Source text - English Petiționarii, cetățeni ai Nigeriei care își fac studiile în Moldova, au susținut că au fost discriminați de către colaboratorii Poliției de Frontieră a sectorului „Aeroportul Internațional Chișinău” prin faptul că nejustificat au fost supuși unui control mai detaliat, iar ulterior le-au refuzat îmbarcarea în avion, cauzându-le prejudiciu material și moral semnificativ.
Consiliul a constata că, în conformitate cu art.1 și art. 2 din Legea cu privire la asigurarea egalității nr. 121/2012, faptele examinate reprezintă instigare la discriminare rasială (profilare rasială).
Consiliul a stabilit că drept motiv pentru stoparea petiționarilor a servit prezența suspiciunilor referitor la veridicitatea actelor de identitate și a vizei. Consiliul a notat că în aceste circumstanțe era firesc pentru colaboratorii Poliției de Frontieră să demareze un control suplimentar al actelor de identitate. Consiliul a reținut că în cazul în care colaboratorii admit la zbor pasageri cu documente nevalabile, riscă penalități. Consiliul a stabilit că stoparea petiționarilor pentru a se asigura că actele sunt în regulă a urmărit un scop legitim.
Cât privește procedura de verificare, Consiliul a stabilit că în timpul controlului colaboratorii de poliție au telefonat instituția de învățământ a petiționarilor pentru a stabili dacă într-adevăr ei sunt studenți. Consiliul a subliniat că Poliția de Frontieră a Republicii Moldova nejustificat a cerut confirmări de la instituția de învățământ a petiționarilor despre situația lor, având în față permisul legal de ședere pe teritoriul Republicii Moldova. Consiliul a calificat aceste acțiuni, ca fiind denigratoare, utilizate pentru a identifica după aparențe și trăsături fizice persoane de anumite etnii sau rase pentru ai supune la verificări mai riguroase și a le limita libertatea de circulație fără să ofere vreo explicație.
Translation - Romanian The applicants, Nigerian nationals studying in Moldova, claimed that they had been discriminated against by the Border Police officers at the Chisinau International Airport by being submitted with no justification to more thorough checks and by later being denied boarding with significant material and non-material damages.
The Council found that, according to Art. 1 and Art. 2 of Law no. 121/2012 on ensuring equality, the facts under examination were incitement to racial discrimination (racial profiling).
The Council established that the reason for stopping the applicants was the suspicion around the authenticity of their ID papers and visa. The Council noted that under those circumstances, the Border Police officers had to initiate additional checks of their ID papers. The Council found that where officers allow the boarding of passengers with invalid documents, they are likely to face penalties. The Council established that stopping the applicants in order to make sure that their papers were in order had a legitimate purpose.
As far as the checking procedure was concerned, the Council established that during the checks the police officers called the applicants' educational establishment to determine whether they were indeed students. The Council stated that had there been any suspicions around the authenticity of the ID papers or visa, they should have been investigated by contacting the issuing authority and not the educational establishment. The Council noted that those actions incited to discrimination against the applicants, and that the phone call would unavoidably have negative implications on the faculty's attitude towards the applicants. The Council underlined that the Border Police of the Republic of Moldova had unjustifiably requested confirmation from the applicants' educational establishment on their status, despite holding their legal permits to stay in the Republic of Moldova. The Council deemed the actions as disparaging and used to track people of certain ethnic groups or races by their appearance and physical traits with a view to subjecting them to tighter checks and restricting their freedom of movement without providing an explanation.
