tumorales.

LIVER BIOPSY
Clinical information:
Poorly differentiated neuroendocrine carcinoma located in the liver. Additional tests required to demonstrate a possible MSI phenotype.
Microscopic examination:
A biopsy specimen measuring approximately 20mm long was received. At one end of the specimen a clearly identifiable liver parenchyma fragment can be noted. The remainder of the specimen is massively infiltrated by a proliferation of tumours organised in clumps or clusters separated by a thick stroma that is desmoplastic in appearance with a relatively rich network of blood vessels. The tumour proliferation consists of medium to large cells, with scant basophilic cytoplasm and an elongated nucleus. It does actually have the appearance of a poorly differentiated neuroendocrine carcinoma. The histological type is difficult to affirm with certainty: the cells are relatively large but their nuclei present morphological features that rather correspond to a small-cell type. No necrotic focus was detected.
Of note is the presence of vascular emboli in the neighbouring Kiernan's spaces adjacent to the tumour proliferation.
Immunohistochemistry testing of the 4 MMR proteins was performed.

There is a high expression of MSH2 and MSH6 in 100% of the tumour cells and a moderate expression of MLH1 in 80% of the tumour cells. A low expression of PMS2 can be noted in approximately 50% of the tumour cells.
