Source text - English The Community Design was instated as part of Council Regulation No 6/2002. A Community Design is basically a trademark on the design of a product, whether it be software, hardware, or packaging. It is filed at the Office for Harmonization in the Internal Market (OHIM), and once granted, is valid in the entire European Union. Initially it is valid for a period of five years, but it can be extended five times to reach a total of 25 years. Every member state has several Community Design courts, which are regular courts allowed to take on matters relating Community Designs. So far, nothing special.
However, there are several reasons why the Community Design - as it stands today - is basically a tool which companies can use to receive free preliminary injunctions. The way that the Community Design is set up favours large companies heavily, allowing them to use it as a club to ban each other's products from entering the European Union.

Un « dessin ou modèle communautaire » est en fait une marque déposée sur l'apparence d'un produit quelconque, logiciel, appareil ou même emballage. Pour en obtenir un, il faut déposer à l'Office de l'Harmonisation dans le Marché Intérieur (OHMI) une demande qui, une fois accordée, est valide dans l'ensemble de l'Union Européenne. La période de protection accordée est au départ de cinq ans mais elle peut être prolongée à cinq reprises, pour une durée totale de 25 ans. Chaque état membre dispose de plusieurs tribunaux habilités à traiter les affaires liées aux dessins et modèles communautaires. Jusque là, rien de bien surprenant.
Cependant, il existe plusieurs raisons pour lesquelles le concept de « dessin ou modèle communautaire » est, dans sa forme actuelle, un outil à la disposition des entreprises grâce auquel elles peuvent obtenir à peu de frais des injonctions préliminaires. Le principe actuel des dessins et modèles communautaires fait la part belle aux grandes entreprises: il leur permet d'en user comme d'une arme pour interdire aux concurrents l'accès au marché européen.
