In PCI, the emergence of drug-eluting stents decreased the restenosis rate to about 5%. However, drug-eluting stents are known to have a risk of causing late/very late stent thrombosis. To avoid this, long-term dual antiplatelet therapy with aspirin and a thienopyridine drug is required. Long-term dual antiplatelet therapy may cause an issue such as hemorrhagic complications. In addition, in-stent restenosis and lesions that are unsuitable for stent placement, such as small vessels, bifurcations, angulations, and moving parts, were issues for drug-eluting stents. Then, the possibility of drug delivery by a balloon catheter for lesions that are unsuitable for stent placement was focused on. Since a drug-eluting balloon is also called drug coated balloon, it can be abbreviated DCB.

Notwithstanding the provisions of preceding clauses, in the event that any Party fails to comply or does not comply totally or in part, regarding the obligations under this Contract, except for the obligation to pay for the leasing fee, it must recognize and pay on behalf of the complying Party - as a penalty and enforcement title -, an amount equivalent to three (3) monthly fees, notwithstanding that the complying Party may require further forced execution regarding the unmet liabilities or obligations or termination of the Contract, both with compensation for the damage caused, if any, in accordance with Article 1600 of the Civil Code. Therefore, the stipulated penalty shall not be understood as an early damage assessment.
Translation - Spanish DÉCIMA SEXTA.- CLÁUSULA PENAL:
Sin perjuicio de lo establecido en las cláusulas anteriores, en el evento en que alguna de las Partes no cumpla o no se allane a cumplir, en todo o en parte, las obligaciones derivadas de este Contrato, salvo por la obligación del pago del canon de arrendamiento, deberá reconocer y cancelar a favor de la Parte cumplida, a título de pena y con función de apremio, una suma equivalente a tres (3) cánones mensuales, sin perjuicio de que la Parte cumplida pueda exigir, además, la ejecución forzada de la o las obligaciones insatisfechas o la resolución del Contrato, en ambos con el resarcimiento de los perjuicios causados, en su caso, de conformidad con el artículo 1600 del Código Civil.
